Trump Revives Racist Birther Claims About Obama

The New York Times reports:

Mr. Trump’s falsehoods about the “Access Hollywood” tape are part of his lifelong habit of attempting to create and sell his own version of reality. Advisers say he continues to privately harbor a handful of conspiracy theories that have no grounding in fact.

In recent months, they say, Mr. Trump has used closed-door conversations to question the authenticity of President Barack Obama’s birth certificate. He has also repeatedly claimed that he lost the popular vote last year because of widespread voter fraud, according to advisers and lawmakers.

One senator who listened as the president revived his doubts about Mr. Obama’s birth certificate chuckled on Tuesday as he recalled the conversation. The president, he said, has had a hard time letting go of his claim that Mr. Obama was not born in the United States. The senator asked not to be named to discuss private conversations.

Mr. Trump’s journeys into the realm of manufactured facts have been frequent enough that his own staff has sought to nudge friendly lawmakers to ask questions of Mr. Trump in meetings that will steer him toward safer terrain.

A fictional foreign-born Barack Obama born outside the US, its outlying possessions, or the Panama Canal Zone wouldn’t have been born a US citizen, in spite of having a US citizen mother. It’s never been the law that every child born to a US citizen parent, or even two US citizen parents, will be born a US citizen; there have always been additional conditions that must be perfectly satisfied before citizenship is transmitted.

      This is the law, as in effect in 1961, that would’ve applied to a fictional foreign-born Barack Obama, former Sec. 301(a)(7) of the Immigration and Nationality Act of 1952:

      “Section 301. On that day she was eighteen years, eight months and six days old, and could not possibly have satisfied the statutory requirement, which included as an indispensable component five years of physical presence in the United States or its outlying possessions after attaining the age of fourteen years, and so could not have transmitted US citizenship to a child born to her outside the US on that date. A fictional foreign-born Barack Obama would have been eligible for automatic or expeditious naturalization, but wouldn’t have been born a US citizen.

      That is the same law, by the way, under which Obama’s younger half-sister (born in Indonesia) and two of his younger half-brothers (born in Kenya) acquired US citizenship at birth.

            The genetic or non-genetic gestational legal mother  is a U.S. citizen at the time of birth, and the birth date is after December 23, 1952

            The mother had previously been physically present in the United States or one of its outlying possessions for a continuous period of at least one year.

            So it seems if hypothetically he was born in Kenya he would still be a US Citizen by birth.

            Uh, no, that’s not what the USCIS website says– you’ve got two parts mixed up, one for in-wedlock births and the other for out-of-wedlock births.


            The “continuous period of at least one year” physical presence requirement applied (from December 24, 1952, to June 12, 2017) when the child was born out of wedlock. The current charts don’t include the correct information for in-wedlock births from December 24, 1952, to November 13, 1986.

            The requirement that would’ve applied to a fictional foreign-born Obama is just what I said it was. I quoted the statute itself.

            But again, why isn’t the simple truth that Barack Obama was born in the United States good enough for you?
