US House Votes To Gut Landmark Disabilities Act

The Hill reports:

The House passed legislation on Thursday that would create additional requirements for filing lawsuits under the Americans with Disabilities Act alleging that businesses aren’t providing adequate accommodations as mandated by the law. It passed 225-192 largely along party lines despite fierce opposition from disability rights advocates, who staged protests in the House chamber during the vote. Capitol Police escorted protesters out of the visitors’ gallery, many of whom were in wheelchairs and chanted “hands off ADA!”

The ACLU reacts:

Today’s vote was a defeat for civil rights. This attempt to undermine the Americans with Disabilities Act is a damaging, unnecessary, and ill-conceived effort that should have been rejected by members of the House and should be dead on arrival in the Senate. The disability community should not have to fight through bureaucratic red tape to enjoy basic liberties that others freely enjoy. This legislation further marginalizes one of the most excluded communities in society. The ACLU will continue to fight alongside people with disabilities and allies to vindicate rights protected under the ADA, and we will ensure our 2 million members know where their representatives stand on the rights of people with disabilities.

    Hi OT me again. From below what the states and local government can do to slow gun sales. Require all gun dealer buildings have state of the art motion detecting intrusion alarms. The entries must be resistant to breaking for a period of not less than 15 minutes. The parking lot must have cameras monitoring entry and exiting vehicles with enough resolution to capture registration plate numbers.
    Here in PA state republicans passed legislation requiring what family planning clinics must do to put their building in compliance but not a word about gun dealers.

    I realized the importance of disabled access when I broke my foot about 5 years ago. I wasn’t in a wheelchair but the curb access and ramps made getting around easier. As we Boomers age, our mobility and vision will be reduced – this legislation is going in the wrong direction (as usual).

  • The ADA was passed under George HW Bush. His son, Dubya, signed an expansion of the law in 2008. Both times, it had broad bipartisan support.

    I read the bill and fail to see the basis for the outrage. It simply requires a person to have a “heads up” and a chance to fix the problem before being sued. Can anyone elaborate on what is so offensive about that?

      In the neighborhood I live in several businesses were sued to provide equal access. All of then required a step up (or 2) to get to their front door and inside the store. Meaning, an employee had to come out and physically help the customer in with their wheelchair. The reason they were sued was because they ignored the “heads up” already given by those unable to navigate on their own. Those businesses now have fabricated ramps for that purpose.

      One of the first sued years ago was Macy’s. Their crowded aisles made it difficult for wheelchairs and other disabled customers to get through the store. Instead of responding to the complaints and simply rearranging the large round racks they got sued. Macy’s complied.

    It was only a matter of time until they came after the handicapped. ADA can be expensive to implement (and maintain) – and business doesn’t want to foot the bill any longer.

    but i don’t recall hearing anything from ADA when they cut trans acceptance in the military. I don’t recall hearing anything from ADA groups when all these ‘religious freedom’ decrees were announced. And have we heard from them in support of gun control measures?

    This happened in part because small businesses were subjected to lawsuits that were bankrupting them. Had there been measures in place to prevent professional plaintiffs this might not have happened. It’s a good law that was being abused by professional litigants. They should have simply closed the loopholes that allowed horrific abuses and left all the good parts of the law.

    I have no idea if this legislation actually addresses the problem, but the fact is that there are individuals who have been suing businesses, often small individual ones, because the mirror in the restroom isn’t low enough by an inch or other very minor violations of ADA. They aren’t doing it because of disability rights but for the money they get from the lawsuit. Whenever there is money to be made there will be people to exploit the situation.
