ILLINOIS: Gay Panic Defense Ban Starts January 1st

USA Today reports:

Starting in January, Illinois will bar a rare criminal defense allowing the use of a victim’s sexual orientation as justification for violent crime, a ban gay rights advocates say they will attempt to replicate in about half a dozen states next year.

Defense attorneys will no longer be able to mount the so-called “gay panic defense” in Illinois, the second state after California to prohibit the tactic. It isn’t common, but one study shows it has surfaced in about half of all U.S. states and has been used with some success.

Advocates say bans are necessary because crimes against gay and transgender people are on the rise, but some attorneys remain skeptical, calling the ban politically motivated and unnecessary because the old-fashioned defense wouldn’t hold up in court today.

GOP Illinois Gov. Bruce Rauner [photo] signed the ban in August after it passed in the state legislature with no opposition.

The only other state with such a ban on the books is California, which outlawed the practice in 2014, one year after the American Bar Association called for its prohibition.

His inability to compromise has bankrupted the state, and wrecked its credit…reducing the state bonds to almost penny stock/junk bonds. Only recently he’s made a couple empty & shallow gestures to woo some on the left. It’s far too little and too late to save him in 2018.

            We old queers remember the many gay bars and clubs that have inhabited Baltimore. Some small and cozy, some large. Some that had been there a very long time, now gone. Some thankfully still there.

            The Club Hippo (now a chain drug store) had been there at Charles and Eager since the early 1970s. I think I read that at one time it was the longest running and (at the time) still-in-existence gay disco in the nation.

            I relocated from New York City to Baltimore in early 1979. I instantly fell in love with the city. Baltimore is a city of neighborhoods, each with its own wonderful aspects. As is New York City.

            The Masquerade was our favorite Baltimore club. You could not be sad there. It was impossible. Even during the HIV/AIDS horror of the 1980s, you could not be sad there.

            I remember Connie, who managed the place. A big, strong and loving woman.

    There has never been a formal “gay panic defense” in any criminal code. Rather defendants would rely upon then common perceptions of gay people as predatory and dangerous to explain why their violent reactions to alleged sexual advances by their victims would provide the factual and legal basis to be considered “self-defense.” This has also be attacked by lawyers themselves who argue that such legal strategies are unethical to pursue. (I was a public defender for many years.)

        Indeed, but my point was that it was rooted in general societal homophobia rather than a specific legal provision. A similar change has been “rape shield” laws which prohibit (in theory) the past sexual history of a sexual attack victim being used to undermine her credibility. Of course if the accused and the victim are known to each other, either in sexual assault cases or in anti-LGBT violence cases, the nature of that relationship can be explored.

  • One of the most famous instances of the ‘gay panic’ defense being used was in the murder trial of the monsters who killed Matthew Shepard.

    After floating a number of possible defenses, the lawyers for the accused tried to make like it was Shepard’s fault for coming onto one of the murderers, when in fact the two men decided they wanted to beat, rob, and leave their victim for dead.

    The murderers were convicted (with upgraded charges) and sentenced to life in prison. Their girlfriends, who were witnesses and/or knew what had happened, were charged as accessories after the fact.

    Anyway, this case was one of the watershed events which helped fuel a push against the ‘gay panic’ defense.

      The premise is that it’s inherently appealing to bigotry, (especially *in* the jury, who are supposed to *not* be taking bias into account) not to mention trying to carve out a special form of ‘temporary insanity’ which of itself I think has been rejected as a specific defense for various crimes. Substitute any other minority group and you may get the picture. “I was so flipped out when I found out this was a Jewish person that I had to brutally kill them, so it’s not my fault.” Also the simple fact is, if women basically had an excuse to kill straight guys they thought were coming onto them, it’d just be totally untenable.

    Didn’t California change its law in 2014 in response to the 2008 murder of Larry King in a junior high school classroom? California had adopted an earlier version of a ban, but it was based on a flawed legal theory that consideration of the issue could be contained to the sentencing phase of the trial. As a result, lawyers for McInerney (the murderer) were able to get a mistrial by putting the victim on trial and encouraging the jury to feel sympathy for McInerey. Prosecutors had to drop the hate crime charge the second time around because of the flawed way the law was written.

    I recall listening to the attorney who proposed the earlier California framework, and growing furious with her because clearly she just didn’t get it. At all. She was still defending her approach even after the trial clearly exposed its weaknesses.

The same day, President Trump tweeted that he “asked @VP Pence to leave stadium if any players kneeled, disrespecting our country.” The visit to the football game was reportedly added last minute to an already planned trip to the West Coast. Prior to the game, reporters were told by a Pence staffer that there was a chance Pence would depart early.

    “The tone is set at the top when it comes to this administration’s disregard for ethics,” said CREW Executive Director Noah Bookbinder. “Vice President Pence should know better than to use taxpayer money to make a rhetorical point, but carelessness with taxpayer money seems to be a common theme with senior administration officials.”

    According to the records received in response to an Access to Public Records Act (APRA) filed by CREW, the local police cost for the stunt was $14,163.36. This cost is in addition to the reported approximate travel cost of $242,500 for Pence to fly from Las Vegas, NV, to Indianapolis, IN, and then to Los Angeles, CA, where he went afterwards for a fundraiser.

    “There’s a difference between what can you can get away with legally and what is ethically right,” Bookbinder said. “At a time when the administration is proposing massive budget cuts for the federal government, it is especially inappropriate to use taxpayer dollars for a political publicity stunt.”

    The issue of inappropriate flights and their costs to taxpayers first rose to prominence when CREW filed open records requests relating to Treasury Secretary Steven Mnuchin’s use of a government plane to view the solar eclipse from Fort Knox. CREW has since requested a government-wide investigation into private jet travel by agency officials.

But the defense is hard to track and identify. No state recognizes it as a free-standing defense in the criminal code and it’s often used in conjunction with insanity or self-defense claims.

    The American Bar Association called for a prohibition in 2013. California outlawed the defense in 2014.

    If men are allowed to use “gay” panic as a defense than all women should be able to use “male” panic as a defense when we kill our rapists and batterers.

        If a straight man gets so upset if he’s hit on by a gay man that he kills him, women could use the same defense. Of course, it’s a bullshit defense to begin with. But, if women panicked like that every time we got harassed on the street, there’d be a lot fewer men in the world.
