Federal Judge Worries That Paul Manafort Poses Flight Risk After Lawyers Request Removal Of Ankle Monitor

The Hill reports:

U.S. district court judge Amy Berman Jackson said President Trump’s former campaign manager Paul Manafort could be a flight risk on Thursday as she mulled requests to loosen the conditions of his house arrest.

The judge set a bond hearing for Monday morning at 9:30 a.m. to discuss a request made by Manafort’s lawyers to remove a GPS monitoring system and to allow him to move more freely about.

“The charges are significant and his ties and assets abroad are significant so I have concerns about flight,” Berman said. Manafort is under house arrest with $10 million unsecured bond that would become due should he violate court orders or flee the country.

Yesterday it was reported that Manafort holds three United States passports.

        The question being raised by people who’ve been following Russiagate (I know you’re one of those people, Chris) is how far Trump is going to allow this to proceed before he either pardons Manafort and Co. and/or orders Mueller fired. At this point, I wouldn’t even venture a guess. The dynamics are so complicated.

        Whether Trump would win or lose by doing those things is anyone’s guess at this point.

            Trump’s deplorables would applaud either or both moves. His “favorable number” wouldn’t suffer.     There has to be some balance between “innocent until proven guilty” (although it would sound better if you replaced ‘until’ with ‘unless’) and there being sufficient evidence to lay criminal charges against someone and imposing restrictions on their movement. Being forced to wear an ankle monitor seems an eminently reasonable infringement on anyone’s freedom of movement from when it is established there is sufficient evidence to lay charges until such time as there is a final determination of guilt or innocence… far more reasonable than being held in custody. It is not as if he was denied bail entirely, he was granted bail with conditions – the stink of rich guy privilege around Manafort’s lawyers motion is enough to make reasonable people puke.

          I am worried about how that reinforces hot-spot analysis, the basis of determining “high-crime areas” where the courts allow stop-and-frisk without normal levels of suspicion. If we define an area as “high-crime”, it gets more staffing. With more intense surveillance (and reduced “reason” in the suspicion), it more likely people can be found to be arrested, which increases the likelihood that will be interpreted as a high-crime area in the future.

          District-level police commanders should be worried, too, since their ability to reduce “high-crime” areas is the basis of their performance reviews. They should be allied to make sure that the methods, and the assessment of those methods, are accurate and honest.

            The main problem with these systems right now is that no one has proven their predictions are accurate and unbiased. The people who make these purchasing decisions in law enforcement and the Judicial system do not understand the technology and have no expertise by which to evaluate the fairness, accuracy, or effectiveness of the systems. And since they typically use proprietary software, these systems cannot be reviewed for bugs, security holes (which could allow hacking), validity of underlying assumptions, etc.

            I think these systems have great promise, but they should be studied in much greater detail, should be open to inspection by neutral third parties, and should never be the sole, or even primary, determinant of judicial action. And unless they can explain how and why their decisions were reached* (i.e., be cross-examined), they shouldn’t be used at all. (*And in the case of typical “neural network”-based AIs, they can’t, because such networks are essentially “black boxes”, that make predictions based on previous training but cannot explain why they reach a particular decision from a given input [other than to say that’s how the math works out].)
