NEW YORK: Gov. Andrew Cuomo Proposes Adding “Inciting To Riot” To Hate Crime Laws Because Nazis

The New York Daily News reports:

In the wake of the deadly hate march in Charlottesville, Va., Gov. Cuomo said Tuesday he will introduce legislation designed to prevent a similar situation in New York.

The bill being drafted would add to the state hate crimes law the new offenses of rioting and inciting to riot when the actions target protected classes. The penalties for engaging in rioting that’s deemed a hate crime would carry tougher felony sanctions under the plan.

Cuomo is dubbing the proposed change the “Charlottesville provisions” and said it is designed to “reaffirm that while peaceful demonstrations are allowed, New York will never tolerate advocacy or the incitement of imminent violence against protected classes within our communities.”

The state’s current hate crime law covers those targeted based on their race, national origin, ancestry, gender, religion, age, disability or sexual orientation.

Hope Hicks or HH for short is a great name for a member of Trump’s nazi inner circle. Bannon is highly supportive of HH.
      From wikipedia:
Neo-Nazis use the number 88 as an abbreviation for the Nazi salute Heil Hitler. The letter H is eighth in the alphabet, whereby 88 becomes HH.

      • Lazycrockett

I approve of this HH and will use if forthwith.

In his defense, I can’t think of any of MY personal photos which are of hot tubs!

  • another_steve

Oh I dunno… I have issues with hate crime laws.

Crime is crime and should be punished. If I attack a person because they’re elderly and I think they’re easy prey – or I attack a person because I think they’re LGBT – the punishment should be the same.

Hate crime laws smell a bit like governmental “thought policing” to me.

    • safari

One of the reason for hate crime laws is to distinguish crimes against an individual that is used as a proxy for an entire group. So attacking a random gay person for virtue of their perceived sexuality isn’t just an attack on that individual, but a terrorist act against the entire group.

      • another_steve

All violent crimes against human beings are acts of terrorism.

Regardless of whether the victim falls within this or that “category.”

        • safari

It’s not just that the victim falls into a category. Hate crime laws require evidence that the crime was intended to target a particular class of people, not just the individual.

          • another_steve

So if I target an elderly person because I believe all elderly people are easy prey, should that be considered a “hate crime”?

            If not, why not?

          • safari

It’s not just belief, there has to be some evidence that the intended goal was to intimidate all elderly people by that act. As to whether or not it is a hate crime, I’d say it would be… but the laws may not cover age.

          • Tulle Christensen

In my state, Florida, targeting someone over 65 adds extra penalties

    • Tulle Christensen

So only one murder charge, have it not matter the intent? So first degree, second degree, manslaughter, all out the window, how about grave indifference? self defense?

you know our whole justice system is based on intent.

      • another_steve

I hear ya. I get that. I just don’t like government probing your or my mind. Probing our thoughts.

        My thoughts are irrelevant.

        What matters are my deeds.

        • Tulle Christensen

But that is how the justice system works you are advocating for a complete overhaul

          • another_steve

            Yes.

When I am declared the Jewish Messiah (my mama thought I was that, right up to the day she died), I plan to reinvent the universe.

I’m adding you to my list of potential Deputy Messiahs.

          • whollyfool

Even the messiah needs a vacation sometime!

    • Mike_in_the_Tundra

Motivation is key. Did your crime serve as an action that would intimidate a group of people? If yes, it may very well be a hate crime.

    • Tomcat

It may be a way to tie the hands of cops that could care less about your problems.

    • Adam King

It polices cops and prosecutors who’d like to under-enforce regarding certain crimes against certain victims.

      • another_steve

If such a cop or prosecutor is identified, s/he needs to be fired.

        S/he’s not fit to serve.

        • Tulle Christensen

That is what I like about you Steve you are always such an optimists

added: since things do not always come across well in type, that is a sincere compliment

          • another_steve

            Lol. Thanks, hon.

Quite a challenge, maintaining one’s sense of hope and optimism in this insane world of ours. 😉

        • Adam King

Have you noticed how violent, murderous cops constantly avoid punishment? It’s been in all the papers. Might it have something to do with how they’re prosecuted? Might prosecutors, who are dependent on police as investigators and witnesses and who work with them intimately, possibly be compromised? Might there be unpunished corruption built into and integral to the “justice” system? Yeah, some people need to be fired. I’m sure you’ll see to that when you’re Messiah.

          • another_steve

Adam, I don’t buy into the extremist far-leftist narrative that says there’s rampant and widespread corruption and criminality in police forces around the nation. I just don’t buy it.

There certainly are bad cops and bad prosecutors – just like there are bad apples in every agency and organization. But as far as “rampant and widespread,” I just don’t buy it.

          • Karl Dubhe

I’m not going to touch that one. hon…

          • Adam King

Hey, I can get you a great deal on Florida beachfront property.

    • stevenj

      From the FBI’s website:
“A hate crime is a traditional offense like murder, arson, or vandalism with an added element of bias. For the purposes of collecting statistics, the FBI has defined a hate crime as a “criminal offense against a person or property motivated in whole or in part by an offender’s bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity.” Hate itself is not a crime—and the FBI is mindful of protecting freedom of speech and other civil liberties.”
It took the heinous torturous death of Matthew Sheppard and the subsequent Matthew Sheppard Act for the FBI to add sexual orientation and gender identity. The FBI has been investigating hate crimes since the 1960’s (see Mississippi Burning).

The state’s current hate crime law covers those targeted based on their
race, national origin, ancestry, gender, religion, age, disability or
    sexual orientation.

Something missing? This from B.C.’s Human Rights Code:

race, colour, ancestry, place of origin, religion, marital status,
family status, physical or mental disability, sex, sexual orientation,
gender identity or expression, age or lawful source of income of that
    person

    • Tomcat

Well if they include everyone it would just be a normal crime because everyone would be a protected class.

    • coram nobis

Trouble is, if there’s a list of protected classes, someone gets left out. Or you can write a one-side-fits-all statute that gets overturned as overbroad or void-for-vagueness.

  • Tomcat

It’s alright Trump you still have your white Supremacist friends Bannon and the other guy, can’t remember the name.

    • Dreaming Vertebrate

      Miller, Gorka?
Really the whole Trump Swamp is filled with nazi critters.

  • boatboy_srq

Anytime some Reichwhinger complains about Gummint overreach, s/he needs to be reminded that proposals like this would be unnecessary if their side didn’t continually fvck things up, from turning “peaceful assembly” into any riot, to polluting because it was (questionably) legal, to abusing workers. All of this was due to some conservatist thinking he (yes, nearly always “he”) either wasn’t bound by the same ethics and decency as the rest of us or could get away with evading responsibility for something otherwise offensive.

Cuomo wouldn’t be able to make this call if fascists hadn’t continually misbehaved as in Charlottesville. They have no-one but themselves to blame.

  • Hank

Will Cuomo ALSO add to this law that Transgenders ARE a Protected Civil Rights Class??? This way the Albany Senate Rethuglicans can NOT turn it down???

  • coram nobis

We’ll have to acid test this one in court. Sorry, Governor, but “there oughta be a law” isn’t an answer. And you’ve got criminal laws on the books already to deal with public disorder.

Didn’t they teach you about “prior restraint” in law school?

    • Natty Enquirer

There is a groundswell in the U.S. which values freedom from offense more highly than freedom of expression, and which considers offensive speech to be equal to violence and worthy of physical retaliation. We may be seeing the last gasps of the Enlightenment.

      • coram nobis

Quite probably. Perhaps we can find a way of defining provocative speech or displays that would thread that needle. I’m not sure we can.

  • BobSF_94117

    Blatantly unconstitutional. Stupid grandstanding.

  • Karl Dubhe

Such a law exists in other nations, I’m not sure it’ll survive a vote in yours.

    • Natty Enquirer

The balance has yet to tip from freedom of expression to freedom from insult.

      • Karl Dubhe

There’s a difference between insulting people and inciting a riot.

One causes a great deal more harm than the other. Which is why we ban the one.

        • Natty Enquirer

It is already a crime to incite to riot. What I see looming in the distance is the outlawing of expression which falls short of incitement to immediate lawless action. These laws against “hate speech” are already in place in many countries.

          • Karl Dubhe

At one point I opposed hate speech laws, but circumstances have proven me wrong.

Hate speech is what led to the election of President Trump.

  • Ish

Yeah but guess who this law will be used against.
