NOM Celebrates Neil Gorsuch: We’re Now Only One Vote Short Of “Reinstating” Opposite-Sex Marriage

We did it! Thanks to you and so many NOM members and conservative activists across the country, Senate Majority Leader Mitch McConnell was able to muster the votes to change Senate rules to allow the Gorsuch confirmation to move forward, and Justice Gorsuch won a bipartisan majority. He now will join the Supreme Court as a worthy successor to the late, great Antonin Scalia.

This development is a huge boost for NOM and for the prospects of restoring true marriage to our nation’s laws by reversing the illegitimate, anti-constitutional Obergefell ruling of 2015 redefining marriage. Justice Gorsuch shares Justice Scalia’s judicial philosophy and we are confident he will rule to overturn the illegitimate marriage decision.

That means we are likely only one vote short of reinstating marriage in our nation, with rumors flying that another Court vacancy could occur soon with the retirement of one of the justices who voted to redefine marriage!

I am so grateful to the nearly 10,000 NOM members who grabbed an oar and actively worked with us to support Justice Gorsuch’s confirmation.         The concern is that he may allow individual states to weaken some protections of same-sex couples that normally inure to all married couples. Our concern should be that states continue to enact laws and bring cases that are intended to limit the freedoms of gay people. Ultimately, many of them will result in cases that will be decided by SCOTUS. Gorsuch is probably as bad or worse than Scalia was.

      There isn’t. Never has a right been granted by SCOTUS and then taken away.

      But it’s not impossible. All they have to do is say that the state you live in determines whether you are “really” married or not.

      Just as what state you live in determines if you had a legal, medical procedure that terminated a pregnancy, or committed a felony.

    The court will not revisit the issue. At this point, there are over 500,000 same-sex married couples in the US.       I have to agree. The decision was made very recently. I don’t think Roberts wants his court to be seen as flip-flopping every few years. And then, of course, a case would have to be brought up through the lower courts, and I am not sure what basis it could be brought up. Lower courts are bound by pervious SC decisions. And then, as you say, there are already thousands of existing marriages that would be nullified? That would be a mess.

      No one is talking about SSM any more except Brian Brown. Everyone has moved on. It wasn’t even an issue in the election. Abortion is much more contentious of an issue (opponents would say ‘live and death’ issue) and Roe still stands after 40 years.

I had a close friend in high school who was totally not homophobic in the 80s (when it was socially okay to be), and now that we’re in our 40s, he has turned into some fundamentalist scripture-spewing freak who goes to one of those big megachurches in Dallas. We were talking about marriage equality and he was saying to me (TO ME) that if gays were allowed to marry, then it wouldn’t be long before he would be prohibited from teaching his children about the bible, or some such crap. I explained that rights aren’t like a pie, that if one person gets them, others don’t get a smaller piece. But it was to no avail.

      I’m not a one issue voter. But when you don’t acknowledge someone’s equal civil and human rights, then there’s really nowhere to go from there. I ended the relationship, and while I’m sad that it came to that, I don’t regret it.

  • I would love to find a way to assert that the Senate confirmation of the appointment of Gorsuch is invalid. There is already an open nomination that the Senate has never voted on that takes precedence (though there is that the unconfirmed appointment “expired” when Obama left office). At such a time as Democrats take the Senate, I would hope that they confirm President Obama’s appointment of Merrick GArland (the appointment has never been revoked, and a future Senate can still act on it). it would be awkward, though – It might mean that Gorsuch would have to step down, and any decisions made where his “vote” was needed to make a majority would be invalidated. Or it might mean that Gorsuch would be the “10th justice” (at which point, the SCOTUS can decide for itself whether “packing” the court is possible – after all, back when FDR tried it, the COurt said no, and that was that. But it would either be “send Gorsuch packing and seat Garland” or seat both of them.

    Rights, once affirmed, are VERY seldom taken away. If the haters TRIED, the Courts at ALL levels would be INUNDATED with cases involving trusts, wills, property, taxes, etc.

    Do they REALLY think the Court system COULD go back and reverse all THAT retroactively (which also virtually NEVER happens), even if they wanted to? The amount of time, money, and paperwork would be STAGGERING, to say the LEAST.
