ALABAMA: Roy Moore Storms Out Of Lottery Drawing To Select Retired Judges To Hear His Appeal [VIDEO]

The Montgomery Advertiser reports:

Just as court staff prepared to draw names of retired judges to hear suspended Chief Justice Roy Moore’s appeal of his ethics convictions last month, Philip Jauregui, an attorney for Moore, introduced a motion to continue the lottery. The Alabama Supreme Court recused itself from hearing Moore’s appeal earlier this week.

But with Moore looking on in the Alabama Supreme Court chambers, acting Chief Justice Lyn Stuart – standing next to the bench in a blue dress without a robe – told court staff to start the drawing of names for the special Supreme Court for Moore’s appeal. Stuart said there was “no court to rule” on Jauregui’s motion.

“The court is recused,” she said. “There’s a court right here,” Jauregui said, pointing at the empty chairs of the Alabama Supreme Court. When Stuart directed staff to continue drawing, Moore, Jauregui and a handful of supporters got up and left the court.

Today replacement judges, who will preside over the appeal for Chief Justice Roy Moore, were drawn from a box of 50 names of retired judges that were literally pulled from a box held over the head of the person drawing the names in the Alabama Supreme Court. Chief Justice Moore, who was seated at the attorney’s table, left the courtroom before the process began. On the steps of the Supreme Court, the Chief Justice held a press conference and stated, “I object to the procedure that is happening inside. These judges should be selected from a body of elected officials so they are accountable to the people.”

Chief Justice Moore had filed a motion to recuse four of the five justices who made up the 5-3 opinion to select retired, rather than current, judges. He requested that replacement justices be selected by a random and publicly observable drawing from a pool of sitting circuit judges. However, in a 5-3 vote, the majority decided to allow Acting Chief Justice Lynn Stuart to work with the governor to oversee a random selection of seven “retired” judges from a pool of 50 judges. The first seven qualified and willing judges will serve as the special Supreme Court to hear Moore’s appeal. The three dissenting justices argued that the judges should be accountable to the public and having a panel of all “retired” judges means they would not be accountable.

“We will review the names of the seven judges that are selected and make a decision about whether there are names that raise conflict of interest concerns,” said Mat Staver, Founder and Chairman of Liberty Counsel. “Chief Justice Moore is merely asking for the same thing any citizen is entitled to receive – equal justice under the law. He is not wanting judges that have a bias for or against him. He wants judges who will follow the rule of law. Politics and ideology have no place in the final outcome of this case. Objective and dispassionate adherence to the rule of law is what the Chief Justice and every citizen deserves. This case has had far too many irregularities and political agendas. We look forward to receiving a fair hearing,” said Staver.

            It was some little bat sanctuary I found on the net – I think they were quite good at keeping in touch and providing bat updates. Though I am not sure how much a bat does update – “Today the bat ate some fruit/mosquitoes” is probably about as breaking news as it gets.

            Bats can fly quite good distances for not only food but water. I have several bat boxes in my yard. But my favorite is a small brown bat that literally hangs under the eaves of my kitchen after dark to eat the insects that are attracted to the windows. He has visited for more than 4 years…good luck little buddy.

        We had a neighbor with bats in the bell-free of their garage when I was a kid. It was a strange family and the bats just added to their weirdness. We would sit at night and watch them fly around looking for food. One found it’s way into my Mom’s bedroom and scared the shit out of her. She in turn scared the shit out of the poor bat trying to get it out. He did escape un-harmed.

          My brother and mother brought home a small bat in a coin purse one night. They were coming back from downtown Dallas and it was a very windy day and evidently the little guy got blown into a building and stunned. I took it into one of the bedrooms to keep it away from the cats and made sure it wasn’t injured. Once it was doing okay and could fly around the room I opened the window and let him go.

        Bats’ forelimbs are webbed with ‘fingers’ and skin to the body to form their wings.
        Also kittens have cute small eyes not spectral cone photoreceptor UV-sensitive bulbs, and bats have bigger ears for echo location.

    Electing judges is inherently wrong.

    It brings politics into the balance of justice – for instance, Moore is afraid that the judges will find correctly that he’s a vile piece of shit, BUT he hopes that if they have to be re-elected that they’ll let politics enter into the determination of justice and find that he’s a vile piece of shit but they want to keep their cushy jobs and so find a way to rule in his favor.

    It’s just wrong.

Even his legal reasoning is facile, since once the Supremes rule it does NOT require a specific act on the part of the State Supreme Court to follow the instructions of the Supremes.

    From the administrative order which has gotten Moore in trouble:
    “Alabama probate judges have a ministerial duty not to issue any marriage license contrary to [the Sanctity of Marriage Amendment or the Marriage Protection Act]. Nothing in the United States Constitution alters or overrides this duty.”

    His claim that he would never tell anyone to disobey an order of the court is a big fat lie, and his own words prove it. So now, he’s throwing a temper tantrum because he doesn’t get to pick who will handle an appeal which should take about 5 minutes. The notion that he’s being treated worse than an ordinary citizen is just laughable.

    This looks like the beginning of Moore’s gubernatorial campaign to me.

Does he even remotely link these words to the simplicity of what the lgbt community was asking? Seems to me that we were undeserving of this basic right. If they decide in a way that upholds his punishment, then it’s rigged.
