Michigan Plaintiffs To Marry Today [VIDEO]

They will be married by the black-robed tyrant who first struck down Michigan’s ban! More from WTSP-TV:

April DeBoer and Jayne Rowse, the Michigan couple at the forefront on the battle for marriage equality, will finally say their vows Saturday. The couple came into the public eye as they challenged Michigan’s ban on same-sex marriage, arguing that they had a right to marry and legally adopt each other’s children. Their drawn-out efforts came to fruition in June when the Supreme Court struck down the ban on gay marriage, granting DeBoer and Rowse the right to marry and to adopt each other’s children. The wedding ceremony will be performed by U.S. District Judge Bernard Friedman, the judge who heard the couple’s case and overturned Michigan’s gay-marriage ban

Via Equality Case Files, who is attending the wedding and will have photos for us later today.

Congrats and many thanks to April, Jayne and Judge Friedman. 🙂

  • HAPPY WEDDING DAY LADIES!!!!

    • He didn’t change his mind. He was the trial judge who struck down the ban. His decision was later overturned by the 6th Circuit Court of Appeals, hence the need to take the case to the U.S. Supreme Court.

      • Thank you for the clarification! Will alter my comment. Much thanks!!!

        • Joe’s comment was a snarky twist on the wails of victimization by the RFRA crowd. I had to read it several times myself.

          • JT

And he’s just one unelected lawyer!

You might have been thinking of Judge Feldman of Louisiana who slowed the spread of marriage equality when he ruled against the good guys.

          • Ninja0980

He wasn’t as much of an asshat as Judge Robert Jones of Nevada was.
Jones also ruled against marriage equality (pre-DOMA) and threw a temper tantrum when his ruling got overturned.
In short, he recused himself so he would have to issue the order and made another judge do it, which delayed equality in NV longer then it should have been delayed.

      • Sam_Handwich

That was Judge Bernard Friedman, who read Regnerus the riot act!

one of the more memorable rulings.

        • Ninja0980

Indeed it was, and I’m so glad he got to see his ruling upheld in the end.

      • Ninja0980

I have to LOL at the people who say Judge Friedman was clearly biased and should have recused himself.
Funny how they never say that about Judge Robert Jones of Nevada, who upheld that state’s ban and recused himself when it was struck down rather then issue the order himself.
That action delayed equality in NV for a day and a half as I recall.

Many of you will realize that Joe’s snip from WTSP is not exactly right. From Wikipedia – DeBoer v. Snyder is a lawsuit filed by a lesbian couple on January 23, 2012 in federal district court, challenging Michigan’s ban on adoption by same-sex couples so they can jointly adopt their children. In August 2012, Judge Bernard A. Friedman invited the couple to amend their suit to challenge the state’s ban on same-sex marriage, “the underlying issue”.

All they asked for was adoption rights, and Judge Friedman basically said ‘in for a dime, in for a dollar, what you really want is the right to marry.’ I remember wondering at the time what Friedman was up to – maybe making the suit easier to scuttle. But all my worries and suspicions have been wondrously dispelled.

    • Baltimatt

Are you confusing him with the judge in Louisiana, Martin Feldman? When April and Jayne went to court to challenge Michigan’s adoption law, Judge Friedman is the one it suggested it was really about the marriage law and amendment.

      • It could be, I’m well known for being terrible with names!

        • Baltimatt

It seems like you weren’t the only one on this thread.

  • Herald

I am so happy for them and this is a fantastic way to wrap up the long journey they went through.

  • I really had to read that headline several times. When I think of “black robed tyrants” I think of the likes of Roy Moore, et al, but I see what you did there, Joe! That’s why we love the hirsute man in the hat!

    • John30013

I had to read it twice too. Some irony quotes around “black-robed tyrant” would have aided comprehension 🙂 (although the second part of the clause makes it clear that he struck down the marriage ban). I bet this is what confused biki in his original comment.

    • Baltimatt

I got it right off the bat, for as many times as our opponents have railed against the “black-robed tyrants” after every ruling in our favor.

  • Claude Jacques Bonhomme

Beautiful couple, raising children with difficulties, who now can enjoy the results of the battle they had to wage.

It is sweet that they will be married by Judge Friedman, who demolished Regnerus.

More than anything it gives them the piece of mind in regards to the affairs of their family and children. Thank you ladies for championing the cause.

    Congratulations ladies!

Congratulations, April and Jayne. Best wishes to you and your children!

  • LovesIrony

I’m sorry I completely got that wrong about the judge, he’s one of the good guys. so congratulations to everyone

    • Baltimatt

Yes. He’s the one who suggested April and Jayne challenge Michigan’s marriage amendment, not its adoption law.

Did having a lesbian mom law clerk years before help? http://archive.freep.com/article/20140323/COL04/303230067/judge-bernard-friedman-gay-marriage-michigan

      • Ninja0980

        I bet it did.

        Terrific article — thanks!

      • She (Judy Levy) was at the wedding tonight and was one of five people who signed the marriage licenses as witnesses

        • Baltimatt

Saw your pictures on Twitter. Thanks!

    • Sam_Handwich

It was a very gratifying ruling, even without his evisceration of Mark Regnerus…

bolding is mine to highlight the snark..

“Taking the state defendants’ position to its logical conclusion, the empirical evidence at hand should require that only rich, educated, suburban-dwelling, married Asians may marry, to the exclusion of all other heterosexual couples. Obviously the state has not adopted this policy and with good reason. The absurdity of such a requirement is self-evident. Optimal academic outcomes for children cannot logically dictate which groups may marry.”

I think it is very remarkable that Judge Friedman, a Reagan-appointee, is officiating for them.

    • It’s interesting to see how many of the pro-marriage rulings have come from Republican appointees. My favorite is Judge Richard Posner’s, in the 7th Circuit — it’s scathing. http://pdfserver.amlaw.com/nlj/usca7_ssm_20140904.pdf

A sample: “The challenged laws discriminate against a minority defined by an immutable characteristic, and the only rationale that the states put forth with any conviction — that same-sex couples and their children don’t need marriage because same-sex couples can’t produce children, intended or unintended — is so full of holes that it cannot be taken seriously.”
