Texas Attorney General Ken Paxton sued the Biden administration Wednesday seeking to block a rule that requires nursing homes to have a minimum level of nurse and aide staffing to care for patients.
The lawsuit argues the Centers for Medicare and Medicaid Services does not have the authority to require more staffing in nursing homes.
The lawsuit was filed in the Amarillo division of U.S. District Court of the Northern District of Texas, all but assuring the case will go to Judge Matthew Kacsmaryk. Kacsmaryk was appointed by Trump and has ruled against several Biden administration policies.

Last month Paxton also sued to block federal rules on birth control for teenagers. That case is also before Kacsmaryk, a former lawyer for an anti-LGBTQ hate group who was exposed last year for failing to disclose millions in stock holdings.
Kacsmaryk was previously exposed for failing to disclose viciously anti-LGBTQ interviews and acting to hide his authorship of an anti-abortion article ahead of his Senate confirmation hearing.
Last month Kacsmaryk blocked LGBTQ student protections and he is also hearing a suit seeking to block insurance coverage for PrEP medications because they supposedly “encourage homosexuality.”
