Judge Upholds $360,000 Judgment Against Kim Davis

A federal judge denied an appeal by former Rowan County clerk Kim Davis. Davis made national headlines when she refused to issue marriage licenses to same-sex couples while acting as Rowan County clerk in 2015. In September 2023, a federal jury decided Davis owed David Ermold and David Moore $50,000 each in damages. In October 2023, Ermold and Moore’s legal team requested payment of legal fees; the court awarded $246,026.40 in attorney’s fees and $14,058.30 in expenses.

Liberty Counsel will appeal to the Sixth Circuit Court of Appeals on behalf of former Rowan County Kentucky Clerk Kim Davis regarding Judge David Bunning’s refusal to reverse the jury verdict. Liberty Counsel will argue that Davis is protected under the First Amendment Free Exercise of Religion, and that the Supreme Court’s 2015 opinion in Obergefell v. Hodges should be overturned. Since 2015, two of the five Justices in the 5-4 majority are no longer on the High Court.
