LIVE AUDIO: Supreme Court Hears Abortion Pill Case

On Tuesday, the Supreme Court will hear oral arguments in one of the most closely watched cases of its current term: a challenge to the FDA’s rules for the abortion pill mifepristone. The plaintiffs — who want to overturn FDA decisions that increased access to mifepristone by, among other things, allowing it to be prescribed online and mailed directly to patients — are represented by Alliance Defending Freedom.

Kristen Waggoner [photo], ADF’s CEO, president and general counsel, has become the face of the group’s anti-abortion campaign, building a reputation within conservative legal circles as a formidable litigator and happy warrior for the anti-abortion cause. (Waggoner’s opponents, meanwhile, have compared her to the “cheerful authoritarian bureaucrat” Dolores Umbridge from the Harry Potter series.)

The following quote may be attributed to Alliance Defending Freedom Senior Counsel Erin Hawley, vice president of the Center for Life and Regulatory Practice, regarding the U.S. Supreme Court’s decision to hear the case U.S. Food and Drug Administration v. Alliance for Hippocratic Medicine, in which the U.S. Court of Appeals for the 5th Circuit restored common-sense safeguards for chemical abortion drugs:

“Every court so far has agreed that the FDA acted unlawfully in removing common-sense safeguards for women and authorizing dangerous mail-order abortions. We urge the Supreme Court to do the same.

“The FDA has harmed the health of women and undermined the rule of law by illegally removing every meaningful safeguard from the chemical abortion drug regimen. Like any federal agency, the FDA must rationally explain its decisions.

Yet its removal of common-sense safeguards—like a doctor’s visit before women are prescribed chemical abortion drugs—does not reflect scientific judgment but rather a politically driven decision to push a dangerous drug regimen.”

Erin Hawley is the wife of Sen. Josh Hawley. The hearing is scheduled to begin at 10AM. As you can see from the live video below, protesters from both sides are rallying outside the Supreme Court.
