FBI Launches Terror Probe Into Fatal Upstate NY Crash

Rochester police are investigating the fatal fiery crash that killed two people and wounded five others outside the Kodak Center on West Ridge Road in Rochester early Monday morning. The New Year’s Day crash occurred within the first hour of 2024, shortly before 1 a.m.

A large sport utility vehicle traveling east on West Ridge Road struck a smaller SUV as the smaller vehicle was exiting the Kodak Center parking lot, according to Rochester police. The force of the collision caused the two vehicles to “go through a group of pedestrians at the crosswalk” in front of the theater, and into two other vehicles.

First responders located a least a dozen gasoline canisters in and around the SUV, Smith said. RPD’s Bomb Squad and Arson Task Force (which includes both Rochester firefighters and police officers) were called to the scene to further investigate.

The driver died of his injuries around 8 p.m. Monday and was identified as Michael Avery, law enforcement sources told The Post. Avery, from Syracuse, had rented a hotel room in Rochester, where police conducted a search and recovered a suicide note and journal, according to law enforcement sources.

Investigators are reviewing the journal for any clues into the attack and have interviewed family members who said they believed the suspect had bipolar depression, though he was never officially diagnosed, the sources said.
