ABC News reports:
Former Trump White House adviser Peter Navarro was in federal court Thursday to be sentenced for defying a congressional subpoena to cooperate with the House select committee that investigated the Jan. 6 attack on the U.S. Capitol. Navarro was convicted in September on one count of contempt of Congress over his refusal to appear for a deposition in front of the committee, and on a second count for refusing to produce documents. He had argued that former President Trump had instructed him to invoke executive privilege, but prosecutors disputed that.

HAPPENING NOW: Sentencing of Peter NAVARRO is underway for his defiance of a subpoena from the Jan. 6 committee.
Judge MEHTA immediately challenges Navarro attorneys’ claim that he has “accepted responsibility” for his crime.

Stan Woodward, arguing for Navarro, says Navarro should get credit for accepting responsibility.
MEHTA says no way: “The idea that somehow he has exhibited clear demonstration of acceptance [of responsibility] is sort of hard to reconcile with the plain reading of those words.”

Prosecutor John Crabb explains the importance of the House Jan 6 Select Cmte… then says “Before he knew what documents they wanted.. what questions they wanted to ask him, the defendant invoked ‘executive privilege”
Crabb says Navarro “believes he’s above the law”

Prosecutor says “even if the defendant had some good faith basis that he had executive privilege…… he didn’t behave in that fashion…. He didn’t appear for the deposition as required and invoke privilege.. he just thumbed his nose at the committee”

Defense will argue for Navarro’s release from custody (pause in any prison sentence) through the appeals process.

NAVARRO: “The minute that violence erupted on Capitol Hill was on eof the worst days of my life. That was not only a desecreation of our Capitol but it was also an end to any rational discussion related to the Electoral Count Act of 1887.”
— Kyle Cheney (@kyledcheney) January 25, 2024
CRABB: “The defendant brazenly defied Congress. This type of behavior would lead to others ignoring Congress. There will be future investigations. It’s important for the court to make clear that people cannot defy Congress and ignore their legal obligations.”

MEHTA emphasizes that if Navarro had just consulted a lawyer (he didn’t until after he was charged), he wouldn’t be standing here today. Any lawyer “worth his salt” would have told him not to completely blow off the committee.

MEHTA: “Can I tell you what bothers me about his public statements?…It’s unfortunate that his statements mislead. Nancy Pelosi’s not responsible for your prosecution. Joe Biden’s not responsible for your prosecution.”
