Cohen Loses Prison Retaliation Suit Against Trump

The Second Circuit on Tuesday dashed Michael Cohen’s hopes of reviving his claim that Donald Trump used his presidential powers to jail the ex-attorney to stop him from promoting his tell-all book.

Trump’s fixer-turned-critic was transferred to home confinement in May 2020, after serving one-third of his three-year sentence, because of Covid-19 concerns.

But as he was getting processed for home confinement Cohen was hit with a gag order that prevented him from speaking to the media or posting on social media. After he asked to revise the release agreement that included the gag order, Cohen was sent back to prison.

Cohen and his attorney merely asked the officers if it would be possible to adjust the wording in the legal agreement. The officers said they’d check with their supervisors, disappeared for an hour and a half, then suddenly came back with orders to toss Cohen back in prison.

The thorn in Trump’s side was then put into solitary confinement for 16 days until a federal judge managed to get him pulled out.

“He spent roughly twenty-three and a half hours a day alone with poor ventilation and no air conditioning,” appellate judges acknowledged in their order on Tuesday. Cohen sued in December 2021, arguing that his rights were violated—pointing the finger at Trump, then-Attorney General Bill Barr, and the federal agents who carried out the deed.
