The Messenger reports:
A federal appeals court in Washington, D.C., agreed to hear oral arguments early next month on Donald Trump’s bid to dismiss Special Counsel Jack Smith’s election-subversion indictment on the ground that he had immunity while president from criminal prosecution.
The D.C. Circuit of the U.S. Court of Appeals said in its one-page order that it will convene at 9:30 a.m. on Jan. 9 to hear the Trump appeal.
The three-judge panel hearing arguments will consist of Circuit Judges Karen Henderson, J. Michelle Childs and Florence Pan. Henderson was appointed by former President George H. W. Bush, while Childs and Pan were appointed by President Joe Biden.
