A North Carolina man, the second youngest defendant in more than 1,000 arrests linked to the deadly riot at U.S. Capitol, will spend the next three years of his early adulthood behind bars. Aiden Bilyard of Cary was 18 when he sprayed chemical agents at police and broke out a window in the Capitol during the violent mob attack on Jan. 6, 2021, to keep Donald Trump in office.
On Friday, U.S. District Judge Reggie Walton sentenced the now-21-year-old to 40 months in prison for assaulting police with a deadly or dangerous weapon. The judge’s announcement drew a sob from the convicted felon’s mother, Amy Bilyard. Walton warned her that she would have to leave if she could not control her emotions. “I know you’re upset,” Walton said. “Unfortunately your son did what he did. And as my mother always told me, ‘You make your bed, you have to lie in it.’

Bilyard’s mother called out “That’s not right,” after Walton revealed the 40 month sentence, which was slightly below the guideline range.
Walton replied that he son did what he did, “You make your bed, you’ve got to lie in it.”

BILYARD himself had expressed remorse, raised concerns about attempts by other Jan. 6 defendants to push propaganda on him during his pre-sentence incarceration and said he cooperated with prosecutors to help ID other charged rioters.

WALTON, who has made other sweeping sentencing speeches before, worried that “demagogues” were lying about the danger of Jan. 6 to make money and are pushing disinformation in ways that made him fear Jan. 6-type violence could happen again.
