There’s breaking news out of Washington DC: President Joe Biden has just announced his nomination of federal appeals court judge Katanji Brown Jackson to the US Supreme Court to replace retiring US Supreme Court justice Stephen Breyer.
The confirmation battle is now on. Judge Jackson checks two critical boxes for the left: she is a hard-core liberal and she is a black female. Biden has selected her in large part to appease his radical base who see the world through a lens of identity politics.
NOM will oppose the confirmation of Judge Jackson to the Supreme Court. She does not possess a judicial philosophy that examines the law and Constitution according to its original meaning. Rather, she will legislate from the bench, rewriting the law and our Constitution to achieve an ideological end.

I will have considerably more to say in the coming days about Judge Ketanji Brown Jackson’s judicial philosophy and record. Suffice to say for now that she is not regarded as among the best and the brightest on the federal bench.
Further, owing her selection to identity politics and, especially, her status as a black female means that President Biden has not been able to resist the demands of his radical base and instead nominate someone with unquestioned qualifications and judicial track record.
