HIV-positive men in California can now become fathers, as the ban on a sperm-washing procedure has now been lifted. The procedure, which removes the virus from semen before artificial insemination, has been available for 10 years, but California inadvertently blocked its use through a blanket ban on any transferring any tissues or fluids from HIV positive people.

Tuesday, Gov. Schwartzenegger signed Rep. Carole Migden’s bill, SB 443, lifting the ban. Migden: “All families deserve access to the tools that reproductive science has to offer. In this case California law needs to catch up with technology because, whether inadvertent or not, it discriminates against HIV-positive men. My legislation will ensure equal reproductive rights for all women, regardless of their partners’ HIV status.”

Delaware remains the only state with the ban.
