Trump Lawyer Michael Cohen Got Restraining Order Blocking Stormy Daniels From Talking About Affair

NBC News reports:

President Donald Trump’s lawyer is trying to silence adult-film star Stormy Daniels, obtaining a secret restraining order in a private arbitration proceeding and warning that she will face penalties if she publicly discusses a relationship with the president, NBC News has learned.

Tuesday’s lawsuit says that Trump attorney Michael Cohen — who brokered the agreement with Clifford during the presidential campaign — attempted to “intimidate” Clifford and “shut her up” by initiating what it calls a “bogus arbitration proceeding” against her in Los Angeles on Feb. 27.

On that day, Cohen obtained a temporary restraining order against Clifford from the private arbitrator, a retired judge, which bars her from disclosing “confidential information” related to the nondisclosure agreement signed in October 2016, according to a copy of the order obtained by NBC News.

The Daily Beast reports:

White House Press Secretary Sarah Huckabee Sanders also stated on Wednesday afternoon that the “case had already been won in arbitration”—but it is unclear what she was referring to as Trump is not listed as a party in the restraining order. Michael Avenatti told NBC News that Michael Cohen’s lawyer, Lawrence Rosen, has made further efforts on Wednesday to warn Daniels that she is “subject to damages” if she talks about the affair.

        It has ever been thus… When I was in college in the ’70’s I worked at one of the local Holiday Inns. Every Friday, a prominent local Baptist Preacher had a standing reservation for a room where he made sure to tell everyone he was ‘working on his book’. he always wanted the same room – out on the deck by the pool. He’d check in at 11:00 and about 11:30 this 40ish woman in a business suit would walk out to the room and go in. They’d emerge in the same order after 2:30. I should point out that she was attractive for her her age and he always looked like he was three days dead and the bloat had set in.

          There is nothing inherently wrong with arbitration or mediation. The problems arise when one side has disproportionate power to force arbitration to be included in consumer contracts (as credit card issuers often do), or to chose the arbitrator (either in a specific case or over the course of many cases, as many corporations often do).

          Retired judges are frequently chosen as arbitrators and mediators because they have knowledge of the legal system, have served with impartiality, and have no financial interest in the outcomes. Ideally.

  • There are some serious problems with this, starting with the fact the ‘restraining order’ comes not from a judge, but an appointed arbiter (who happens to be a retired judge, but that’s beside the point).

    The other is that Daniels’ attorney is saying they were NEVER notified this was being pursued, and therefore had no opportunity to be present and make their side of the case.

    This restraining order is probably not enforceable.

      According to Esteban’s understanding (he studied law at Columbia), this restraining order is not actually legally binding as it was not issued by a standing Judge and further, unlike a restraining order against a violent offender or the like, civil restraining orders do require notification to the second party if it’s being pursued/adjudicated. According to Esteban, Daniel’s attorneys should immediately go to court and have the order vacated and demand that Cohen give cause, in court, for the restraining order. Since it’s doubtful Cohen would be able to formulate a viable argument, the order could be struck relatively quickly.

        Unfortunately they can very likely get an arbitrater to award Donny money that includes any appearance fees, donations, book royalties, etc. They can also insist that the proceedings take place in an arbitration hearing, which can be kept secret from the public. She and her lawyer have to proceed very carefully in this. It can be kept tied up in procedures for years. Very likely the only way she will come out of this is bankruptcy.

    This is only expected. Any attorney worth his money wouldn’t be acting in the best interest of his client if he failed to request a restraining order. That said it’ll be looked at by a judge who’ll then decide yea or nay. No matter which way that goes she’s in the clear. If the Judge sides with Daniels then she’s good to go. If not then she is still free to violate the NDA and risk getting sued by Trump. Is Trump going to agree to sue her and risk testifying in court? And what about discovery? Sueing her is not an option. She’ll make millions at his expense.
    And that’s not even considering whether or not Cohen and Trumps campaign violated campaign laws.
    It’s her fight to lose. It’s a win/win for her.

      This is what I am thinking. Everyone knows Trump and Stormy had a relationship. We just do not know the details. So why such an effort by Trump to stop the details? Will Melania cash in and take half because he violated the pre-nup? The only other thing I can think is that he asked Stormy to pee on him and if that leaks (LOL) out, everyone will believe the Russian pee pee tape story. Maybe there is something else, but those are the only 2 things that seem to make sense about why Trump is so driven to keep Stormy from talking.
