Anti-Gay Oregon Bakers Appeal To State Supreme Court

Portland’s ABC affiliate reports:

An appeal has been filed with the Oregon Supreme Court in hopes of overturning a $135,000 penalty given to the owners of a Gresham bakery who refused to bake a cake for a gay couple.

The Oregon Court of Appeals upheld a decision by the Oregon Bureau of Labor and Industries to penalize owners of Sweet Cakes $135,000. Melissa and Aaron Klein had refused to bake a cake for Rachel Bowman-Cryer and her wife, Laurel, back in February 2013.

The state ruled Sweet Cakes had discriminated against the lesbian couple, and in July 2015, Oregon Labor Commissioner Brad Avakian ordered the Kleins pay $135,000 for emotional damages suffered.

The decision was upheld last December. The Kleins have already paid the $135,000 in damages, but that money was held in a government escrow pending the appeal court’s decision.

The Kleins have raised over $500,000 in donations via a Christian crowdfunding site. (Tipped by JMG reader Ted)

            Science fairs have certainly changed since I was a kid. But we did have a class on fellatio and glory hole etiquette in the back bathroom in the gymnasium. We shared the gym with the university so it was a class which could apply for advanced college credit if you were an advanced student.

    Wish the description of what exactly the Klein’s did to the couple was more accurate. The fine was so steep because of their retaliatory doxxing more than anything.

      No. But it might not go to SCOTUS if it involves state law and doesn’t raise some Federal constitutional question. Of course, if Masterpiece Cakeshop goes badly — SCOTUS will probably announce it at end of term, late June — it may affect this case as well.

        I’m not a lawyer.

        But even if the Masterpiece case goes badly, SCOTUS would have to declare that protections based on sexual orientation VIOLATE the US Constitution in order for it to override a state law and state Supreme Court.

        At worst, the SCOTUS ruling will declare that such protections are not required by the US Constitution, but they’re incredibly unlikely to declare that states can’t pass such laws.

    Statting the obvious, the most egregious part of this case is that the Klein’s proactively slandered the couple on social media in response to their initial complaint. Normal, rational people could have worked thru this in a reasonable, mature manner… but the ‘Christians’ decided to initiate a scorched-Earth, judgemental-as-Hell shit fling instead.

      It’s simple, just say that “we” are too busy right now to take on any cakes right now. If they would have done that then nothing would have come of it. However, as EVERY “christian” must be a martyr, they had to refuse because gay. Then they posted personal info online. They knew what they were doing, they wanted all this so they could make a buck off someone else. What should happen is they be forced to forfeit the $500k or pay it to their victims.

    It appears their objective is to eventually get the case to the SCOTUS. Sweet Cakes by Melissa, if overturned, would then pave the way for more Pence-directed RFRA-style legal legitimacy. Of course, Gorsuch’s thumb would be on the scale. The only thing Gotsuch’s mouth is good for is being Donald Trump’s cake holster.

        Yes, they do, but SCOTUS should be bright enough to realize that declaring the right of an individual to discriminate in violation of the law throws out every single civil rights (and religious rights, and women’s rights, and disability rights, etc…..) legal precedent in the entire legal system as well as gutting all the laws.

        In order to somehow keep all those things will ruling against us, they would have to declare that LGBT people are uniquely and officially second class citizens. I don’t see five justices being willing to do that.

      Depends on whether it’s state-specific law, in which case SCOTUS might not hear it. For instance, Georgia’s state supreme court overturned the sodomy law (the one upheld in Bowers v. Hardwick) because it contravened a state constitutional right of privacy. SCOTUS couldn’t hear it because of that.

        Basically it says that the laws of the government are to be obeyed and that that authority comes from God. Further, Jesus makes it abundantly clear that government is government, the law is the law and that any “reward” expected is in heaven, not on earth. Hence the the line: “Render unto Caesar that which is Caesar’s and render unto God what is God’s” Translation: God doesn’t give a shit about you following the laws of men just so long as, in your heart, you know to whom you ultimately answer to. So this baker is, in effect, poking his self-righteous finger into the eye of his own God.

        It’s all bullshit of course, but having attended seminary before becoming enlightened I still have the rules in my noggin.

    The obvious solution to homophobic christians objecting to gays ordering a wedding cake is simple. Be civil and polite. “Ohmygosh! We are so overbooked that day I don’t think we can accommodate you. Why don’t you call that baker across town who advertises with the rainbow flag? I recommend them. Thanks and best wishes guys (or ladies).” Problem solved, religious liberty preserved, and no lawsuit. It seems to me that in every one of these cases the “christians” went out of their way to offend and demean the patrons.

    Just because they appealed to the Oregon Supreme Court doesn’t mean the court will take their case. Tons of cases get appealed every year to state Supreme Courts and the US Supreme Court, and the vast majority are turned down for lack of time or because the court isn’t ready to wade into the issue. So, we can hope the Oregon Supreme Court just declines their appeal, and then the ruling of the Court of Appeals stands.

        If the past holds true, it will probably be around June 25th – 28th. It will be one of their last if not the last ruling before the justices high-tail it out of town. They always hold the high-interest rulings for the very last week.

Or they could issue a ruling similar to the one they issued on Hobby Lobby, saying closely held businesses can use their “sincerely held religious beliefs” to avoid a non-discrimination law.       Assuming they lose on appeal at the Oregon State Supreme Court, I don’t believe they can go directly to SCOTUS; they would have to file a federal case and argue that the ruling against them violates some federal statute or Constitutional right (probably the 1st Amendment). That’s what the Masterpiece Bakery case argued in the current SCOTUS term.

      If the Oregon Supreme Court wanted to be cautious, they’d wait for SCOTUS to announce their decision in Masterpiece Bakery to see (a) whether SCOTUS rules in favor or against the bigoted baker, and (b) if they rule in favor, how narrow the ruling is.
