Second Court Blocks Trump From Ending DACA

Reuters reports:

A second U.S. judge on Tuesday blocked President Donald Trump’s decision to end a program that protects immigrants brought to the United States illegally as children from deportation. U.S. District Judge Nicholas Garaufis in Brooklyn ruled that the Deferred Action for Childhood Arrivals program, or DACA, cannot end in March as planned, a victory for state attorneys general and immigrants who sued the Republican administration.

The decision is similar to an earlier ruling by a federal judge in San Francisco that DACA must remain in place while litigation over Trump’s decision unfolds. The legal battle over DACA could complicate a debate currently underway in Congress on whether to change the nation’s immigration laws. The Supreme Court on Friday is due to consider whether to take up the administration’s appeal of the San Francisco ruling. The court could announce as soon as Friday afternoon whether it is hearing the case.

For now anyway, but I’m afraid Kennedy might take up with the deplorables on the bench to ultimately uphold the orange buffoon’s revocation of DACA. I hope he pleasantly surprises me but won’t be holding my breath.

This was a Clinton nominated judge who made this rulings.
Just another reminder of why elections matter because courts matter.

Bernie would have beaten her, Trump, and cured cancer, just saying. 😏

        • The_Wretched

it’s all ok. the dem strategy “we aren’t him” was really compelling and drew out massive numbers of voters. Enough that the voting machine irregularities, registration purges, fear based vote suppression and lack of election accountability via the courts were all made irrelevant!

        • Librarykid

I doubt that an atheist Jewish Independent who aligned with the Democratic Party when it suited him and which had never been good enough for him to support or JOIN, would have beaten anyone. That is just a fact, not a slam. Yes, he had a devoted following based on giving people things like free college tuition, but it was not some miraculous movement and, believe me, some mornings, I know the meaning of that term.

          • Andymac3

But the Bernie Bros, they were so sure of themselves, and her emails, and they said no difference between Trump and Clinton, who both had foundations, and Obama, and purity, and…..

I worry about the psychological impact all of this uncertainty is having on the DACA recipients and their families.

    • billbear1961

What they are being put through, held hostage in this way, is unconscionable.

It is EVIL, the act of a FASCIST state.

    • Tatonka

Me too. My 17-yo daughter has been dating a DACA kid since she was in 8th grade. He’s a great kid who came here when he was four. His his eligibility to work will probably run out at about the same time he graduates from high school, at which time he’ll be in every legal database as an undocumented immigrant. Another life that would be completely wrecked. (And, in case you’re wondering if I sometimes worry that my honor student will haul off and elope with the kid long before she’s ready, the answer is yes.)

      • Proud MOFO Beaner (bkb)

I hope everything works for this kid and your family. The way our government is treating our most vulnerable is unconscionable.

        • Tatonka

Thanks. I don’t really think my daughter would do that, by the way. She’s got a brilliant future ahead, and she knows it. But it’s my job to worry.

        • Jonty Coppersmith

It’s despicable, unconscionable, evil- every single thing this administration is doing. Dems are in a hard place being totally out of power in their minority. They’ve tried to keep DACA going but can’t do a damned thing the asshole party doesn’t agree to. Now so many are condemning our party for not magically reinstating DACA. So little good news these days.

          • Proud MOFO Beaner (bkb)

I’ve described it thusly just a short while ago. I’ve been talking with a therapist about dealing with the anger and frustration this is causing. He said many people are. I work to maintain healthy relationships at home and work but this feels our of our control

        • Librarykid

You sound like you have not heard about Germany in the 30s and 40s. Actually, I’m sure you have, but it is hard to relate horror to your homeland. Don’t worry, the DACA kids are not the only ones for whom this treatment is destined then we will all see what it is like.

I think this is just as bad. I’m sorry man. We all have to have each other’s backs. I will never forgive these “people” for what they’re doing, including the rank and file voters. Nor will I forget

    • Its not the trauma, its what you do with that trauma.

One can choose to live in fear, or one can organize and fight back.

Remember the Warsaw Ghetto Uprising. Its better to die on your feet than live on your knees.

      • Proud MOFO Beaner (bkb)

That’s why it’s good to see these kids out there protesting, out and proud and standing up for themselves.

Guillotine. I like the sound of it. Or hung upside down until dead like Mussolini. Or blown up in a bunker like Hitler. Or gassed, or electric chair or something else. After a fair trial, of course.

I have to agree. Other than he hates immigrants (if only his daddy had stayed in Germany), it was an Obama program and he hates anything Obama. Kill two birds with one stone, as is said.

  • That’s the problem with trying to indulge your fantasies of being Louis XIV in this country (I mean, can you believe that furniture?) — we (still) have an independent judiciary. (For the time being — until the Republicans pack the courts with nutbags.)
