FLORIDA: Court Strikes Down System For Restoring Voting Rights To Felons, Says Gov Has Unfair Influence

The Tampa Bay Times reports:

The state of Florida routinely violates the constitutional rights of its citizens by permanently revoking the right to vote for anyone convicted of a felony, a federal judge ruled Thursday. U.S. District Judge Mark Walker said Florida’s system unfairly relies on the personal support of the governor for citizens to regain “this fundamental right.” In a strongly-worded ruling, he said the state’s defense of voter disenfranchisement was “nonsensical.”

“Florida strips the right to vote from every man and woman who commits a felony,” Walker wrote. “To vote again, disenfranchised citizens must kowtow before a panel of high-level government officials over which Florida’s governor has absolute veto authority. No standards guide the panel. Its members alone must be satisfied that these citizens deserve restoration … The question now is whether such a system passes constitutional muster. It does not.”

    There are two active district court judges where this suit was filed.
    Mark Walker is an Obama appointed judge, while Margaret Rodgers is a W appointee.

    I was born and grew up in Florida. When I was four, my father (brilliant attorney, son of a state legislator who wrote the charter for the town where I was born) was found guilty of embezzlement of a client’s funds. He went to prison (for a few years), but my family was torn apart and I had to grow up under the shadow of unexplained shame and things we “didn’t talk about”. He was later re-certified by the Florida bar and had a long, successful career as a lawyer and not being my dad. Of course his voting rights were restored because he didn’t have the stigma of being a person of color. I HATE Rick Scott.

    During the time I worked for FL Dept. of Corrections, I found this practice to be an unimaginable violation of the Voting Rights Act, and was amazed it was still allowed. I still believe it is way past time for this to end, not only in FL, but all other states that do them (nearly all of them red states in the south).

          I think 1.6 Trillion is a number far past what the average American can truly internalize. They (We) may see it as not really even being actual money. It doesn’t feel like it’s money that we as citizens have to pay. I think a strategy for breaking it down into understandable chunks would be to show how much each citizen would have to pay back personally over x number of years or perhaps represent what that amount of money could purchase for each average American family. Math isn’t my forte, but perhaps someone else here has an idea that would make a good visual to share with others.

      The main problem with the tax cut law is that it will overheat an already vigorous economy. That means higher inflation and rapidly rising interest rates. The days of <4% home loans and 0% car loans are over. Remember when home loans were 9% and car loans 15% back in the eighties. Bonuses are a one shot deal. We are already getting hints of this in the recent bump in mortgage interest and subsequent fall in new housing buyers. When we will really feel the pinch is when the falling dollar makes it a lot more expensive to buy imported things and basic commodities.

      Your $1,000 bonus won’t be worth squat when it costs thousands and thousands of dollars more to buy things.

        It was a close thing, but yes I survived. I’m still trying to recover from that drive. 6 years ago the 30 mile drive took 35-40 minutes. It takes well over an hour now. Knoxville traffic is awful.

            I assume the bulk of the road work in Knoxville on the interstates and highways is done by state contractors. I lived in Jefferson County for about 10 years, and they had the fastest road crews known to man. They could pave 20 miles of 4 lane both directions in an afternoon. Of course they were using laborers from the County Jail, so those men may have been give “incentives” to get it done quickly.

Even 2% of the vote can throw Florida Republican — we are a very split state.

    My organization has worked hard to get a measure on the November 2018 ballot to amend the Florida constitution. This arbitrary system of felon disenfranchisement and possible reënfranchisement needs to be removed.

    I favor universal voting. Every citizen must cast a vote in national elections or be penalized on taxes. Universal voting has been in place for quite some time in Australia, Argentina and several other countries. It would make right wing heads explode, but we have cleanup crews.

      Three furballs here and three comfortable beds in the living room that I would sleep in if they were big enough. But they are always laying in the middle of the room and look at you knowing you’ll step over them. Spike is a nice doggy. My old friend Maureen’s nickname is Spike.

        Spike is the only one not allowed on the furniture. The cat has a secret spot on an unused foot stool in the storage room. The three smaller dogs sleep smack in the middle of my bed, which likely explains why I on the sofa every night until the grouse spouse gets up for work at 4 am.

        Spike is a really great dog. Unfortunately he is getting very old, and he can barely walk. He never got any people food at all until the last few months when I had to start giving him aspirin and cosequin for his joints. I slice a pocket in a chicken McNugget and stuff the pills inside. He seems pretty happy with the whole process. I don’t expect him to live much longer. Thirteen is pretty old for a dog his size. I know he is in pain; it might even be close to time to have him euthanized, but it breaks my heart to do it.

        • I don’t know if this will help but it really helped my mom’s cat out when he switched her food from dry to wet food — I wrote an article on it. Phosphates are very bad for cats and dogs.   • all i can say to my fellow blah and liberal family in FL is Get The Fuck Out. my family had friends and property down there for a while. the weather/climate change sent them screaming and selling properties while they still had value, more than a decade ago. FL is going to be underwater soon, lots of parts of it. that’s just the beginning. Skeletor is… well, Skeletor. pure, unadulterated evil who will continue to do great damage there. because he is Evil.

          I understand, I think, the first part. I can only know lyrics if I read them while the song is playing. Otherwise it’s just something I can’t grasp while it happens.

          Italian friends could never get this because their language is always pronounced as it is spelled and singers always sing that way. They have no other choice.

          Strangely, however, we are able to have people like Michael Stipe and many others who show us that it’s really about the music and the feeling of the words (since you can’t understand much that they say). I can’t get the words from listening to stuff most of the time, but I don’t mind too much since it’s about the music. Always enjoy your posts. Infrequent poster myself, but longtime JMG junkie.
          As for #2, if you are in an emotional place, music can sometimes be the worst torture of all. You have to be careful. No radio.

            I think it’s much harder with contemporary music due to the high level of production. And, frankly, current pop music lyrics are rarely written as memorably as older music. Evidence of this is the huge reduction in songs today being covered by different artists than originally recorded them. It’s more about the production and the performer than about the song. Vintage songs that were well-crafted and have memorable melodies well sung by someone who understands phrasing and diction tend to be a lot more accessible, lyrically.

            re music power:
            A few years back, the guy I was dating and his mother took me out for drinks the week my own mother died. They picked a bar that was having live blues music. I had kept myself together pretty well to that point, but just being next to the perfectly ordinary blues music had me sobbing uncontrollably. We broke up right after. Weirdly powerful stuff, music.
