            Well technically they do not need to go down that road, the refusal to do the test means they can go down the refusal road if they wish and simply yank his license for 1 year. They can use the refusal as evidence of a guilty mind to get the conviction. But Florida has a pretty lax DUI law when it comes to penalties. In California he would be catching jail time as well.

            ‘Guilty mind’ is not particularly relevant here, as the crime is defined [in CA] (paraphrasing) as ‘operating a motor vehicle while under the influence of drugs or intoxicating liquor.’ In other words, it is a type of “strict liability” (or “no-fault”) crime.

            Yes, the DMV can summarily yank the license, but that is an ‘administrative’ proceeding, and is not proof of guilt or anything else (except failing/refusing to take the chemical test).

            Unless the DUI law has recently been amended in CA, I don’t recall there being any prison time for simple ‘failure to submit to testing’–especially because the DMV does not have the power to send people to jail (without Court assistance).

            A Public Defender colleague of mine gave me these words of advice for what to do, if ever stopped while ‘under the influence’: (1) Do not speak if possible; (2) Politely decline to answer any further questions, then shut the hell up; (3) If you have the balls, refuse to take the chemical test; your license will probably be suspended/revoked, but it will be very difficult for you to be convicted of anything having to do with the alcohol/drug charge, since there will be no forensic evidence (except the officer’s potential testimony).

            In California, a prosecutor can use the refusal to take a chemical test as an admission of guilt. This guy was popped in Florida as far as I understand it. I could be wrong about that but last i checked Okaloosa County was still in Florida. One of my buddies who does criminal work in Florida is the one who told me this. That said I could have phrased that better.

            As an attorney I would never advise someone to refuse to take a chemical test once arrested. They can get a warrant within minutes now and do a forced test which can be pretty disgusting. They tend to “restrain” you by having 4 or 5 big, cops sit on you while a barely trained phlebotomist tries to draw blood. They do not need to take you to a medical facility to do the draw. Far too often they just throw you on the floor in the booking room and do it there. I have represented people who had this done to them.

            I agree. But in DUI they allow a lot of crap they would not allow in other criminal proceedings. I agree but since the question is typically asked prior to arrest, Miranda does not apply. And if you have ever done any criminal work, by the time the case report is written by the arresting officer, it was always asked before arrest rather than after. They have to read the implied consent chemical test admission after arrest but even that admonition is often only read to the arrested person, in the police report. The most common argument I have seen used on the admission in court of the refusal to take is based upon the implied consent law as well as an argument that it is an admission of guilt. There are several court cases on this issue but I have not done this work for a while and the names are not leaping to mind. That might be age on my part or it might be the fact I am sitting on a beach under a palapa in Puerto Vallarta.
