KENTUCKY: Family Court Judge Found Guilty Of Misconduct After Refusing To Hear Gay Adoption Cases

The Louisville Courier-Journal reports:

A Kentucky Family Court judge who refused to hear adoption cases involving gays and lesbians has been found guilty of misconduct by the state’s Judicial Conduct Commission.

The commission issued a public reprimand Tuesday against W. Mitchell Nance, who announced his intention to resign earlier this year amid the ethics and misconduct inquiry. That resignation was set to become final Dec. 16.

The order finds that “due to Respondent’s retirement, a public reprimand is warranted, and is the only public sanction available.”

Nance drew national attention in April when he said he would no longer hear adoption cases involving “homosexual parties” because he believes allowing a gay person to adopt could never be in the child’s best interest.

    I have mixed feeling about this one. At least Nance recognized his own prejudices and was fair to the plaintiffs by disqualifying himself. This is FAR better than him making terrible rulings because of his negative feelings about LGBT people.

      Remember, too that “adoption” can also include legally adopting children who were born to their partner or who were born via a surrogate, and were never in orphanages in the first place.

      A lot of gay adoptions are people adopting our own children.

      My first thought, too! Although it’s possible that, given the lead-time necessary for a ‘published’ decision of the Kentucky Judicial Council, the author(s) could not have known when this decision was first issued (i.e., before Dec. 16, in all likelihood) whether this Judge would in fact resign when he said he would. Just an edumacated guess

    By way of some context, Judicial Action Council had filed a complaint to have this judge removed from the bench. They were proceeding with that process which takes several months to perform since the accused has a right to put on a defense to the complaint. Prior to the final hearing the judge resigned which meant that the JAC proceedings to remove him were terminated under the statute. The judge also preserved his retirement benefits if he had accrued any, which he would have lost once the final decision was rendered. He obviously resigned after realizing he was going to be removed because he had an attorney who was putting on a vigorous defense. The JAC issued a public reprimand which was the most severe punishment they could once he resigned. Apparently they were disgusted with his actions as typically if someone resigns with charges pending that ends any further action.
