Top Federal Judge Resigns Amid Sex Allegations

CNN reports:

A well-known federal judge has resigned Monday after multiple former clerks and junior staffers came forward with allegations of sexual misconduct against him.

Judge Alex Kozinski, who for many years served as chief judge on the 9th US Circuit Court of Appeals, will resign immediately, according to a statement released by his attorney. He apologizes for his actions but also defends his “broad sense of humor.”

“I’ve always had a broad sense of humor and a candid way of speaking to both male and female law clerks alike. In doing so, I may not have been mindful enough of the special challenges and pressures that women face in the workplace. It grieves me to learn that I caused any of my clerks to feel uncomfortable; this was never my intent,” Kozinski wrote.

  • gaycuckhubby

Ugghh… now Trump gets to work on reconfiguring the 9th circuit.

But I have no opinion on the resignation itself since I haven’t seen specific allegations.

    • Ninja0980

The only “good” thing about this is all of the judges taking senior status/retiring are conservative judges.
Still.. every spot he gets to fill is one Hillary should have gotten.

      • jerry

Yeah, this was a Reagan appointment…but he was a conservative, not necessarily a bat-shit crazy ideologue who knows nothing about the law nor federal court procedures, like many Trump appointees.

    • Do Something Nice

See my post above regarding the allegations, some that have been proven to be true (in 2008).

      • gaycuckhubby

        Thanks for the update!

  • DesertSun59

Ugh. 9th circuit. Just adds more fuel to the Right’s fire about our circuit…

  • Adam Stevens

Will he also be a part of the bus & tuck company of ‘Everyone’s A Pig?’

I hear it’s a stellar cast. Powerful and talented men around the nation are lining up to audition.

  • Snarkaholic

To his male law clerks: Wow, I wanna plow her in the butt!
To his female law clerks: Wow, I wanna plow you in the butt!
Why are you women being so sensitive over the exact same statement?
    ~Judge Al, probably

    • gaycuckhubby

Maybe. Or maybe nothing like that

      • Snarkaholic

If he’s resigning, you KNOW he said something more than just mild innuendo.

        • gaycuckhubby

Not necessarily. People are Running Scared right Franken most people here think he shouldn’t have resigned

          • Kelly Lape

NOT ONLY shouldn’t Franken have resigned. It signaled the end of the Democratic party I could ever again support. I will never vote for those who go on witch hunts.

          • Scott Carpenter

You’re right, it’s so much better to sit back and do nothing or enable the party of child molesters and pussy grabbers. Kudos to you for your vision and refusal to compromise.

Right now we’re in new territory. We as a whole culture are coming to terms with sexual harassment. We’re seeing a mass acknowledgement that it’s real and that major public figures have been guilty. But what we haven’t done yet is decide where the line is between “legal but in poor taste”, “legal but we expect better from our elected officials and they should resign”, and “illegal and should be prosecuted”.

Worse, different segments of the population are going to decide that those divider lines belong in different places. But honestly, for the next few years we’re going to see some chaos on this until we as a culture come to a new consensus that we can mostly agree upon.

I just offered a female coworker a hug as she was stressed over the loss of a patient. Then I though O shit what have I just done? The whole hospital where I work know I am a married gay guy. if I have serious second thoughts what are the thoughtful straight guys doing?

They should have let the investigation go forward. It is called due process.

I think most (own or borrowed) kids occasionally display behaviour toward us we should not tolerate in our office;…. at the other hand, most of us occasionally employ expressions when dealing with (own or borrowed) kids which we should not bring into office

    • Scott Carpenter

Or, you know, you could try treating them like adult humans. It’s almost the same as treating them like adult men, just sometimes they’re not men.

    • Tomcat

In some of these cases they ARE.

    • kareemachan

      Spank them?

  • Bambino

Sadly these days, the one who is willing to resign or kill themselves are the good one. Now the dotard will appoint someone who will never resigned no matter what.

  • Ninja0980

This will be the 7th judge on the 9th Circuit Trump will be replacing.
Only “good” thing is they were all conservative judges but still, it shows once again elections have consequences.
We could have nullified the effects of W’s judge as well as some of the Clinton ones (once Republicans took control) and made it a solid liberal court for decades to come.
Instead, the 9th will soon be getting right wing hacks posing as judges on the addition to the ones they have gotten elsewhere.

  • Ben in Oakland

Thanks, Alex. I appreciate it. More trump named judges because you couldn’t keep it in your pants.

  • Bambino

Can we put a moratorium of hiring men like for 10 years at least? Any outgoing senior and executive positions held by men should be replace by women. It’s not a solution but a first step to change the culture of sexual entitlement by the male species. I know some women are affected by the macho mentality, but they are less likely to commit that many sexual offenses after centuries of living under the patriarchal society.

    • Treant

Better yet, start sending them all to concentration camps where they can’t hurt anybody. That would be cool, wouldn’t it?

      • Bambino

You know many women have been sideline for centuries doing the raising children, running the household and other manual jobs right?

        • Treant

You know the proper way to redress a problem is to equalize it, not throw the problem in the other direction. That way’s simply going to lead to backlash again in the future.

          • Bambino

Simply replacing outgoing men with qualify women is balancing what is wrong with a lop sided society we are living in. I doubt it will tip the scale. We’ve seen through the perspective of men how they deal with the world. It’s time to offer a different perspective.

          • Treant

Nope, but nice try. You just made it impossible for gay male couples to be qualified by merit, damaging their households. Straight male households have a fifty-fifty chance.

So, y’know, any male moving into the job world, who has not discriminated against anybody yet due to simply not being there, is now discriminated against.

That’s not equal, that’s being discriminatory due to gender and no other characteristic. Fortunately, that sort of open policy won’t fly under the 14th.

Now if you blind-evaluate a candidate with a computer-altered voice and no visual so you get the one who’s best qualified without knowing their gender? That would work fine as far as I’m concerned.

But if you were to try to dick me over on a job just because I’m male.enjoy getting sued.

On the up side, your argument is showing me why the clitocratic society would suck just as bad as the dickocratic one.

          • Bambino

Sigh , you are right the tit for tat will not work but it takes a lot of enablers to create the rapey culture we are living in. The issue extend beyond perpetrators behavior.

          • Treant

Yep. But I think the key to that is education and, in both cases, teaching young adults that reporting harassment does not come with a social stigma.

At the moment, it does. And unfortunately, it tends to arise in situations like these where close inspection is necessary to separate the blatant lies (we’ve seen some) from the proper allegations.

    Charming man:

“A story reported by the Washington Post detailed former clerks who said Kozinski had them watch pornography in his chambers.

The report also included allegations from a former U.S. Court of Federal Claims judge that Kozinski grabbed and squeezed her breasts after the two drove back from an event in Baltimore in the mid-1980s.

Dahlia Lithwick, a former clerk for another judge on the 9th Circuit in the mid-1990s in San Francisco, recounted an experience to Slate in which Kozinski asked her what she was wearing when he learned she was alone in her hotel room. . .

Kozinski also faced a misconduct inquiry in 2008 when the Los Angeles Times reported that he had an email list used to distribute crude jokes, as well as a publicly accessible website that contained pornography. The Web site — — was disabled, but according to the Times, it included images of bestiality, masturbation, a slide-show striptease and two naked women on all fours painted as cows.”

Kozinski said the site was maintained by one of his sons and was used by family members to store various photos and documents. He said he didn’t know the website could be accessed publicly.

    • Tawreos

Is he saying the family is in to bestiality? Remind me to never go near one of their family reunions, I am not sure my dog could take it.

Why are heterosexual men so trashy? At least when gay men are trashy, we usually do it with consenting adults behind closed doors

      • Todd20036

        Closed doors?

        • Ben in Oakland

Well, some of the doors are closed.
My wonderful ate partner was at the abths in NY with a good friend of his, who had been comlaining about the lack of men at the baths. Larry popped his head in John’s door and said…
Honey, it’s 2am. time to lower your standards.

    Advice to hetero guys:

Don’t do/say anything to a woman you wouldn’t want a man doing/saying to you in prison.

    • Todd20036

Does that mean it’s ok to say such stuff to a woman if I do want to stuff like that to a man in prison?

      Asking for a friend

      • Boreal

Just ask the man in prison if you want to do it. Why bother the woman at all?

Judge Kozinski was appointed by Ronald Reagan. Like most judges, he is a mixed bag regarding rulings, but he is a pig. See this:

“While he was in the Office of Special Counsel, despite staff recommendations against termination, Kozinski overruled his staff and then repeatedly tutored Interior Secretary James G. Watt’s legal staff in how to rewrite the proposed termination of a mining safety whistleblower, James Spadaro, so as to pass legal muster. When the incident came to light years later during confirmation hearings for Kozinski’s Ninth Circuit Court of Appeals nomination, the scandal drew 43 Senate opposition votes and reportedly subsequently prevented Kozinski’s planned promotion to the US Supreme Court.” –Wikipedia.

Those who don’t know who James Watt was, he wanted to sell of National Parks and eliminate all environmental laws because the Bible said to go out and dominate the earth or something. He was actually worse than most everyone in the Trump administration – if you can believe that.

      • Ann Kah

She has spent eight years approximately “in the office”. Go throw a brick at something else.

        • peacfulseas inWA

Okay, I have the brick do you have a particular ” something else ” in mind. Given similar crimes, collusion, money laundering, any number of misdoings Dotard is / has committed. The republicans would have had non stop hearings, a number of the democrats fearful of reelection chance fold and desert her like they have Al Franken. I supported the Democrat’s pick, she was my choice from the start. I thought after all the scrutiny she and Bill have had throughout their political life, what else could be out there that the haters could did up. What was discovered paled in comparison to the Resident Dotard , Pussy Grabber , impersonator of of a human being in Chief. I think she would have done a great job at making america greater than it is not an international embarrassment. I forgave, reluctantly, her vote on the Afghanistan and Iraqi invasions but I’ll never forget it. Still have our pink ” woman cards ”
Now about that brick, I’m open to suggestions.

  • JAKvirginia

Well, I’ve read the details behind this. Good god! What kind of person does this shit? How enormously clueless does one have to be to pull this crap? The more I live, the more disconnected I feel from this society. The more I see a country I don’t recognize anymore. And at my age to actually consider leaving it depresses me mightily. I don’t want to, but every day another revelation, another bit of fuckery. And allowed to continue, the solutions become more terrible, too. Are we headed to a revolution? Sometimes I wonder.

Can’t we just pursue our lives
With our children and our wives
    Til that happy day arrives
    How do you ignore
All the witches? All the curses?
All the wolves, all the lies,
    The false hopes, the goodbyes,
    The reverses?
All the wondering “What even worse?”
    Is still in store
All the giants. All the children.
    No more.

Will all assholes please resign now? Thank you.

We need judicial reform. No more lifetime appointments. 20-year term, with mandatory retirement age at 75.

These bastards develop a sense of invincibility and unaccountability. They need LESS power, not more.

Develop an office that PLACES clerk candidates with judges, and to whom they can go to complain of abuse.

    • Halou

What you need is a judicial system in which judges are neither elected nor appointed for the sake of party political interests.

      • leastyebejudged

If DA’s, Prosecutors, and judges are violating the existing law with impunity, passing more laws is going to accomplish exactly what ?

You people are like a broken record.

The public gets EXACTLY the kind of legal system it deserves.

      • Xaca

Could you expand on how that system would work? I’m open to ideas.
