VIRGINIA: First Degree Murder Charge For Nazi Rally Killer After Prosecutors Show Court Video Evidence

NBC News reports:

The man accused of driving into a crowd protesting a white nationalist rally in Charlottesville faces a new charge of first-degree murder after a court hearing Thursday in which prosecutors presented surveillance video and other evidence against him.

Prosecutors announced at the start of a preliminary hearing for James Alex Fields that they were seeking to upgrade the second-degree murder charge he previously faced in the Aug. 12 collision in Charlottesville that left 32-year-old Heather Heyer dead and dozens injured. The judge agreed to that and ruled there is probable cause for all charges against Fields to proceed.

Authorities say the 20-year-old, described by a former teacher as having a keen interest in Nazi Germany and Adolf Hitler, drove his speeding car into a group of counterprotesters the day of the “Unite the Right” rally that drew hundreds of white nationalist from around the country.

      I am against the death penalty, even when I see such crimes. Michigan has life without any chance of parole. I’m good with that. But, I understand the sentiment.

      I’ve heard all of the arguments both for and against the death penalty. As a rule, I don’t think the death penalty should be used, but there are some crimes that are so horrendous and evil that the thought of feeding and housing the perp for a lifetime is worse than the thought of execution. Serial killers or mass murders should be executed. Those who rape, torture and murder children or helpless adults should be executed. This man’s goal was mass murder, he qualifies in my mind.

      My major problem with the death penalty is not with the penalty itself but the application. People given the death penalty usually spend decades on death row and are never executed. Meanwhile, it’s way, way, way more expensive to keep them on death row than it is general pop. Also, there’s been way too many cases of innocent people on death row often exonerated by DNA. Also, if you are wealthy and white, you are less likely to get on death row than if you are a minority and broke for the very same kind of crime.

      I don’t mind it for this case as he was basically caught in the act so there’s no worry about it being the wrong person. I don’t have a problem with a Dylan Roofe being executed because it’s definitely him and his crime is just that heinous. But in general, I can’t get on board with the death penalty as currently enforced because it’s insanely problematic.

      The death penalty doesn’t bring back the dead, rehabilitate the guilty, or save money for society. It’s merely an act of blood vengeance that says much about us. I’d rather a hard line between us and them.

      Having done my share of criminal.justice study, this is one instance where I differ. Death penalty is too easy, too kind. Life without parole is far more appropriate. Seventy years locked up, no chance of getting out. “You’ll never see daylight again” incarceration. Plus, as Sporkfighter notes, it’s cheaper – not least because a death penalty verdict is also an immediate appeal, so the whole thing has to be done at least twice.

      For all those torn between human decency (no executions) vs. vengefulness, remember that a key component of punishment is the amount of time that it lasts.

      Execution ends all pain and punishment, whereas lifetime imprisonment continues it as long as humanly possible, often a half century or more. So, if you want to inflict revenge but flinch at being an executioner, then a life sentence is the best option.

      I don’t support the death penalty, just because I don’t trust the government. But I do think we should have separate prisons, ones for people we want to rehabilitate, and ones for people like this guy that we just want to warehouse until they die.

According to Wikipedia (may or may not be correct so take it for what it’s worth) one of the circumstances which can make a murder into a CAPITAL murder in Virginia–eligible for the death penalty– is if the murder is committed in the commission of or attempted commission of an act of terrorism.

    2. Also according to Wikipedia, Virginia is the state with the shortest time on average between death sentence and execution (less than 8 years). It has executed 113 offenders since 1976 and has just 4 remaining on death row as of August
    2017.
