    But it does bring to mind a not-so-recent case from our local University. In which a very drunk woman consented to sex with a very drunk man and then regretted it in the morning. She claimed–and the University agreed–that she was unable to give consent and that it was rape.

    My argument was that he was equally drunk, equally unable to give consent and therefore she raped him. Both should have been expelled under that rule. The fellow in question was never charged as I doubt the D.A. saw any case there at all.

    So yes, it can be taken way too far. But those edge cases aren’t usually what we’re discussing, although the fact that they exist absolutely does weaken the argument for more central cases as well. It doesn’t take a lot of stupidity before people just think you’re stupid.
