UPDATE: Mistrial In Menendez Bribery Trial

The Associated Press reports:

The judge and lawyers in Sen. Bob Menendez’s bribery trial are interviewing jurors as the jury says it remained deadlocked. Menendez’s defense lawyer on Thursday asked Judge William Walls to declare a mistrial. An attorney for co-defendant Salomon Melgen asked Walls to poll the jury individually to confirm they are deadlocked.

Federal prosecutors have asked Walls to give the jury more time to deliberate and to give them partial verdict instructions, but Walls says he won’t do that.

Deliberations began Nov. 6. On Monday the jury told the judge they were deadlocked, but he told them to keep going. They deliberated Tuesday, Wednesday and some of Thursday morning without reaching a unanimous verdict against the New Jersey Democrat and the Florida eye doctor.

          That wasn’t a problem, I don’t care what you’re wearing, inappropriate touching is wrong. Even pretending to do so is wrong*.

          It’s the fact that the circumstances aren’t at all what they were suggested to be that makes it not groping. He’s not intending a grope. She’s not perceiving a grope, per the photographer.

          * I have a story about that, actually, but won’t bore you with it.

      I want to believe but that guy didn’t speak to the photographer, he’s basing his tweet on Franken saying it was a staged skit. There’s no link to an actual photographer making that statement. Plus, Aiden might be a Russian plant. They love to sow confusion on all sides.

        Seems that the story might be that she willingly posed for both pictures. Neither make her a wanton slut, per se. One photo might make some people think she is a wanton slut, others might rightly guess that she has been augmented.

            How does the photo discredit the accuser? It’s part of her body of work and has probably been published in calendar form.

            It shouldn’t–and yet it does because of preconceived notions that members of our society have about victims of sexual assault. If she posed in a bikini, she was “asking for it” and shouldn’t be taken seriously. It sucks, but that’s the way it is.

          Because if she posed willingly, that should be enough. Many people don’t take women’s accusations seriously if they think they’re “too slutty.” This is why rape victims are asked what they were wearing when they were raped. It should be irrelevant.

          • as i like to say, no matter what you’re wearing, it’s always “too slutty” to somebody. if you’re unlucky and get a person like that on a jury, you could be screwed (the victim). it’s way common in our society despite decades of science that it is just that, irrelevant.

The focus should be whether her allegation has an ounce of truth or political motivated. The damaged not only to Al Franklin and the Dems if this turn outs to be false but for millions of real victims of sexual assault.

        This is an unfortunate truth. It’s happened before. During the ‘recovered memory’ panic, so many young women accused their fathers that it stopped any of them from being believed. And also, perhaps, stopped us from believing accusations of sexual assault as collateral damage as in: women will say anything.

      Looking at her in the second photo, the first thing I really noticed (seriously) is the very dangerous tool cabinet setup on the left side of the picture. Luckily it seems to be a (bad) Photoshop fix to hide something. Anyone stacking tool chests seven feet high like that is asking for serious trouble.

            Specifically, Tweeden said that she “was back in the US and looking through the CD of photos we were given by the photographer that I saw [the photo]. I couldn’t believe it. He groped me, without my consent, while I was asleep.”

            There were two incidents: a groping incident depicted in the photo, and the kiss incident during the rehearsal.

            That was, sadly, my knee-jerk reaction as well. But then how do we believe Moore’s accusers when the same can be said of them? Coming forward with accusations of assault against anyone takes extraordinary courage.

  • Not surprising, really. It was a weird and convoluted case. Menendez looked dirty and corrupt from the start (and he may well be, because this is NJ politics…), but on the other hand, at least some of the charges included him asking the ethics panels if what he was doing was okay, and they said yes, it was fine.

        The only documentation Moore “signed” was actually via a rubber stamp dismissing the case after the accuser opted to reconcile with her husband.

        “A month later, she filed a motion to dismiss the case. That appears to be the only document Moore signed, and given there was no hearing, there is no reason the divorce action would have required her to enter the courthouse or have contact with Moore.”
