Guilty Verdict For Man Charged With Beating 8 Year-Old Boy To Death Because He Thought Child Was Gay

The Los Angeles Times reports:

A 37-year-old man accused of torturing and beating his girlfriend’s 8-year-old son to death in a case that prompted far-reaching reforms of the county’s child welfare system was convicted Wednesday of first-degree murder. Jurors deliberated for about six hours before returning the verdict against Isauro Aguirre, also finding true a special allegation that the murder was committed with the infliction of torture.

The jury must next determine whether Aguirre should be sentenced to death for the May 2013 death of Gabriel Fernandez, who was found unconscious with a cracked skull, three broken ribs and BB pellets embedded in his lung and groin when paramedics reached him at his Palmdale home. He was declared brain-dead and taken off life support two days later.

Following the verdict, Deputy Dist. Atty. Jonathan Hatami embraced Gabriel’s father. In a press conference, the prosecutor grew emotional recounting the moment. Hatami said Aguirre couldn’t blame either drugs or mental health problems for his actions, and he added that Aguirre hated Gabriel because he suspected the boy was gay.

The sentencing phase of the trial begins in two weeks. The mother will be tried for murder separately.

        No more grounds for a mistrial there, than when they tried to get a favorably gay marriage verdict overturned because the judge was gay. There’d have to be something like the prosecutor withholding exculpatory evidence, or malicious prosecution and that it would have had to have made a difference in the outcome, if I’m not mistaken.

            My parents weren’t abusive, but after trying for years to communicate with them about my being gay, only to be in general rebuffed, I finally gave up. It was their loss, not mine. I have had plenty of substitute parents that have loved me and respected me for exactly who I am, not whom they wished me to be. I’m 67, and my current “mom” is 96.

      Sadly, the “child welfare system” of most areas are broken. Too few people working in the system, too many claims, quick burn out of the agents that are there, less and less budget to work with, and no real oversight of the system.

      The CPS where I grew up was full of bitter/angry people who didn’t want to make waves in the community by properly reporting abuses. I know of one case where four different CPS workers were sent to a house where sexual abuse had been reported by neighbors. Come to find out the foster family had been running a child prostitution ring out of their home and each and every CPS worker had been advised of this, interviewed neighbors and kids, and still passed the family as fit to continue their foster care.

        What a horrible, sad story. 🙁 I come at this from a different place, some good friends of ours are adopting (through the foster care system), they have been put through more stuff (which is good), but a lot of it is kind of ridiculous. Of course I’m seeing only through their eyes. But yeah, it is a pretty broken system.

          Not all systems are broken. It’s good to know some are still doing their jobs. I know it can feel like they are jumping through flaming hoops, but they can take comfort in the fact that at least this system doesn’t just give kids to anyone. I hope they finalize their adoption soon.

            Thanks, yeah I suppose in the back of my head I know that…and I try to encourage our friends to persevere (they are fabulous parents to an adopted “spectrumy” 8 year old. He is a handful, but they want more. More power to them.

    More information:

    Apparently, there had been 60 complaints filed with child services, and eight investigations, but nothing was ever done to help Gabriel. Some of the social workers are now facing felony child abuse charges.

    The mother, Pearl Fernandez, sounds just as bad as her boyfriend who killed the child: apparently, with another child she had, she would not breastfeed or give the baby formula. She would just try to feed her Coke and junk food and the poor girl would vomit up and always be sick.

    Looks like the mother is going to be tried for murder as well, although separately.

    Oh, also, the prosecutor in this case was a victim of child abuse as well. Unlike the bastards who perpetuate the cycle on their children, he was able to use his horrible experiences to become a better person and prosecute scum like Isauro Aguirre.

    From the prosecutor:
    “His teeth were knocked out. His penis was bruised, burned, and cut…”

      Poor Gabriel. It’s heartbreaking to see the pictures of him smiling and to think that despite what he must have suffered, he was still able to maintain a shred of positivity.

      They truly sound like delightful people and I desperately hope they get what they have coming to them.

      However, he’s more likely to be killed as a child abuser rather than being locked in his cell and fed kitty litter.

      This is one instance where I can honestly, and without any ethical problems, say, “Gee, that’s too bad. Well, back to the news.” He’s given up any claim on humanity he had and demoted himself to “dangerous animal.”

      I’ll wait for the guilty verdict in her case before I do the same to her. The social workers…I had a tad more sympathy, but not very much. One call? Sure, that can be an accident. Sixty? Bitch. Please.

    Like most government services Child Protection is vastly underfunded by republicans wanting to keep their wealth. The same reason the California shooter was able to acquire guns, the people working in the agencies tasked with keeping guns out of the hands of criminals are spread too thin thanks to a concerted effort by republicans in thrall to the gun lobby.

      Agreed. The problem with these trials is that they don’t go high enough. Let the people who cut the funding bear some responsibility for Gabriel’s death since this was a logical conclusion of cutting funding under the acceptable limit.

      And let there be jail time.

        Speaking of going high enough, my understanding is the California shooter got guns given to him. If true or if he took them because they weren’t in a gun safe the owner should suffer the same as if he pulled the trigger himself.

          If I, with sixty people, cheer on a beating that ends in a death, I’m culpable.

          It’s a lesser charge, in all likelihood, but the guilt goes far and wide.

    Looking at that little boy’s beautiful face and thinking about the horrors that Aguirre did to him would bring a stone to tears. I hope the jury imposes the death penalty which will cause him to languish in a death row section of some prison for years.

    I think the death penalty is appropriate in this case The same for the father who shot his 14 year old son for being gay in Henderson, Nevada about 10 days ago By the way, the murder of the 14 year-old was reported in the as Vegas news outlets, but none of the mentioned that the father’s motive for killing his son was that “I would rather have a dead son than a gay son” which is what he told police as they arrested him. It was reported everywhere else in the country/world. But not in Vegas. Makes me wonder what’s up in Sin City

        Well…no. I get your point, and yeah, it’s better if the jury aren’t seen to have just said “Guilty as all hell, now let’s go get lunch”, but to deliberate carefully reduces—does not eliminate—the chance of the verdict being overturned for one specific reason. And there are still many reasons a verdict can be overturned, having nothing to do with how long the jury deliberated.

    I cannot get that child’s face out of my mind. He’s such a beautiful kid, and he still looks eager and hopeful. What an immoral, horrible thing to do. So what if the kid were gay? And why kill because he “may” be gay. I would like the boyfriend to die the same way he tortured Gabriel, except maybe being strung up by his balls somewhere along the line. Or maybe using drugs with a “use by” date…and it’s at least two months beyond that. There is, I think, no physical punishment that the perp be given that I would in any way object to.
