Court Rejects Right Wing Lawsuit Seeking To Force State Department To Keep Digging For Hillary’s Emails

The Washington Examiner reports:

A federal judge in U.S. District Court for the District of Columbia dismissed a case Thursday which would have compelled the State Department and the U.S. archivist to continue searching for emails from Hillary Clinton’s tenure as secretary of state in which she used a private email server and address.

The case, brought by Cause of Action and Judicial Watch, didn’t stem from a Freedom of Information Act request, as is usually the case with those watchdog groups. Instead, the two groups were pressing the court to rely on a line from the Federal Records Act, which commands the archivist team up with the U.S. Attorney General’s office to recover documents which may have been “unlawfully removed from that agency[.]”

More from The Hill:

In a 26-page ruling, U.S. District Judge James Boasberg argued that the FBI had already “pursued every imaginable avenue to recover the missing emails” from Clinton’s tenure as secretary of State, and that there was no evidence to suggest that additional search efforts would uncover more information.

“The Court of Appeals may have asked the Government to ‘shake the tree harder’ for more emails, but it never suggested that the FBI must shake every tree in every forest, without knowing whether they are fruit trees,” Boasberg wrote.

Judicial Watch was founded in 1994 by nutjob Larry Klayman, who recently petitioned Trump to hire him as a special prosecutor to go after Hillary Clinton. Klayman left Judicial Watch to run for the US Senate and, of course, has sued them several times since.

Why aren’t they also “embracing and celebrating”?

As y’all may have heard, there was discussion of rebooting “Xena”. The effort eventually fell apart—w/ XWP fans MAINLY believing that there should be no reboot w/o the one&only original stars (I was mainly in that camp).

Lately, I’ve been thinking that there is *one* actress who MIGHT be able to pull it off: looks, talent, and mainly attitude.

For your consideration as Xena: Evan Rachel Wood

Hey T…OT…do you have all of your dahlias in? How do you store the tubers? Mine are in the basement in peat moss. I lost a bunch a number of years ago…I didn’t keep them damp. Hmmm.

        • Treant

They’re in, split, and stored. Peat moss is great, just sprinkle a tad of water on them every now and a rare again.

I wrap mine in Saran wrap (actually, the cheaper store brand as it’s easier to handle and less self-sticky). Post three to five days drying indoors, that retains enough water to keep them alive. Mostly. I’ll lose about half the smallest ones, but that’s true no matter how I store!

          https://uploads.disquscdn.com/images/3dec97aea4b57841471e7c3321e7550decf985ae90b988e4deb1a0214d9a7952.jpg

          • Joe in PA

Thanks, so you separate each tuber? I left the clump intact…should I break them apart? Also, with peonies (herbaceous) you have to have an eye (sprout)…not so with these? And it looks like you washed them? And thanks for letting me know that I will lose at least some, good to know.

          • Treant

You can leave the clump intact until spring, that’s not a problem. At that point, eyes are much more apparent if you’re not used to splitting them. I made sure each tuber has an eye, and several of those are two or more tubers together.

By this time, your stored tubers might already be developing eyes. You can watch the videos online on how to determine what an eye is, but I usually just cut so that a bit of stem goes with the tuber. 90% of the time, even cutting blind, I get an eye anyway. At least one.

Washing them is recommended, to remove soil and to wash away bacteria, viruses, and small insects that might otherwise feed on the tubers over the winter. But it isn’t strictly necessary and a few of my tubers are…less than pristine. Some people dust them with elemental sulfur (flowers of sulfur, garden sulfur, available at Home Depot, Lowe’s, and most garden shops). I never bother because I start with five and end up with…that. Every year.

          • Joe in PA

            Thank you!

          • Steve Smith

I leave mine in the ground. Mulch them with compost and leaves for the winter and they pop up again every year. So far.

          • Treant

What’s your locale? It seems to get way too cold here for anything that isn’t frost hardy, nine years out of ten, anyway.

          • Steve Smith

I’m on the border between Italy and Switzerland, in the lower part of the Alps, at a height of 420 metres and only a short distance from lake Maggiore. The soil is very light and free-draining, though, which makes the overwintering of dahlias possible although we get snow and temperatures well below freezing!

          • Treant

Gotcha! Pennsylvania, United States. Heavy silt soil that stays soaking wet all winter long–and winter runs from November to April. Dahlia and cannas rot in weeks. 🙂

          • Steve Smith

But I bet you have wonderful shows of flowers all summer! Here its a constant battle to keep any moisture in the ground in hot weather, not helped by being on a very steep mountainside. But the views are spectacular.

          • Treant

Nope, you really can’t grow flowers around here at all, no matter what we try…
            🙂

            https://uploads.disquscdn.com/images/bef48902cf0e82882f0cf207bce2f4dccd6fdfa0a61fa7ea245aa3fce561e101.jpg

          • Steve Smith

!!!! Amazing. I grow a lot of perennial plants, including flowers. But mainly a huge supply of vegetables, enough for us for the year without having to buy. And we’re vegetarian too.

        • RoFaWh

How to moisten dry peatmoss effortlessly:

          1. Buy large bale around Labor Day.

          2. Cut it open.

          3. Put it where the rain can reach it.

          4. Use starting in the spring. It will be beautifully and evenly moist.

          This requires some planning ahead.

          • Joe in PA

          • Treant

I wish that were true, but I kind of agree with Becca here. The Republican Party isn’t acting like elections matter any longer because, at this point, they’re not going to with our current trajectory. Either we won’t have elections, or they’ll be so hacked that the person who wins will be the person the Republican party wants to win.

I include extensive gerrymandering in with hacking an election; you’ve made the voting public not matter in the slightest.

          • GayOldLady

My 2018 nightmare: overwhelming evidence of Trump Russia collusion/corruption, but he remains in office bc GOP won’t act; this leads to overwhelming wave election in midterms, but gerrymandering/geographic concentration means Rs retain control of Congress. US democracy dies.

    • Treant

Frankly, I’m already counting it as dead, but within the time period for resuscitation.

A return to fully healthy is going to require some pre-requisites for holding office, however. Or at least for people to analyze the person rather than just the party identification.

I don’t expect a return to health for our democracy within any reasonable time period, would be the takeaway here.

      • That’s my feeling, too. And the Republican party knows it, otherwise they wouldn’t be acting as if their ONLY priority is finding ways to throw piles of money at America’s oligarchs.

They’re not behaving as if elections even matter anymore.

      • RoFaWh

It’s not too early to discuss what those prerequisites should be and how, where, and when candidates should be checked for compliance.

Yep, and the only way I can think of around that is to pack the courts. It’s not really a roller coaster we want to get on, however…

    • JCF

That’s the time we take to the streets (OK, Billbear?) with NOTHING left to lose.

    • Steverino

This is what Carl Rove very genteelly referred to as the “permanent Republican majority.” You know, a one-party government.

      Sound familiar?

  • boatboy_srq

Conservatist jurisprudence: if the investigators haven’t turned up incriminatimg evidence, they just haven’t dug deep enough.

  • justme

and the fees for this search, so far, along with court cost should be paid by them..

  • ETownCanuck

While they’re at it, they should go search each wardrobe and closet until they find Narnia….

  • Jean-Marc in Canada

Yet these same paragons of idiocy would squawk and screech at the mere mention of looking into the current emails of those in the Trump administration who, surprise surprise, use private fucking email!

    • Gianni

The big difference is that Hillary made the unwise decision to use her own, private, computer server housed at her home. That’s where all the hubbub comes from. Former Secretary Of State, Colin Powell, used a private email account but that is what we all use to send/receive email, like Hotmail, G-Mail, AOL, etc. Hillary took it a step further and used her own server. The Republicants will forever use that accusation when they try to link any Dem to Hillary or anything Clinton.

  • TuuxKabin

Cheese and crackers got all muddy. Has anyone morphed the “LEAVE BRITTANY ALONE!” gif in to ‘LEAVE HILLARY ALONE’ gif? About time.

  • coram nobis

I would think that between Flynn plotting to kidnap someone for pay, and Roy Moore’s revelations about young girls, that Hillary’s e-mails would seem quaint, if not as dated a controversy as the Lusitania cargo manifest.

    • Lars Littlefield

Which, 100 years later, divers discovered the Lusitania was officially carrying among her cargo 750 tons of rifle/machine-gun ammunition, 1250 cases of shrapnel artillery shells with the explosive burster charges loaded but no fuses or propellant charges, and the artillery fuses for those shells stored separately. The cargo also included 46 tons of aluminum powder, which was used in the manufacture of explosives and which was being shipped to the Woolwich Arsenal in the UK, The cargo also included 50 barrels and 94 cases of aluminum powder, as well as 50 cases of bronze powder and a
large quantity of nitrocellulose (gun cotton), none of which was listed on the cargo manifest.

So much for conspiracy theories. 😀

      • coram nobis

There was still the mystery of the furs, sent by the munitions firm DuPont, as well as the lard, butter and cheese — not in refrigerated compartments — consigned to the Royal Navy weapons center at Shoeburyness.

There’s also the question of why one torpedo would cause two distinct explosions, and why the presiding judge at the inquest, Lord Mersey, would step down from the bench afterward. All very mysterious.

      • Girlgoon

So did the Germans sink it because they knew about the dubious cargo ?

        • Lars Littlefield

          Rumor has it. Yes.

  • Friday’s_cat

Why is it the media has to dig through their files and find the most unflattering photos to run above Hillary articles. This one is the least offensive I’v seen in all the Thrown Out Frivolous Suit stores that were reported today.

  • DesertSun59

There’s nothing quite like the intense and never ending delusion the Right has about Hillary.

    • joe ho

the delusions the far left has about her are about as intense.

      • Grumpy Old Man

Nah, I call bullshit on ‘both-sidesism’.

  • Gianni

Oh, the dismay must be heart-wrenching for them. When’s the first appeal?

  • JackNasty

There are lots of legitimate reasons to criticize both of the Clintons, but this e-mail nonsense isn’t among them.

Larry Klayman and the rest of the GOP need to give it a rest.

  • I love dim sum

I’m so glad that old cow lost.

  • SilasMarner

Hey, Cause of Action and Judicial Watch, how you like THEM apples. LOL!
