Court Blocks Trump’s Trans Military Ban, Says Directive “Based Only On Desire To Disapprove Of Trans People”

The Associated Press reports that a federal court has blocked Trump’s attempt to ban transgender military service. Story developing….

UPDATE:

On July 26 Trump issued a statement via Twitter announcing that “the United States Government will not accept or allow transgender individuals to serve in any capacity in the U.S. Military.”

A formal presidential memorandum required the military to remove transgender service members by authorizing their discharge no later than March 23.

The judge said that the president’s directives are “not genuinely based on legitimate concerns regarding military effectiveness or budget constraints, but are instead driven by a desire to express disapproval of transgender people generally.”

So fucking awesome. Trump must be losing his fucking mind right now. Maybe he’ll have a heart attack.

Hopefully not a fatal one – I want to see him do the perp walk first.

      • Christopher

At this point, I’m good with either.

      • RoFaWh

I’d be satisfied with a stroke that deprives him of (a) the power of speech and (b) the ability to walk.

Incidentally, I wonder if Trump’s issue with stairs is because his knees are shot and don’t do stairs all that well plus Trump himself being a coward who won’t get knee replacements.

PS: I’m a coward in that respect, myself. Got the right one done a couple of years ago, and it triggered back pain more intense than I had ever thought pain could be, though the surgery itself was uneventful and not all that painful.

Fear of a repeat bout with severe back pain has led me to cancel my position on the waiting list. That and the mere fact that six weeks without driving is a major headache.

        • thatotherjean

I’m at that point, too. It took me so long to recover from the first one, thanks to Ehlers-Danlos Syndrome (which slows down healing time), that I’m not about to have another knee replacement until the pain keeps me from walking at all. I wonder if Trump has some form of hypermobility? He does that weird thing with his thumbs, where the top joint points almost backward when he’s giving a thumbs-up. If he has what I have, his ligaments are unusually stretchy, and early-onset arthritis is not uncommon. Avoiding stairs and being uncomfortable on slopes would make sense.

A few starting points for me are Daily Kos ( https://www.dailykos.com/ ) and What The Fuck Just Happened Today ( https://whatthefuckjusthappenedtoday.com/ ), as well as JMG of course.

One letter or one call by itself won’t change anything, just as one vote by itself doesn’t change things; what matters is the collective impact, taking up enough of their staff’s time so they can’t ignore important issues, so the politicians start believing their reelection is at stake.

    • The_Wretched

Important to see the bottom get a new low point though even with noise in the data.

538’s tracking average is still a stubborn 37% but it’s trending to a minimum as well. It tends to lag the single polls.

      • Well, that’s the definition of a tracking average. It’s meant to compensate for the noise.

        • The_Wretched

And that’s why I check it whenever we get news on single polls.

      • WitlessProtection

Wasn’t that the site that gave Hilary a 93% chance of winning the election? They have lost all credibility with me.

        • swimboy

They had her at about at 68% chance by November. That means that two times out of three, she’d have won. We just got that third time of three (excluding the possibility of election tampering, of course.)

People who don’t understand statistics think that fivethirtyeight did a horrible job predicting the election. What really happened is that the reality leading up to the election wasn’t a good predictor of the outcome. *Everybody* had a tough time with that one.

To truly gauge fivethirtyeight’s skill, look at their record over *hundreds* of elections. They’re right more often than most of the other guys. To complain that they suck because they misled you about the outcome of one election is disingenuous at best, and blatantly ignorant of statistics at worst.

          • Chucktech

Yup. The one election. The big one. The rilly, RILLY big one.

          • swimboy

I still think that most people believe that since HRC was well above 50% on the prediction that she was *certain* to win. Statistics doesn’t work like that. Most people were interpreting any number significantly bigger than 50% as a sure thing, confusing percentage chance of winning with percentage of vote won. They’re two completely different things, and I think that most people still don’t understand the difference.

          • Chucktech

In my opinion, the one variable that none of the polling took into consideration was the influential meddling of the Russians.

        • The_Wretched

They were closer than anyone else. As the election date got closer, they moved lower and lower on a clinton win.

        • lymis

I’d like to know how fivethirtyeight was supposed to predict Comey torpedoing her by announcing that the email investigation was reopened.

        • (((GC)))

The election itself lost all credibility with me.

Possibly over a million voters of color purged from election rolls. Thin “victory” margins in crucial swing states dwarfed by the numbers of pesky likely-Democratic voters targeted by Kris Kobach’s intentionally sloppy Crosscheck matching scheme. Laws rolling back early voting and instituting strict ID requirements that targeted Blacks with “almost surgical precision”.

Not to mention Russian disinformation, and Robert Mercer’s targeted psychological warfare (articles and ads shown to specific, narrow audiences) based on detailed profiles derived from hundreds of Facebook likes.

Not to mention hackable, inherently unreliable electronic voting machines with no paper trail. The State Department uses concurrence with exit polls as an indication of trustworthy, free and fair elections in other countries; we would have failed that.

(edit) I’ll say again: the standard should be paper ballots. They can be quickly scanned by machine, and they provide a tangible record of every voter’s intent. They can be spot-checked in random precincts to gauge the reliability of the electronic count, and they can be recounted by hand if necessary.

          • The_Wretched

            ^this

      • Chucktech

538 also assured us of Madame President Clinton, too.

        • TominDC

FWIW they were the most bearish of the well-known trackers – they gave Mrs Clinton a ~70% chance of winning, and the shitgibbon ~30%.

          Three-in-ten events aren’t exactly rare.

          • sfbob

Yup: When the weather forecast includes a 30% chance of rain, how often has it rained? The answer isn’t “none, because the chance of rain was only 30%.” In fact it has 30% of the time and if one of those “30% days” happens to coincide with the day of your picnic then you’re gonna get wet.

        • The_Wretched

So did every other outlet. It’s one of the long list of data points that show the election process is broken.

    • RoFaWh

Be careful: because the author of that graph failed to include the zero point on the Y-axis, the percentage that disapproves appears to be smaller than it really is. Given that this graph tracks percentages, the hundred-percent point should be included as well.

    • barryearle

Roughly 1/3rd of votes are Republican, 1/3rd are Democrats and 1/3rd are so-called Independents. I think what these numbers indicate is that the Independents who voted for Trump are defecting. The hard-core “Give Him A Chance” Republicans are sticking with their guy. It’s important to know that it’s the Independents who swing the vote one way or the other. So if I’m correct, this is a very good sign for 2018. But, then, leave it to the Democrats to screw up a good thing.

      • (((GC)))

The situation is complicated. This article looks into the various political typologies within “red” and “blue”:

Are you a ‘solid liberal,’ or something else? This new study helps explain every political type (Daily Kos)
        https://m.dailykos.com/stories/1710013

        https://uploads.disquscdn.com/images/9307cf4de0ab9cc9e8986a5fdef1e74804622354a09dbba1de608285f52a14cc.png

(This also helps make the case for gerrymandering (and voter suppression) distorting our legislatures. With 50% of people “Dem / lean Dem” vs. 40% “Rep / lean Rep”, you wouldn’t expect fair elections to produce the Republican majorities we see in Congress. In a fair representative democracy, the voters choose their representatives. With gerrymandering, the representatives choose their voters.)

    Translation into plain English : [ edit : or read between the lines.}
“The President’s directives are based on his own personal bigotry not on any genuine or legitimate concerns regarding military effectiveness..”

    • Trumpy, in an effort to distract and to gin up support from his bigoted base forgot about the need to paper it over with a rigged study. Just like the way DoD spent decades claiming they couldn’t let gay people serve, just by running out a fake study every few years.

      • Lars Littlefield

My favorite fake study was how they had proof that homosexuality was more nurture than nature because so many gay men kept miniature poodles as pets.

      • The_Wretched

Saved again from a horrible change by Team Trump’s on-going incompetence at following regular order.

      • Chucktech

Ha ha, you used “Trump” and “Study” in the same sentence.

      • -M-

He’s not smart enough to do that. Pence wanted this worked the fool over, BSed some rationalizations about costs and morale, told him the base would love it.

    • Talisman

“The President’s directives are based on his own personal vanity and desire to elicit accolades from his base…”

Never too late for “The October Surprise(s)”. 😁

For some reason all the unfolding shenannigans reminds me of a joke about a young Japanese national put in charge of the supplies at a gold mine. No one sees or hears from him for months and month. Management fears he got lost in the mine. They set out a search party to find him. Deep in the mine they come around a dark corner and the Japanese national jumps out snd yells, “_____________!”

I’d celebrate this more if not for the fact that as we speak, Trump and Republicans are making sure to fill judicial vacancies with far right hacks who will rule the opposite of this.
I know some people are sick of me saying it but it has to be said.
The courts are basically the only protection many people have against bigots and why Democrats didn’t highlight that more and fight for them boggles my mind.

    • NowAnAgnostic

You are right to remind everyone frequently. Just think of the judiciary we would have now if Gore 2000 had been elected president and Hillary had been elected in 2016. I worry about the judiciary appointments in every election.

I’m old and can remember some of the anti-gay decisions made by local, state, and federal judges.

    • billbear1961

People should be in the streets protesting this, insisting moderates only be appointed. He has no mandate, having lost the popular vote by nearly three MILLION votes, to do ANYTHING extreme.

And I’d like someone to explain to me why citizens of a GENUINE democracy should accept rulings from KNOWN far-right FANATICS–fascists–who intend to IGNORE the Equal Protection Clause–pretend it doesn’t apply–and to strip MILLIONS of their civil rights!!

That’s BULLSHIT!! “You will BEG the majority for your rights, lowly minority! We strip you of rights that HAD been recognized, our ‘reasons’ based on nothing but LIES and HATRED! It is so ordered!” FUCK THAT!! In this day and age, you bow down to that ONLY if you are SERFS, do you hear me?!

They should be REMOVED from the courts, or the circuit courts and SCOTUS should me EXPANDED to seat MORE judges as soon as we possess the power to effect those changes!! It is NOT unconstitutional to do so!!

This Republic will NOT become a fascist state, where the Tyranny of the Majority–and the far right’s views do not even represent the majority’s views!–deprives minorities of the RIGHTS of CITIZENS!!

    • billbear1961

  • The Trump campaign SENT Papadopoulos to Russia to set up agreements in AUGUST 2016.
    https://twitter.com/kaitlancollins/status/925058328773963776

    • I’m dyin’ to know who the supervisor and the other ‘foreign policy advisor’ were.

      • After checking some things: The week of August 15th is when Manafort was booted out as Campaign Manager, in circumstances which were murky as hell to begin with and not fully reported until Friday 19 Aug.

        https://www.politico.com/story/2016/08/paul-manafort-resigns-from-trump-campaign-227197

Just totally spitballing here, but I’m wondering if someone inside the Trump campaign who wasn’t Manafort looked at these contacts and realized they were being way the fuck too obvious on the collusion angle — and sparked a general panic that resulted in him being ret-conned right out of the campaign itself.

Mueller is playing Chess. Trump is playing tic-tac-toe

  • Leo
    • Halou

Of course they do. They are told a pardon is being set up for them. Why else would Trump invite Pence and Sessions to dinner at such short notice if not to plan an escape route for other co-conspirators?

      • JohnJay

Wouldn’t they have to plead guilty (or be found guilty) in order to accept a pardon?

      • LeeCMH

Also, tRump has already been warned Mueller is watching tRump’s reaction to this.

If he pardons people ostensibly to avoid prosecution, then tRump exposes himself to possible obstruction charges.

If tRump tries to bully or communicate with those indicted, that can also be seen as possible obstruction.

        • billbear1961

You, as a people, can’t just let him use his pardon powers corruptly to pardon all his henchmen and himself, thus TOTALLY undermining the rule of law by placing himself and his cronies perpetually ABOVE the law!! What a vile FARCE that would be, turning this country into a DICTATORSHIP!!

The next step would be orders from him to his people to commit any crime he likes!

“Don’t worry–if you get caught, I’ll pardon you!”

          • John30013

I would like to see 45*’s abuse of the presidential pardon reined in by a new constitutional amendment. The amendment should make clear that accepting a pardon is an admission of guilt, and that it cannot be used until at least 4 years after a person had been convicted. That would go a long way toward eliminating political pardons.

          • Hank

To accept a pardon, one has to admit to the crime. It then, also allows the pardoned to forgo, their 5th Amendment and be allowed to answer freely in court. Then they become open witnesses for EVERYTHING!!! 😉

    • safari
