KENTUCKY: State Loses Appeal, Ordered To Pay $222K In Legal Fees To The Gay Couples Who Sued Kim Davis

Courthouse News Service reports:

A federal judge ruled Monday that Kentucky taxpayers are still on the hook for attorney fees for the couples who sued Kim Davis, a county clerk who refused to issue marriage licenses to same-sex couples after the historic U.S. Supreme Court decision legalizing gay marriage.

In July, U.S. District Judge David Bunning ordered Kentucky to pay $222,695 to the attorneys of April Miller and others, after they won a favorable judgment against Davis. Bunning also awarded an additional $2,008 in other costs. Gov. Matt Bevin and Terry Manuel, commissioner of the Kentucky Department for the Libraries and Archives, appealed the ruling, claiming the fees should be assessed against Davis and the Rowan County Clerk’s Office.

The governor and commissioner, who were third-party defendants in the case, argued that Davis did not represent Kentucky when she acted against the U.S. Supreme Court’s 2015 ruling in Obergefell v. Hodges because her behavior was not directed or approved by any state official. Bunning once again found the argument unpersuasive, and rejected the appeal on Monday.

Earlier this month Davis traveled with the Liberty Counsel to Romania in support of the far-right campaign to place a ban on same-sex marriage into the federal constitution.

        Elected or not each position has an obligation. If the court found she violated the term of her employment, the Governor has the obligation to remove her regardless of how it will pan out for his own political career. Aside from the monetary reward, can the plaintiffs now sue the Governor for not removing her for not fulfilling her obligation as a county clerk?

          Sadly, it doesn’t work like that. If I remember correctly, she would have to be impeached by the legislature and I am not aware of a law that can compel the legislature to act against her, but I could be wrong.

          Nice try, but no, the plaintiffs cannot sue the Governor, for at least a couple of reasons. (1) Palsgraf and causation issues; (2) Statutory, constitutional, and other immunities of the Governor for ‘official acts’ he performed (or didn’t perform) while in office; and (3) Governor probably owes no ‘duty of care’ to the Plaintiffs regarding his choices for county clerks

    Naturally, one does not work. So I’m moving on with 6 Gb (2Gb x 2 plus 1 Gb x 2) and notified the company, who has actually already shipped a replacement. And told me to simply throw away the non-functional chip.

    It’s DDR2-667 MHz, so that should tell you how old it is. I haven’t upgraded in ten years.

    Starting in 2013 when Kentucky’s then-Democratic governor embraced Obamacare, Cara Stewart, a health law fellow at the Kentucky Equal Justice Center, along with the state’s Primary Care Association and others, enrolled hundreds of people in the program without mentioning Obamacare, the Affordable Care Act or the federal government.

    Uninsured Rate Plummets

    Within two years, the state’s uninsured rate had fallen to 6 percent of the population from 20 percent. More than 420,000 people had been insured through Medicaid expansion, dropping the number of uninsured in some low-income jobs — at restaurants, construction sites, gas stations and discount stores, among others — by between 35 percent and 52 percent, according to data from the Kentucky Center for Economic Policy, which studies impacts on the poor.

    It had been easy for Bevin to run against Obamacare. Once in office, his promise meant killing the subsidized insurance much of the state depended on but didn’t know they had.

      While I agree the state should have acted to disassociate themselves from her actions when they were taking place rather than at the last moment when they’re merely concerned with not being on the hook for legal fees, the fact is that as an elected official the state did not have the power to dismiss her. I suppose impeachment might have been a possibility but that would have required action from a legislature that almost certainly approved of her behavior.

    I agree with the state on this one. Davis acted on her own accord against direct “orders” from the courts and the state. She should be on the hook for the money not the taxpayers. Sheis getting away with everything and no kind of punishment. The couples that were denied need to sue her personally and take her for all they can. They also need to sue the county for not firing her when she refused to follow a court order.

Round here on the South Coast old Old England, the young people are unfazed by whether you are gay, straight, bisexual, queer, transgender or anything at all really at age 16 or over with anyone aged 16 or over. The Conservative Party MP here had his electoral majority of 14,300 slashed down to 5,000 by the large and handsome lady Labour candidate, knowing her Labour Manifesto so well, and she was once a Premiere League Boy Footballer. When she anonounced that she had decided to change her gender, her Football Team accepted this without batting an eyelid. This is what young people are like today.
