DOJ To Aid Prosecution In Murder Of Iowa Trans Teen

The New York Times reports:

The Justice Department has dispatched an experienced federal hate crimes lawyer to Iowa to help prosecute a man charged with murdering a transgender high school student last year, a highly unusual move that officials said was personally initiated by Attorney General Jeff Sessions.

In taking the step, Mr. Sessions, a staunch conservative, is sending a signal that he has made a priority of fighting violence against transgender people individually, even as he has rolled back legal protections for them collectively.

The Justice Department rarely assigns its lawyers to serve as local prosecutors, and only in cases in which they can provide expertise in areas that the federal government views as significant. By doing so in this instance, Mr. Sessions put the weight of the government behind a small-city murder case with overtones of gender identity and sexuality.

Kedarie Johnson, a 16-year-old student in Burlington, Iowa, was shot to death in March 2016. Family and friends told local newspapers that he was gay, identified as both male and female and occasionally went by the name Kandicee. Christopher Perras, a Justice Department lawyer, will serve as a county prosecutor in the case, according to court documents filed on Friday.

Curtis Dial, a Keokuk attorney appointed to represent Jorge “Lumni” Sanders-Galvez, 23, filed a motion Monday in Des Moines County District Court seeking “all of the federal grand jury testimony … and scientific results from the Federal Bureau of Investigation” into the March 2016 killing of Kedarie Johnson, 16, of Burlington.

Sanders-Galvez is scheduled to go to trial on first-degree murder charges in state court Oct. 24. Dial said he needs the grand jury testimony to assist him in preparing his case in state court.

Dial’s motion is the first public court document, at either the state or federal level, to acknowledge a grand jury has been convened in U.S. District Court in Davenport. The grand jury is looking into the possibility of indicting Sanders-Galvez and a second-man, Jaron “Wikked West” Purham, 25, also of St. Louis, on federal hate crime charges in Johnson’s death.

Sanders-Galvez’ trial was moved from Des Moines County to Henry County. Brown moved Sanders-Galvez’ trial to Henry County after Dial argued he couldn’t get a fair trial in Des Moines County because of pretrial publicity.

Shortly after Johnson’s murder, local investigators said evidence they obtained during the investigation did not meet the law in Iowa that would have allowed state prosecutors to file hate crime charges against the men in Iowa. However, a federal hate crime has different elements.

          This is actually progress, unfortunately. In the past, nobody would have cared. In some cases, that’s still true.

          At least by bringing up hate crimes, progressives have motivated even a very conservative and reactionary Administration to do its J-o-b and fully prosecute someone for breaking the generally applicable law.

            No, Señor Tibbs and his siblings from the same litter are fine. The two cats that were killed were from a younger litter (the last before Mama got fixed), only 2 1/2 months old or so. Babies. I stay out of the neighborhood drama, but today I got an earful from the neighbor who texted me about this. She says the cat killer is “EXTREMELY bipolar and unmedicated.” Oh goody. Apparently she was threatening suicide last night, the cops were called, and she was taken to the hospital.

        They’re not in it for the money (shocking) Admission is 15 recommended, but not required. Memberships are even low. It is their claim, that the museum is for historical education of the book, and it’s influence. Not on the specifics of the book itself. I’d go. I’ve been to The Smithsonian and there is plenty of history in there too. One can learn history without reliving it.

    What a difference. It’s almost like Microsoft designed Windows 10 to be a complete memory and processor hog just to sell new machines. But that would be dishonest.

          The thing about photos, particularly news photos, is they are less than 1/100th of a second, frozen in time.

          Half a second later she could have been smiling broadly.

          They are and always have been a completely misleading indicator of what the subjects are thinking or feeling. You need video for that.

She, and the royal family, are expected to be at the State Dinners — although Prince Charles has been known to skip dinners with leaders he does not approve of. There was an episode of The Crown which shows that she was asked to postpone her holiday to make way for a state visit by President Eisenhower which did not happen since he took ill — but people need to realize she is a Constitutional Monarch and figurehead, and her powers as outlined in Bagehot’s seminal 1867 Essay the English Constitution (he was the Editor of The Economist) are to be consulted by the Prime Minister, to encourage, and to warn– all in private — something which she is masterful at.     I’m so sick of this rehashing of the Clinton years when Weinstein and others come up and it has nothing to do with being a liberal.
    I think Bill Clinton is a scummy husband and he rightfully deserves all the scorn he gets for what he did with Monica and other women behind Hillary’s back.
    Also, like it or not, his presence (as unfair as it is) DID hurt Hillary.
    Having said that, someone who sleeps around on his spouse does not a sexual predator make.
    You want to know why I don’t take Jones or Broaderick seriously?
    Because they only attack Democrats and never call out Republicans for their scummy behavior.
    They have called out the women who accused Trump of doing to them what they claimed Bill did (or worse) liars and have said nothing when Trump defended Ailes and O’Reilly after they were ousted.
    They also both just love seeing stories about Chelsea Clinton being harassed.
    Broaderick herself has tweeted nasty things to Chelsea numerous times.
    I’ve seen victims of sexual assault react in different ways (sadly many do turn to drugs to cope with the pain.)
    I’ve never seen any engage in the attacks against others and the partisan tone Broaderick and Jones have.
    That is why I don’t trust, them.
    So no, Jake Tapper, Michael Black etc., I don’t need to do any soul searching when it comes to them.
    Other cases yes but not this.

    If Joe had posted my reports of Jeff sessions intervention into my sexual orientation discrimination case, this would be put in context. The federal prosecutors were already going to prosecute this crime, and so Jeff sessions steps in to show – fooling none of us – that he’s not a bigot. However, He intervened into my appeal in which I sought protections for gay and lesbian people under sex discrimination as written under title VII of the civil rights act. I wrote Joe several times, and he just blew it off

            Um, he walked the lead-off batter, and got lucky on a couple of strike-outs (batter swung at balls out of strike zone). Didn’t really think Duensing was “dealing”.

            Re your reply, “dealing” was Ninja, not me. Duensing got himself out of the trouble he was in in the 8th (inducing an inning-ending double play) and when a dangerous bat came up in the next inning, he walked Puig, probably figuring it would be better to have him on the bases than rounding them. Then a sac bunt, then Duensing strikes out the pinch hitter low and away. He only had to get one more out, he was doing what he had to, and seemed to have much better control than Lackey tonight.

            Haven’t seen Lackey pitch recently, but he certainly does have experience (been around to torture my Giants from when he was a rookie in the 2002 WS, to being the starting pitcher—though not effectively—when the Giants imploded in their season-ending bullpen collapse in the 2016 NLDS. Ended more than a season: ended an era. 🙁 )

        Eh, my husband is rather negative on the series. I’m neutral. It’s a darker, thematic break with the utopian civilization presented in the other series, the Klingons are different, damn it, and the commander is a bit morally ambiguous.

      I lost a dear friend at the end of 2015. He’d been very active in politics, was a huge supporter of Obama, and lived to see major changes for the better. I’m glad he’s not here to see where we are now.

      My father was in the state legislature and voted for legal recognition of gay marriage prior to Obergfell. He passed last year. I’m glad he’s not here either.
