BREAKING: Sessions Issues Long-Feared And Sweeping “License To Discriminate” Against LGBT Americans

The Associated Press reports:

In an order that undercuts federal protections for LGBT people, Attorney General Jeff Sessions issued a sweeping directive to agencies Friday to do as much as possible to accommodate those who claim their religious freedoms are being violated.

The guidance, an attempt to deliver on President Donald Trump’s pledge to his evangelical supporters that he would protect religious liberties, effectively lifts a burden from religious objectors to prove that their beliefs about marriage or other topics are sincerely held.

Under the new policy, a claim of a violation of religious freedom would be enough to override many anti-discrimination protections for LGBT people, women and others. The guidelines are so sweeping that experts on religious liberty are calling them a legal powder-keg that could prompt wide-ranging lawsuits against the government.

“This is putting the world on notice: You better take these claims seriously,” said Robin Fretwell Wilson, a law professor at the University of Illinois at Urbana-Champaign. “This is a signal to the rest of these agencies to rethink the protections they have put in place on sexual orientation and gender identity.”

“Today the Trump-Pence administration launched an all-out assault on LGBTQ people, women, and other minority communities by unleashing a sweeping license to discriminate,” said HRC President Chad Griffin. “This blatant attempt to further Donald Trump’s cynical and hateful agenda will enable systematic, government-wide discrimination that will have a devastating impact on LGBTQ people and their families. Donald Trump and Mike Pence have proven they will stop at nothing to target the LGBTQ community and drag our nation backwards. We will fight them every step of the way.”

“It’s unconscionable that the Trump-Pence administration also today encouraged employers to exert control over the essential health care decisions of their employees,” continued Griffin. “The rule change on contraception will undoubtedly limit access to vitally important care that women and so many in the LGBTQ community rely on every day. We each deserve to have the freedom to live and plan our lives with dignity, and this administration’s reckless efforts to undermine the health care of millions of Americans must be stopped.”

This guidance follows the anti-LGBTQ executive order signed by President Trump – which could ultimately allow a person to use so-called “religious exemptions” to discriminate against the LGBTQ community at the workplace, in housing, in public accommodations across the nation, and even in marriage equality. Today’s guidance bears a striking resemblance to some of Indiana’s “Religious Freedom Restoration Act” (RFRA), an anti-LGBTQ measure Mike Pence signed into law when he was Indiana’s governor in 2015.

“Today’s guidance by Jeff Sessions proves this Administration will do anything possible to categorize LGBTQ Americans as second-class citizens who are not equal under the law,” said Sarah Kate Ellis, President and CEO of GLAAD. “Freedom of religion is paramount to our nation’s success, but does not give people the right to impose their beliefs on others, to harm others, or to discriminate. Nothing could be more un-American and unholy than using religion to justify harm and discrimination to others.”

          This is guidance on interpreting and implementing the federal Religious Freedom Restoration Act provisions.
          It doesn’t and cannot set aside state laws.
          Official “Guidance” is never the law, it is merely the AG’s interpretation of what he thinks the federal RFRA allows. Other lawyers and the federal courts may have other, better legal interpretations.

If government cannot discriminate against a person or a religion, how could Trump block Muslims or any other religion from entering the country. And if a religious person starts a lawsuit against the company he/she works for because having to work side by side of a homo is against his/her belief, what about the company who’s deeply held religious belief says they believe that they are commanded by god to treat all persons equally? The both believe deeply but their beliefs are contradictory. And that’s the reason why none of this BS should be accepted – because it’s the rights of believers having first priority over non-believers.             Our old pup, Sonic was a decent size (60 lbs, I think).

            Our fat orange blob, Max, that DNA tests claim is a feline LOVED him. He didn’t quite feel the same way and Max would chase him around the house trying so hard to cuddle with him.

            When we moved to Hawaii – since we were only going to be there for a year and then move to Chile and bringing animals to Hawaii takes months and months of preparation and lots of money – we left the cats in the care of babysitters and sent the dog to live on a farm up north.

            (Literally. He moved in with my parents, who love him, and we couldn’t separate them once he settled in.)

            Here’s a pic of hubby and Sonic back when they were still both young and adorable (before I wrecked them), packed up and ready to go to the beach, and one of Sonic when he was full grown. He is still alive and kicking and extremely active now at 11 years old, although his nuzzle is grey as a mule.

    About ten years ago, when states started changing their Constitutions to define marriage as between a man and a woman, all my gay friends were livid.

    I was calm. Or rather, I was excited.

    For I knew that these new laws would get challenged, and that marriage equality would happen sooner.

    Had states not done this, we would not likely have marriage equality today.

        Tough to say actually. It seems the phrase is usually taken as a given and then applied with the only question being whether the belief is truly “sincere.” In the Hobby Lobby case Alito claimed that it was easy for the courts to decide whether a belief was sincere or not. However the situations he cited do little to shed light on cases of general discrimination against an identifiable group of people. There are cases in which a claim for religious exemption can be invalidated because it’s easy to find some ulterior motive for the claim itself or for the claimant having established the belief in the first place. Such as for example a church created for the express purpose of using otherwise illegal drugs in its sacraments (as opposed to one that has existed longer than the statutes banning drugs).

        This doesn’t do much good when it comes to deciding whether a religious accommodation applies to to laws that outlaw other forms of discrimination. In that case there are two ostensibly legitimate but opposing claims of rights. I don’t think it’s hard to demonstrate that laws and policies forbidding discrimination on the basis of sexual orientation or gender identity should trump claims of religious persecution. But the opposing approach always contends that the anti-discrimination laws intrinsically discriminate against religiously-based forms of bigotry.

        Realistically speaking, the intentions behind Sessions’ policy are to turn religion into a weapon, using it to force non-believers into adhering to the plaintiffs’ preferred religious views.

    Organization:
