AG Jeff Sessions On DACA: Obama’s Unconstitutional Abuse Of Executive Authority Is Being Rescinded

The New York Times reports:

“The program known as DACA that was effectuated under the Obama administration is being rescinded,” Mr. Sessions told reporters, adding that “The policy was implemented unilaterally, to great controversy and legal concern.”

Mr. Sessions called the Obama-era policy an “open-ended circumvention of immigration laws” and an unconstitutional use of executive authority. “The executive branch through DACA deliberately sought to achieve what the legislative branch specifically refused to authorize on multiple occasions,” he said.

“The nation must set and enforce a limit on how many immigrants we accept each year, and that means all cannot be accepted.” Elaine Duke, the acting Homeland Security secretary, said in a statement that Mr. Trump chose to “wind the program down in an orderly fashion that protects beneficiaries in the near-term while working with Congress to pass legislation.”

      • We have a border – no Trump imprisoned here in Canada

  • AW

These people are monsters. True monsters. I hate these evil vile people with a passion. I hate those who vote for these people. I’m officially done, Republicans are now the Nazi party.

  • Stogiebear

    “protects beneficiaries”

Running that through the Fascist to English translator we get:

Arrest and detain the brown people.

    • Stogiebear

And speaking of arresting and detaining… There are currently about 800,000 DACA folks in the country. They will make a very tidy addition to the private prison system for anyone in the Dump Administration who happens to be invested in it.

      • Sandrachedrick

my classmate’s mom makes $91 per hour at home… she has been out of a job for four months but the previous month her profit was $12005 just working from home five hours a day,➤ go➤ here

  • No More GOP.

If it were unconstitutional, Jeff (I can call you Jeff, right? “Fuckwit” would be more satisfying, true, but probably not appropriate here), it would have already been in the courts. Oh, and by the way? Fuck you.

They have the temerity to talk about Obama’s “abuse” of executive authority? I’m fucking LIVID. There’s nothing I want more than to see these reprehensible, cruel assholes suffer.

    • -M-

Congress can act on this any time they choose, just as they could have done to reinforce, clarify, change, or rescind DACA at any time they wished before now.

  • Skokieguy [Larry]

“The executive branch through DACA deliberately sought to achieve what
the legislative branch specifically refused to authorize on multiple
    occasions,” he said.

Yes, because Congress over and over, abdicated is responsibility.

    • popebuck1

There was a bill, with bipartisan support, which McConnell and Ryan wouldn’t bring up for a vote – because that would have been a “win” for Obama, and NOTHING took priority over denying Obama wins. Obama acted via executive order because the GOP Congress wouldn’t do their fcking jobs.

      • Skokieguy [Larry]

Yup, as they announced the day he was sworn in. Trying to ruin the black guy was and is the most important goal. Ruining the country in the process? Just collateral damage.

“The policy was implemented unilaterally, to great controversy and legal concern.”
Mr. Sessions called the Obama-era policy an “open-ended circumvention of immigration laws” and an unconstitutional use of executive authority.

What, then, would be Trump’s unilateral, popularly and legally controversial, open-ended circumvention of immigration laws and unconstitutional Muslim Ban executive order be?

  • Skokieguy [Larry]

So Jeffy, where will the money come from to pay for all this?

Will you be using boxcars to improve efficiency?

  • Jonathan Smith

I thought if the president DID it it CANNOT be unconstitutional…..

That’s “at-will employment” not starve them soshulist yoonyuns so workers will take whatever pay management offers and work in whatever conditions management provides “right to work.” both need to go.

        • Tomcat

It is called (right to work) not at will employment in Tennessee and it allows employers to hire and fire for any reason or no reason. And in Tennessee (at will employment) is not a term used or even known.

          • boatboy_srq

Other states (VA, for instance) make the distinction, and use them to the respective different ends.

      • wmforr

It’s called Double-Speak. Call it by its opposite. The Republicans have outdone George Orwell with it: Clean Skies, Fake News, Right to Life, Freedom Caucus,… The idea is to totally destroy the meaning of words, so nobody can contradict you.

      • Joseph Miceli

Orwell is spinning like a top.

This, and the underground railroad for Chechen gays, started a serious discussion last night of moving to Toronto. I just don’t think America is America anymore, if it ever was.

      • David Walker

It tried to be. Excellent vision statement. Concise mission statement. Well-written set of civil laws that can be updated as necessary. It tried. It never achieved those goals, but it sure as hell tried. No more.

        • CharlestonDave

I think it was more of a hiring issue. Somebody in HR needs to be fired.

      • canoebum

Moving to Canada is a wonderful notion for some Americans. I’d move there if I could. Two things will help your cause: be young, speak both French and English.

        • prixator

In Toronto, you can get by very well with only English (I do). Of course, a second language is always useful, but not a requirement – except in some jobs, especially in government (citizens have a right to access govt. services in both French and English).

Edited to add: Housing in Toronto is VERY expensive right now – real estate and rents.

          • canoebum

I was referring to the Canada Immigration (point based) scoring protocol. If you’re not young and don’t speak French, your chances of getting in are significantly diminished. You can get by even in most parts of Quebec without speaking French, but you’ll see some occasional resentment. I love Quebec. As a visitor I’ve had many enjoyable trips. At times though, people have refused to speak to me when I addressed them in English.

          • William

They didn’t even want to let me into Montreal for a visit! I had to go to special detention and convince some delightful sparklepony that I had no intentions of staying.

I don’t recall anyone ever questioning the executive authority or the constitutionality of DACA before today. In fact I predict many court challenges to the constitutionality of today’s recinding.

    • Tiger Quinn

Apparently suddenly the President does NOT have EO authority, which is weird given Trump’s last ten free for all months.

  • Tawreos

If it was unconstitutional then why didn’t you take it to the Supreme Court to have it vacated?

  • Tiger Quinn

I know I shouldn’t be shocked anymore, but I was open mouthed watching him stand there and lie about one thing after another. It’s not a path to amnesty. Their parents don’t get anything. Yeah, they DO pay into SSN, but they don’t get to take anything out. Wow.

  • Let’s see — Barack Obama was a professor of constitutional law at one of the top law schools in the country, but couldn’t figure out that his executive order establishing DACA was unconstitutional, according to Jefferson Beauregard Sessions III, who took his JD from the U of Alabama Law School, was nominated to the federal judiciary and was rejected because he’s a racist bigot.

  • Uncle Mark

Curious. Wasn’t the Attention-Whore & Chief the one proclaiming that he was going to be the one making this announcement today? Why did he send his little imp to make this announcement? Did he suddenly realize that he continues to paint himself in the corner with this? Or that he divides the GOP on this? Or that this is not popular with big business? Or were his handlers afraid he was going to go off script again on another racist rant?

  • TheManicMechanic

Looks like every initial reply has at least one downvote here. The Trumpbots are out in force, along with a few leftover BernieBros and SteinDrinkers.

“open-ended circumvention of immigration laws” and an unconstitutional use of executive authority. “The executive branch through DACA deliberately sought to achieve what the legislative branch specifically refused to authorize on multiple occasions,”

Look, you racist Keebler Elf, motherfucker. Barack Hussein(I know how you racists sons of bitches looooove to stress the Black Guy’s middle name) Obama did what your Orange Overlord did when he took over. He exercised prosecutorial discretion. Donald Trump is such a wimp, such a pussy, that he sends his little lawn jockey errand boy to do his bidding.

Let’s see we’re punishing children whose only crime was to be brought unwillingly by parents to this country and who probably only know these United States as their home. You and your racist, xenophobic, assholes comrades are a bunch of heartless thugs– yes, thugs–who do not care a whit over people.

You claim yourself a Chirstian, Jeff Keebler Elf Sessions. I guess you slept through the day they were teaching Ezekiel 18:20, asshole. Here’s a fucking refresher needledick:

The soul that sinneth, it shall die. The son shall not bear the iniquity of the father, neither shall the father bear the iniquity of the son: the righteousness of the righteous shall be upon him, and the wickedness of the wicked shall be upon him.

    Fuck you, Donald J. Trump,
Fuck you, Jefferson Beauregard Sessions III
    Fuck you, Stephen (Kapo-boy) Miller
Fuck you, Jared (Jelly Spine) Kutchner
Fuck you, Ivanka (Daddy’s Little Princess) Trump

The Universe has a pretty wicked way of setting things straight, you bunch of assholes. I hope your reckoning is creative and very damaging

  • Natty Enquirer
  • Ken M

The courts decide if it’s unconstitutional, NOT Congress.

  • Raising_Rlyeh

Yeah, congress is not going to do anything. Of course, by the kkkeebler elf’s logic trumps immigration ban is an overreach, but I know he doesn’t feel that way.

  • JackFknTwist

Sometimes I am speechless at what is happening to the most benevolent country in the world.
USA has lifted so many countries, it has refueled Europe after WWII, it has been a sanctuary for starving Irish after the Famine of 1847- 1850, and other countries, of course, it has been a source of Civil Rights and a generator of international trade and a source of international understanding,………now it is hardly recognisable, there seems to have been a lurch to the extremist right wing, and an astonishing plunge in civility. Now it is picking on children………a soft target for the fascists Trump + Sessions.

  • Halou

I think Trump is giving Sessions and his Congressional co-conspirators a six month long window for fear that a blanket expulsion order would end up affecting his current wife. Melania’s initial visa to enter the US did not allow her to seek paid work within the country, so when just such a thing was done she voided her visa and would under Trump’s rule qualify for a free flight to Slovenia never to be allowed back in again.

Not for any love of his wife though. It is merely to avoid being embarrassed by ICE agents knocking down the doors of the White Power House.

Don’t you just love it when Jeff Sessions pretends to understand the Constitution!?

  • Professor Barnhardt
    • Paula

He’s not that tall, is he?

  • CJAS

Not real surprising from an AG who said that the Immigration Restriction Act of 1924 that was consciously crafted to end “acceptance of all races” (specifically limiting supposedly genetically inferior Italians, Jews, Africans, Middle Easterners, and totally banning Asians) “was good for America”.

  • wmforr

Of course Sessions says the Rule of Law is sacred. Just like he said when Trump pardoned Sherriff Joe, right? Just like he did when he committed a felony by lying on his security clearance form about meeting with Russians, right? Just like he did when he said he won’t enforce Affirmative Action, ’cause he doesn’t like it, right?
Hypocrite among hypocrites. Diogenes would go craze looking for an honest man among the Republicans.

  • David

I truly will never, ever understand the joy and pleasure conservitives get from brutalizing children.

  • Mark_in_MN

“The nation must set and enforce a limit on how many immigrants we accept each year, and that means all cannot be accepted.” The United States does this, but there is no “must” about it. We do t have to. It is not something required by the constitution. We could do it another way. This is a really lame justification to trot out here.
