California Bakery Refuses To Serve Gay Couple Because “Our Business Is God’s Business, We Work For Him”

ABC News reports:

A Bakersfield bakery is facing controversy after they reportedly refused to serve a gay couple. Posts on social media have criticized Tastries Bakery for refusing to make a wedding cake for a gay couple. The owner of the bakery has said she chose not to create the cakes because of her beliefs.

Owner Cathy Miller said, “Here at Tastries, we love everyone. We are Christians and we know that God created everyone and he created everyone equal so it’s not that we don’t like people of certain groups of people, there are just certain things that violate my conscience.”

In the video at the link, Miller says, “Our business is God’s business, we work for him. I shouldn’t be picked on because of my beliefs.”

          I attended a pool party recently with a bunch of bears…and one mom and her son who was celebrating his 2nd birthday. The boy did *exactly* as depicted in this picture…and then he took a liking to me, and used my bend legs as a jungle gym and to steady himself as he rubbed more and more frosting on him…and me. I rinsed off with the hose before going home. 🙂 The mother thanked me profusely for being a good sport. We gay-bear extended family must repre-SENT! 🙂

Perhaps even have a table at wedding conventions and offset the cost of exhibiting by charging a small fee to be ‘certified’ as serving everyone (except the inevitable Christofacisct that will come in asking for a cake saying “Die Fags” or “I love Hitler” which could be totally refused, as you are not providing “hate cakes” (regardless of the gender, politics or religion of the requester of said cake).

      The weekend after the day same-sex marriage became legal in California (pre Prop 8), the now hubby and I stopped in at a local bakery known for its cakes (lots of weddings, lots of cakes for t.v. show wrap parties, etc). We said we’d like to see a cake consultant person (or whatever they’re called…) and we were told “I’m sorry, but we can’t accommodate you.” We were about to get really irate when the person said, “But next week has some openings.” We looked and the consulting room was filled to the brim with same-sex customers looking at catalogs and trying samples.

        I went through there a few years ago when I took the Greyhound from SF down to Los Angeles with a friend. The bus stopped for a short break in Bakersfield before going on to LA. God, what a depressing town! I had lived in LA for over 20 years, and had no idea a city that sad was that close to LA. The locals all looked like they should have been on suicide watch.

I was right across from the cultural highlight of the area, the Buck Owens Museum, although now it looks like the museum is combined with a restaurant. As a side note, as I was googling the Buck Owens museum for a handy hyperlink, I stumbled across a renovated Padre Hotel site. Looking through it, I found the pic below.       The flip side of that is this. Allies making themselves known so the bigots see how they’re outnumbered works too. The 5th circuit let things proceed, but there was VERY little celebration. I think the bigots know this type of thing can only happen a few times at the edges before people get fed up with them. A SCOTUS fight is coming and since this involves business, the decision might be clearer than some of the other ones.

    It may be “God’s business”, but I’m pretty sure Bakersfield required you to get a permit before opening it for him. Along with that permit comes a few rules you must follow. Your permit could be revoked for violating the rules, and you can go back to baking cookies in your kitchen at home. God won’t miss having a business.

      Your earlier link included the SPCA. They did amazing things in Harrison county after Katrina. The shelter was rebuilt and paired with shelters on the west coast. We are now no kill because the “extra” kittens and puppies go to sister shelters that can use them because they have been successful with spay/neuter programs and run short of adoptable animals. They also stood up a great low cost spay/neuter program here. Hopefully one day we can stop being a donor shelter and shift to an outplacement shelter easing pressure on other shelters.

            What most people, even in the community, don’t realize, is that only 19 states have statewide protections based on sexual orientation. Of the 31 others, some counties or cities may offer them. In most states however there is nothing protecting the LGBT community from any kind of discrimination. Very few federal protections, including housing and employment, include sexual orientation. Scary for the 21st century.

      • This bakery wasn’t “targeted”. If these couples had known about Miller’s bigotry, they would never have gone in to the store. Even her staff wasn’t aware of the owner’s views, they had treated both couples wonderfully in earlier visits. It wasn’t until the owner herself sat down to finalize plans that the issue came up. The only harassment here was by the bakery’s owner.

    I think that no jurisdiction has enacted a new public accommodations law since the wedding services [cake, photos, flowers] cases popped up.

    I also think it may very well make sense to consider whether it’s worth it to pursue such issues through the legal system – as opposed to negative but factually accurate publicity on Yelp – as it just creates somewhat sympathetic martyrs for the right, not to mention a case at the Supreme Court with Judge Gorsuch.

    Is it really worth it? Thank you.

        I notice from time to time while watching videos of animal rescues (mostly dogs) by Hope for Paws (Eldad Hagar) that a family dog has been left behind when the family moved away.

        How extraordinarily cruel!

        My own attitude is that when you take a pet in, cat, dog, cockatiel, whatever, you make a commitment to look after him or her for the rest of their natural life, including the sometimes rather costly vet care in their last years.

        One of the things my husband and I have been trying work out is our plan for evacuating our pets in the event of an emergency (natural or otherwise). We have 4 dogs and a cat, and that kind of logistical nightmare can’t just be left to winging it. I don’t think my husband understood how scared I am or how serious I was taking disaster planning until I started packing emergency bags for our pets. I have made sure we have enough crates, leashes, food, and supplies for all of them with our own supplies. There was a time when I thought those end of the world prepper people were nuts, but I am starting to see the wisdom in having a good plan and at least a fair stash of supplies. The neighbors are going to start talking about us if my stress level gets any worse; I’m going to be out in the yard with a clipboard and whistle running disaster drills.

      Actually, the City of Houston sent a fleet of school buses to rescue NOLA residents from the Super Dome and elsewhere just a couple of days after Katrina while W’s FEMA dithered. When the Houston Mayor was asked how the city would pay the expenses, he said “We’ll bill the Feds later. What’s important now is to rescue these people.” Many of those NOLA evacuees chose to stay in Houston rather than return.

          In my defense, it was hard to tell (at least to me) from this video who was pursuing that journalist. You are right that whoever did this, antifa or not, needs to be called out. However, federal prosecution and terrorism charges are extreme, and it’s very telling he focused on antifa instead of similarly condemning the Nazis.

That suggests AR-15 pattern weapons. If they’re the older M16A1/A2 types, they’re probably worn out. I’ve dealt with enough of them in property-book or range settings, and they’ re apt to be dirty or rusty or simply mechanically worn, which means the firer has to put up with double- or triple-feed stoppages, or bolt-carrier lockups, or maybe a cookoff.

        It’s stuff that should be melted down for frying pans, not re-issued.

      Houston has like 5 or 6 million people. From what I’ve heard they apparently tried a mass evacuation with Ike or Allison and it was a completely mess because everybody got stuck in traffic jams on the roads. So this time they decided not to do the mass evacuation and to shelter in place and well, it may be a case of damned if you do and damned if you don’t since they have unchecked development in a flood plain in Houston.

            As someone remained at their home through the actual hurricane Katrina (Harrison County MS), on the east side with 31ft surge, tornadoes, and 125mph winds – not the clusterfuck that NOLA had because of the ACoE I think I know a bit about storms/evacuation/recovery. I’m at 100 feet elevation so the biggest danger was not present. The rain and tornado possibility went far inland. For me the sensible decision was to stay put and shelter others. I have Camille, Frederick, Elena, Georges, and many minor storms under my belt and still have to assess each storm as they come.
            I take care of me and mine, then try to help others. There are times to evacuate and times to stay put. Evacuation is always situational. Some people can’t evacuate. Some deserve the misery because they’re in a dangerous area and choose to not evacuate. Then there’s the rest of us, making the best choices we can with the information we have. Look up the track on Elena and tell me how people could plan to evacuate. It went from offshore at Pensacola to the Big Bend than made a hard landfall in MS.
            The TX officials had to look at history (RITA) and figure how many people would be on the roads. Most states instituted counterflow after SC did it with Hugo. My parents evacuated Mobile AL for a strong storm. It took them 18 hours to reach Birmingham, AL (normally a 5 hour trip). Until you’ve lived through some big storms you need to step back and not throw rocks at folks who have been there.

        Building a highway system for moving flood waters doesn’t exactly help with the evac of millions of people via the highway system. Silly circle, repubble thought- how do we evac people? Oh build another highway. Which of course is allocated as the primary route again for floodwaters.

          To fix the flooding problems in Houston, a deep level storm sewer system would have to be built, with tunnels to draw floodwater to the Gulf. It would have to be massive, and nobody will ever pay to build such a thing.

          That’s the thing that happened after Katrina: there were a ton of dog rescues, where dogs had (by contemporary humane standards) suffered/abuse/neglect/allowed to breed unrestricted. It did set up some nasty legal fights, where the original owners accused the (unwilling to return) rescuers of cultural/class prejudices (e.g. pit bulls w/ their ears docked). Messy.

          Cesar Millan did an episode on this, where he was about educating the original owners, not confronting them (and of course, Cesar went ahead and had ’em all FIXED before returning them!).

        I had my cat Gypsy in to see the vet a couple of weeks ago. We discussed her arthritis at length, with some emphasis on the fact that just a few days earlier, she’d gotten much worse.

        Dr. Signorella is a good vet, so she got down on the floor and clipped the cat’s claws while we were there. Yes, on the floor.

        Two days later, Gypsy started to move much more fluidly, though she’s still arthritic.

        I have a horrible suspicion I wasn’t checking her claws often enough…

            Devil disease???? Yes. My diabetes has slowly worsened since I was diagnosed in early 2005 and I seem to have reached the point where my pancreas has completely failed. Insulin is now a necessity. The other side of the coin is that I have to pay close attention to my carbohydrate consumption; nutritional labels are a subject of interest now.

            Pizza isn’t the only thing verboten (due to that lovely chewy yummy crust). Rice. Potatoes. Pasta. Baked goods of all descriptions, including bread and double yummy Eccles cakes, to say nothing of pizza, to my great sorrow.

            Eccles cakes: puff pastry filled with a mixture of currants and orange peel. I’d never had them until I moved from the US to Victoria, but I became an instant addict and they’ve been a favorite junk food ever since.

        NW Houston here. It’s been raining hard all day. All the bayous will be in flood stage, most at record flood levels, before tomorrow morning if they aren’t already there. This disaster won’t be over until at least next weekend. They’re calling this a “500 year” flood. (I’m OK. My neighborhood hasn’t flooded in any of the floods of the last few years. Hopefully, this trend will hold in this flood.)

      So, we used to live across the street from some semi-public housing. It wasn’t a bad or dangerous place, but some of the kids liked to pull the fire alarm on a fairly regular basis. We’d hear the alarms and just ignore them. One night, about three in the morning, I was asleep in my bed and something woke me up. I could hear the alarms going. I stumbled to the front door and opened it, and there he was. OMG. All you could see with all the gear was a slit between the nose and forehead, not unlike what some women in a burka show. But it was enough. The eyes… Did I say “OMG”? I was dumbstruck. He was explaining something about evacuation routes and all I could do was stare at those eyes. I really had no idea what he had said, but I gathered up the dog and we went downstairs. All the neighbors were gathered across the parking area in two groups. One was made of up people discussing why our alarms had gone off. I joined the other, larger group who were all discussing the drop-dead gorgeous fireman and his remarkable eyes.

They don’t even require cities to enroll in NFIP, which secures recovery funds for infrastructure destroyed in flooding. Any city that is at risk and fails to have flood insurance is derelict.

      People can’t even get a loan from a bank to buy condos in my complex because USGS mapped part of the complex (about 1/5 of it, at the east end) into a flood zone. And I live in the desert – there has *never* been an actual flood here according to longtime residents who are in their 80s and 90s. So condo owners who want to sell in the complex are more or less limited to cash buyers. Our HOA has been working on getting the floodzone maps revised for years, with no success so far.

        Banks require flood insurance for mortgages if the property in in a flood zone most places, even TX. The issue is that as you’re talking about those maps are pretty far out of date. Houston has exploded based on older flood maps. Ours are recent, because: Katrina.
        I can’t get my head around the state not requiring cities to have flood insurance. insurance from the feds has to be less costly than self insuring city/county property and infrastructure.

        My take on it:

        The key word is heterosexuals who “admitted” to having anal intercourse (44% male – 36% female). Double that number and you’d probably be a lot closer to reality. It’s not really about the sex act, it is more about feeling guilty (dirty) about sex in general and re-focusing that sex-shame on a vulnerable minority. The same way many racists in the Old South would over-sexualize Black men as a “threat” to their precious and vulnerable White Women. It is an unhealthy attitude about human sexuality expressed as sex-shaming and anti-sex aggression redirected toward “the other…the outsider…the non-conformist” — whether that be another race or a different sexual orientation. In the anal sex context concerning homosexual males, it is also about an affront to and a perceived rejection of gender roles.

        As far as making a federal or state case of a publicly licensed business refusing you service; doing nothing about people violating your civil rights is the same as enabling it and an admission that your existence is not entitled to equal treatment under the law in accordance with the American Constitution. Never let anyone think that they have “the right” to tell you to shut up and go sit in the back of the bus — not if you have any self-respect or care about your community, as well as the future of the next LGBT generation to come.

            I believe as a business owner she should have to serve anyone who comes through her door. She does not. Neither of us are ever going to change our mind. If you want to use the occasion of your marriage to try to force her hand, please proceed.

            But if I’m having a big wedding I don’t want to go to court. I want all our friends and family, and fresh flowers and passed hors d’oeuvres and good liquor and a cake that is beautiful and delicious. For me, for that one day, it’s not about the fight, it’s about him and I.

There are many, many, many bakeries that would love to make a wedding cake for gays (wedding cakes cost hundreds of dollars, or so I hear — what bakery wouldn’t love that kind of business?). These people also probably will make hundreds of thousands of dollars by starting a legal defense fund. Just put a note on Yelp, or whatever, saying that they don’t serve gays, and then find a bakery that does, a bakery that deserves to get your day dollars. Why do gays want to give money/business to people who hate them? How many decades later are some gays still not drinking Coors, or going to Cracker Barrel, or whatever?

    I feel like some gays are saying: “You hate us!?!?! Well now I am going to FORCE you to take my money. Money that you will probably turn around and donate to Focus on the Family, or the Family Research Council, or NOM!)

    (That last part was a joke, no one gives money to NOM).

    Three bakeries out of several thousand have refused to make a gay wedding cake and we make them front page news, we make them into martyrs.We make them the poster children for “religious liberty” laws.

        The religious right sees them as martyrs and they convince their average friends, who all call their legislators, who then make ‘religious liberty’ laws because of some bakery or florist.

        But my biggest issue is: why do you want to financially support businesses that hate you? I would walk into a bakery and ask: how do you feel about same sex marriage? The owner says “I don’t” then I would walk out. Wedding cakes are hundreds of dollars. You don’t buy a $4 Chick-Fil-A sandwich but you want to spend $800 at a homophobic business?

        • To your first point, sure, they make religious liberty laws, but the vast majority fail to pass because they aren’t really religious liberty laws – they are Christian entitlement laws, and if they do get passed, they go through the same dance that any religious entitlement occurrence (crosses on public land, prayer in public schools, ten commandment signs in courthouses, etc.) goes through, ending in it being ruled unconstitutional.

          To your second point, I suspect the gay couple DON’T intend to support businesses that hate them. I suspect they are publicizing this either to win support from the public or in order to launch a court case in the hope that the business has to pay a settlement. But there could be lots of reasons. Maybe the bakery is the only one in town and the couple have limited mobility. Maybe they are committed to local businesses and they are appalled that a business they assumed was good is this homophobic, so they want to teach the owners a lesson. Maybe the couple are just two real assholes who want to stir up trouble. Or maybe they are just not that bright. Or maybe they’re neighbors of the bakery and want to force them out of town. Or maybe a friend of theirs works there and they wanted their cake made by that person.

          But either way, it doesn’t matter. Everyone has the right to complain. It’s freedom baby, yeah!

          You assume their motives are simple, and that they’re just being stupid by trying to support a homophobic business, but things are often a lot more complicated. If you really want to know, you’d need to ask them. But making out that they’re stupid when you don’t know the whole story is… well, kinda silly.
