Trump Sued Over Proposed Ban On Transgender Troops

President Trump’s recently announced plan to bar transgender people from the armed forces isn’t yet policy, but LGBT legal groups have already initiated a lawsuit seeking to enjoin enforcement of the ban.

The 15-page complaint was filed Wednesday in the U.S. District Court for the District of Columbia by National Center for Lesbian Rights and GLBTQ Legal Advocates & Defenders on behalf of five anonymous transgender service members identified as “Jane Doe.”

Although the Pentagon has said there would be “no modifications” to transgender service until further guidance from the White House, the lawsuit — known as Doe v. Trump — maintains Trump’s announcement “upset the reasonable expectations of plaintiffs and thousands of other transgender service members and the men and women with whom they serve and fight.”

“Execution of the president’s directive will result in an end to service by openly transgender service members and has already resulted in immediate, concrete injury to plaintiffs by unsettling and destabilizing plaintiffs’ reasonable expectation of continued service,” the lawsuit says.

      Even were a lower court to decide in favor of plaintiffs in the lawsuit that’s the subject of Joe’s post, the ruling would have to survive review by the Supreme Court.

      Lots of uncertainty in the above.

        Just from my own experiences, I have friends that support LGB rights but think the T is another matter entirely.

          I’ve made a similar point in other comments of mine: Not all LGB-friendly straight people – and not all LGB people themselves – are on board when it comes to the “T’s.”

          The theofascist right knows that, which is why trans people are in their crosshairs.

            are changing with more visibility, more transmen and transwomen coming
            out . As a woman with a history of transsexualism the one thing I knew
            is not everyone is going to understand or agree with your decision to
            transition. That still holds today. When I came out to friends and
            family I told them it was ” okay if they couldn’t handle the changes,
            don’t try to understand the whys ,how it just is”. We only lost one
            couple due to religion.

            I’m
            not sure when I first arrived here at Joe’s Place of Sanity but have
            always felt trans issues have been well supported by ALL the regulars
            here and when a true hater chimes in their legs have been chopped at the
            knees by the best witted here. I rarely need to add my 2cents.

      Booting experienced, willing & loyal service people (trans, gay, lesbian, bi, or even straight) does NOT make this country safer. It’s also wasting money the nation invested in them. We already have enough of a problem getting and keeping qualified people to work in the military service. Perhaps if there is a draft (with no deferments allowed for the wealthy or well-connected) to make up for the foolish removal experienced personnel, some folks will feel differently about the LGBT in the military.

    Fingers crossed, but “upset the reasonable expectations” and “immediate, concrete injury to plaintiffs by unsettling and destabilizing plaintiffs’ reasonable expectation of continued service” may not cut it.

    Without federal codified law (as opposed to Obama Executive Order action) protecting the civil rights of trans people, plaintiffs’ arguments here might not fly.

      If the plaintiffs are currently members of the military, they may be able to argue that they reasonably relied on the change in policy to come out as transgender. I don’t know whether they’ll win, but it’s at least a decent argument. Unfortunately, it doesn’t help any transgender person that may want to join the military in the future.

    While I agree with the merits of the case and there’s a very good chance of prevailing if it becomes a policy, people shouldn’t be alarmed if it is tossed as not being ripe – no actual change in policy other than Agent Orange’s tweet.
