BREAKING: Justice Department Files Brief Arguing That LGBT Workers Are Not Protected By The Civil Rights Act

Dominic Holden reports at Buzzfeed:

The US Justice Department on Wednesday argued in a major federal lawsuit that a 1964 civil rights law doesn’t protect gay workers from discrimination, thereby diverging from a separate, autonomous federal agency that had supported the gay plaintiff’s case.

The Trump administration’s filing is unusual in part because the Justice Department isn’t a party in the case, and the department doesn’t typically weigh in on private employment lawsuits.

But in an amicus brief filed at the US Court of Appeals for the Second Circuit, lawyers under Attorney General Jeff Sessions contend that Title VII of the Civil Rights Act of 1964, which bans sex discrimination, does not cover sexual orientation.

“The sole question here is whether, as a matter of law, Title VII reaches sexual orientation discrimination,” says the Justice Department’s brief. “It does not, as has been settled for decades. Any efforts to amend Title VII’s scope should be directed to Congress rather than the courts.”

The Justice Department also contends that Title VII only applies if men and women are treated unequally. “The essential element of sex discrimination under Title VII is that employees of one sex must be treated worse than similarly situated employees of the other sex, and sexual orientation discrimination simply does not have that effect,” the brief says.

            I think part of the problem of growing up with privilege – and by privilege I mean being able to go into any establishment and know you will be served, or applying for a job and knowing you will be judged on merit – is that it can be difficult to wrap your head around the fact that it isn’t like that for everyone. Growing up in a small, WASP, old money town, it was impossible for me to understand, as a 10 year old, why those “whites only” signs that I saw on our vacation to Florida, existed. And I remember how much is distressed my parents when they tried to make me understand. I kept repeating every child’s favorite line, “But why???”

            As you say, until you lose those rights, it can be difficult to truly understand, although with modern communication and tv, it’s easier then back when I grew up.

            There was a teacher who divided her young class by eye color. Light eyes were better than dark eyes, and all the light eyes were encouraged to discriminate against the dark eyes, who had fewer classroom privileges. Then, she reversed the process. Those are kids who will grow up to understood discrimination, because until you live the negative side of it, it’s hard to wrap your head around. Basic straight, white, middle-class, privilege feels as natural as breathing to those who have it, and until you have to struggle to achieve it, it can be hard to grasp that it isn’t there for everyone.

            When there are stories, denigrating any other religious group, I avoid making comments, as I do not feel, that I have the right to publicly criticize another religion or religious group. OTHERS should keep that in mind, as well.

I am normally a “big tent” queen, but I draw the line at people who are actively working against my/our civil rights. Similar to the “outing” phenomenon years ago. I have taken heat here (and in other LGBTQ forums) for defending gay people of faith, or folks who vote GOP. For me, that is too broad a brush, as I think it behooves us to have friends in all circles, if for no other reason, than for reconnaissance. Also, not all GOP members, or people of faith, are actively working against us. Jew catchers existed, as did Qusling and many other treacherous folks who are directly responsible for other Jews’ and Norwegians’ deaths. Finally, you have no idea what my ethnicity, race, or religion is, keep THAT in mind. Even if it doesn’t conform to your sense of propriety, you are not the arbiter of what is offensive, especially for terms that are part of common parlance (for decades). I stand by my comments.

            There’s a subtle and nuanced dynamic surrounding the use of the word “Jew.” Context is all-important.

            As you know, Hank, Jewish people use the word “Jew” all the time when referring to themselves and other Jewish people. Non-Jews who aren’t anti-Semitic also use the word. Non-biased journalists and historians too.

            But when bigots – be they on the far-left or the far-right – say “Jew,” the Jewish ear stings. We know the context in which they’re speaking. The bigotry. The hate. The ability to discern that bigotry and hate is, I think, part of the Jewish genome.

    I have mixed feelings. First, I believe this will get to the Supreme Court. Second, if the SCOTUS decides against LGBT people, that means the status quo holds. There are no protections now for us in Federal law as it is currently interpreted. Therefore, the worst outcome doesn’t change a thing.

    And there is the potential for a decision in our favor. We still have Kennedy on the court. Even the Chief Justice may come to realize he doesn’t want to go down in history as the modern day equivalent of the segregationists in terms of gay rights. So it is a heads, no change, tails, we win, situation.

    I’m actually kind of hoping that Sessions wins on this. Here’s why: I think that the “interpretation” that Title VII covers sexual orientation workplace discrimination is and always was a boobie/consolation prize, and a piss-poor substitute for passing ENDA. And this case now shows exactly why, in black and white.

    Now, nobody in Congress will be able to claim that a specific law like ENDA isn’t a priority or necessary because, guess what? A new administration came in and just like that reversed the (pretty far-fetched) “interpretation” of Title VII that the Obama administration made. This shows just what bullshit this kind of hodge-podge fix is. We need a law that specifically spells out that discrimination against LGBTs is wrong.

      While the legislation wasn’t intended to protect LGB or T, the interpretation that the prohibition on gender discrimination logically also forbids discrimination on the basis of being seen as violating gender norms isn’t far-fetched.

      I would however, like you, prefer civil rights protections for sexual orientation, gender identity and marital status to also be specifically spelled out.

      Recenty listened to a CBC podcast on the inclusion of minority rights–specifically gays and lesbians–into the Canadian Charter of Rights and Freedoms. The case was made for explicit inclusion and turning that back would require a constitutional change that just won’t happen. Perhaps a constitutional amendment is needed in the States.

        I’m not saying we don’t have a battle ahead regarding the minority issue. But sexual orientation is only barely covered in some city and states as a protected class. The federal Govt has NEVER included sexual orientation as a protected class regarding employment, housing etc. The issue is not do we fight. The issue is the best way to do so and expect to achieve our desired goals.

    “The recruiters for Global Horizons sought out poor Thai individuals in Thailand and made them promises of high wages and good working conditions in exchange for jobs in Hawaii,” said Tom Simon, a special agent with Honolulu FBI.

    Simon says Aloun Farms on Oahu is one of 14 Hawaii farms that used Global Horizons work force. Aloun’s owners, brothers Mike and Alec Sou, are already under fire for a separate case that also involves luring and mistreating farm workers from Thailand. Their next court hearing is September 9th.

    “These are two totally separate cases. We’re not saying that Aloun Farms did anything wrong in this situation involving this indictment,” said Simon.

    The indictment, filed on September 1st, alleges that the recruiters paid the workers less than what they promised, did not honor their employment contracts, and took away the workers passports so they couldn’t escape.

    In one case, the indictment says they “strung yellow tape around the Maui Pineapple Farm housing and installed bells on string lines in the woods to alert the guards if a worker attempted to escape.”

    Edited to add: Can everybody push this story because it’s under-exposed and I’m tired of people having a god damn blind spot about refusing to acknowledge or do anything about the DEMAND side of the labor equation.

        There is a whole slew of Democrats from California that I like (Swalwell, Matsui, Ruiz, Takano, Lieu, Schiff, Sanchez, etc.), but I assume you’re asking because Pelosi seems to be a turn-off in places like Georgia or Ohio. I’m not sure any of the kind of Democrats that do well in California would be a superstar in the Midwest or the South. Also, being a good majority/minority leader is not the same thing as being a congressmember who votes well. That requires a special political skill set and you have to be the bad cop sometimes to keep the party together.

        As far as vulnerable CA Republicans, I would say that Valadao, Rohrabacher, Issa, Royce, Knight, Denham and Hunter will all be vulnerable next year. McCarthy, McClintock, Calvert and LaMalfa are probably safe in their districts. Not sure about Nunes – his district is very Republican, but his shady behavior with the hearings might make him a special case next year where he could get defeated.
