BREAKING: Trump To Legalize Anti-LGBT Discrimination With Thursday Order, Religious Leaders Invited

Politico reports:

President Donald Trump has invited conservative leaders to the White House on Thursday for what they expect will be the ceremonial signing of a long-awaited—and highly controversial—executive order on religious liberty, according to multiple people familiar with the situation.

Two senior administration officials confirmed the plan, though one cautioned that it hasn’t yet been finalized, and noted that lawyers are currently reviewing and fine-tuning the draft language. Thursday is the National Day of Prayer, and the White House was already planning to celebrate the occasion with faith leaders.

The signing would represent a major triumph for Vice President Mike Pence—whose push for religious-freedom legislation backfired mightily when he served as governor of Indiana—and his allies in the conservative movement.

According to the above-linked report, the order is only slightly revised from the sweeping anti-LGBT order that was leaked to the press in February.

“The ACLU fights every day to defend religious freedom, but religious freedom does not mean the right to discriminate against or harm others. If President Trump signs an executive order that attempts to provide a license to discriminate against women or LGBT people, we will see him in court.”

          Gorsuch replaced Scalia. Scalia would not have voted in our favor on a matter like this. Therefore, while someone more centrist or even liberal would have been a bonus to our side, Gorsuch doesn’t materially impact the results of cases in the immediate future.

          It’s the NEXT appointment, if it’s replacing one of the centrist or progressive judges, that’s the much bigger practical concern.

            Or Kennedy is the rumor I’m hearing, supposedly this summer. About Roberts being the swing vote now, not so much on LGBT issues I don’t think. He made sure to make snide remarks the day the Obergefell decision was issued in which he basically said the constitution had nothing to do with that ruling, so he thinks we don’t count as full citizens it seems. The only thing I remember being surprised about with him was that he sort of semi-upheld the ACA, but I understand that was at his wife’s insistence.

          Well if you’re going to take advantage of religious freedom protections to discriminate against people, you need to show that such discrimination is based on a religious belief and not a political one.

            The question is, what’s the difference between a political belief and a religious one? One could just as easily say that a allegedly religious person was discriminating against a gay person because of their political beliefs, not because of their religion and prove it in court by showing inconsistencies in their choices of whom they discriminate against based on what “sin”.

If you are trying to say that you can’t serve certain people because your religion doesn’t tolerate them, I suspect all you would need to do is show that your is based on a religious tenant that you actually believe in. I don’t think the state is allowed rule based on whether you pick and choose what discriminatory beliefs to live by.

            If religion is being used as a reason to discriminate in any respect, it becomes open to a legal challenge. Demonstrating that a decision by a court requires ruling on the validity of a religious belief may be sufficient to invalidate an EO or law. That sword may cut both ways though.

My reasoning is that the establishment clause keeps the government from deciding what kinds of religious beliefs are real as long as they are sincerely held. My understanding is that these cases revolve around whether the state has a good enough reason to impede a particular belief or if the complainant is sincere about whatever government law or action being against his/her religion. It’s not hard for Christians to show that their religion tells them to exclude gay people. My question is what religion would give us license to exclude Christians?

            I think that may be a meaningless question. The problem is exactly the paradox this and other questions raises. A belief is never sufficient to justify an action that is against the law.

            It’s not hard for Christians to show that their religion tells them to exclude gay people.

            On the contrary, courts cannot rule on the validity of a religious belief and cannot determine if a belief is part of a particular religion or not. Just claiming that a religious belief should exempt someone from the operation of an anti discrimination public accommodation law does not work even if is sincerely held. This makes religious belief unsuitable to test the constitutionality of a law and courts don’t do that. Furthermore, the First Amendment forecloses any path to the elevation of an arbitrary religious belief per-se to the status of law.

            Isn’t that what we’re all afraid of? It may be moot the moment since the EO didn’t do anything of consequence isn’t the fear that a law or conservative court would say that non-discrimination is no longer more important that religious free exercise?

            Courts, even more conservative leaning ones, have consistently upheld non-discrimination laws. Nothing is impossible, and SCOTUS could change direction, but that is unlikely.

            The interpretation of the notion of “free exercise” doesn’t give religious people or their organizations (churches, private membership “clubs”) the right to break the law. They can pick and choose who they will let into certain parts of themselves, and courts have found for them when they did, including whom they could employ in certain positions, carving out certain protections for churches and their organizations to “discriminate” on the basis of religion and sex.

            Businesses that are not churches or religious organizations are all going to be held to the same standard. Wedding photographers, caterers, and bakers are not “religious organizations”, and their work is not about the “exercise” of their religion. Were they to be so classified would make a mess of things and courts would end up sorting out and (hopefully striking down) any laws that went so far as to allow the classification of a business as a religious organization if that business “normally” makes its goods and services available to the public.

            To answer your question, it’s hard to say, but I expect we won’t see something radical that passes legal muster coming out of the administration in the way of an EO related to this question. Congress could try something, but I think they are going to stay away from stirring up a hornets nest in the form of something contentious related to religion.

    If I remember correctly, this EO, as with most EOs, would only affect federal agencies and contractors that work w/ the federal gov’t. Would the ACLU/Lamda even have standing? Or would they have to wait to represent someone affected by the actual EO?

      Laws (EOs count) can be challenged ‘on their face’ or ‘as applied’ but in either case, you need someone harmed or likely to be harmed by the law to be the plaintiff. EOs really only apply to the fedgov as you note so any national level overruling of State law would be a basis to overturn or block the EO in the courts. So far, the courts have been hostile to Trump’s EOs and haven’t been bamboozled by the attempts to end run that limit.

      I worry about the courts. I read a history of Nazi Germany which said one of their first objectives was to subvert the courts. There was a quote from a German judge where he said he knew that giving in to the Nazis was moral cowardice, and he despised himself for it. But he went along.

      Trump of course does not have an SS to terrorize jurists with. But he has the power of appointment, and I dread to see how he will use it.

        A plaintiff-advocate, say ACLU or Lambda Legal, might be able to get legal standing, and plead for relief to prevent irreparable damage or injury. Both standing and this kind of anticipatory injunction are well-trodden paths, just as the order against Donald’s immigration ban was prior to. Typical language:

        That there is a substantial likelihood of success on the merits of the case,
        That they face a substantial threat of irreparable damage or injury if the injunction is not granted,
        The threat is immediate,
        That the balance of harms weighs in favor of the party seeking the preliminary injunction,
        There is no other available remedy,
        That the grant of an injunction would serve the public interest.

Wouldn’t there be a direct conflict (the EO) with the rulings in those cases? I’m not a lawyer but would think the the governors in both those states could file for an immediate stay (or injunction) until those court cases can go up to a higher court??

            They might, depends tho’ on what the case law is at that Federal level, if there’s something in the Circuit rulings or, better yet, SCOTUS case law. The EO might contravene several different areas of Constitutional law.

        That second part might be all that is needed. The Muslim ban got into court the first time because people were being seized at airports. The sanctuary city EO went to court when cities sued.

    … It also, by extending some of its protections to one particular set of religious beliefs, would risk violating the Establishment Clause of the First Amendment to the Constitution.

    So it’s not about religious freedom but about advancing one particular sectarian view above all others, so other religious organizations that believe differently may get nothing.

    The “Lemon test” (Lemon v. Kurtzman, 403 U.S. 602 (1971), says that a law or order must have a secular purpose, and must not advance or inhibit religion, and must not entangle government with religion. So, kids, take a look. It has a religious purpose, touts one narrow religious belief regarding who’s screwing whom, and affects government contractors, among other things, and may require some kind of interaction with such businesses as well.

      Well, IF this happens, then there are two courses of action:
      1.) Be vocal in calling out Religion as a whole for allowing this to happen. Many will say “We’re not all like that.” But then they were silent as this occurred, and they also still commune with the haters,…so…, they are complicit by their silence.
      This same rationale applies to the Republican Party. Neither of the two groups comprehend the U.S. Constitution.

      2.) When a Religious zealot throws a gay out of their place of business, then sue them.

      This likely/eminent order from the Commander in Orange is troubling, but we cannot control him. We can only respond, and with Him (and his Religious contingent) forcing this issue, they likewise force us to respond, and to get the issue into the courts – courts that appear to be ruling increasingly in our favor.
