Former Obama Advisor Blasts Trump: Presidents Can’t Order Wiretaps, This Protects Us From People Like You

The Hill reports:

A former policy adviser to President Obama is firing back at President Trump’s claim that Obama wiretapped Trump Tower, saying it didn’t happen — at least not under Obama’s orders.

“No President can order a wiretap. Those restrictions were put in place to protect citizens from people like you,” Ben Rhodes tweeted Saturday morning. He also said “only a liar” could make the case, as Trump suggested, that Obama wire tapped Trump Tower ahead of the election.

It was not immediately clear whether Trump had any proof or was referencing a report. Breitbart News on Friday reported on conservative radio host Mark Levin’s claim that Obama executed a “silent coup” of Trump via “police state” tactics. White House chief strategist Stephen Bannon was the executive chair of Breitbart before joining Trump’s team.

Observers have noted the president’s tendency to tweet things — including a 2003 photo tweeted Friday of Sen. Chuck Schumer (D-N.Y.) with Russian President Vladimir Putin — shortly after they were published on pro-Trump blogs like Gateway Pundit or conservative websites like Drudge Report.

    Trump may or may not purposely be heading for a lawsuit. I know he’s doing this to deflect from his own personal disaster, but defamation is something that Obama is free to deal with now so I would not fuck with the man who has time, money, and law degree to handle it.

    1. There are rumors (or facts?) that FBI had knowledge about the Russian connection before the election. It would be natural for CIA or FBI or whatever to wiretap under such circumstances. My guess is that it was FBI and there’s at least one Russian mole there, controlling the data and helping the Russians manipulate the Puppet.

    2. Regardless of #1, this is deflection from the Puppet. He was supposed to have this big, presidential moment after his speech but then Sessions ruined it. Also I think maybe it’s an attempt at damage control for what he KNOWS will come out next week. Or tomorrow. There’s definitely more coming.

  • I just searched for answer to the question “process for ordering a federal wiretap”:
    “To get a wiretap on a phone, the Department of Justice has to file a request with a federal judge in order to have a wiretap. The judge has to approve the request before a wiretap can happen. (And, again, this is for law enforcement/Department of Justice – for NSA/CIA stuff the rules, if there are rules, are different).
    In the request for a wiretap, the prosecutor has to describe who is going to be wiretapped and the details of the tap. He or she also has to describe “whether or not other investigative procedures have been tried and failed or why they reasonably appear to be unlikely to succeed if tried or to be too dangerous.” The judge then has to find that other ways of getting the information from the wiretap would be too dangerous. .”
    —So the Department of Justice- hence, Loretta Lynch et al, were the ones that had to order this. Is this correct? Could the FBI order one on their own, and could the CIA order one on their own?

  • Update: Apparently, there is something called the FISA ( Foreign Intelligence Surveillance Court (FISC, also called the FISA Court) which was established back in 1978 and is quite secret. Warrants were supposedly granted to the FBI to wiretap Trump’s phones for Russian banking ties back in October and perhaps much earlier.     • Yes, this is true. And it is also true that only independent law enforcement organizations like the FBI, CIA, and NSA can file requests for warrants. However, none of those organizations or any other can order a wiretap be done on the President’s orders. They *can* ask for authorization for a wiretap based on a probable cause filing with the FISA court, which has to be in the course of an active ongoing investigation.

      To be clear, if President Obama had said, “I want a wiretap on Trump” — the only legal response from the FBI, CIA, etc. would be, “No Mr. President, you don’t have the authority to order or even ask for that.”

The movements of the Russian jet need to be explained to the public. Whatever information the NSA and other intelligence services have on that plane should be released to the media. Why, in this one administration, are there so many people who, as members of Donald’s campaign, spoke with reps of the Russian government and then routinely denied doing so? The truth has only been revealed because of the monitoring of the Russian Ambassador’s phone and other evidence revealed through FBI investigation. The Ruskie ambassador was clearly the go-to guy to what – exchange greetings and recipes? Not in the real world! They needed to discuss and provide assurances that the Obama sanctions, etc, would be corrected and other assorted things that Trump would take care of to institute a nicey-nicey setup with the Russian government.

        • Hard to say for sure. Donald doesn’t like to be undercut or contradicted. Sessions’ recusal came just hours after Donald said he didn’t see any reason for him to do so. He also does not like any sign of public capitulation. You could be right though — given Donald’s complete ignorance of the gov’t or the actual powers of the Executive branch, he probably thought Sessions had the means and authority to quash any possible investigations.

          Word is Sessions is heading to Florida today, all of a sudden. My guess is Donald is going to demand he un-recuse himself and look into the reports (via Breitbart no less…ugh) that Trump Tower was bugged last year.

And the Trumpites don’t give a damn, they just want to keep on with their purge of Muslims and Hispanics which edges closer every day to the opening of mass concentration camps. (Not going to get into the religious vs fiscal vs ideological conservatism divide, but that exists, too.)

            Their problem is take away any one of those groups and what remains is a minority party. But growing numbers of the other two, especially the mainline GOP, are realizing the Trump situation is not sustainable.

            I do think the Dems have to push certain things harder though. A big issue that could have really excited voters would be if the Dems went after Big Pharma.     ttRump’s accusations are potentially the most damaging thing he has ever done to himself. His accusation of President Obama must be answered. If Obama acted illegally by ordering wiretaps without the court order, then Obama must be prosecuted. I cannot tell you how highly unlikely that scenario is to me.

    That leaves two alternatives: tRump lied, and there was no bugging of his campaign by Obama. OR, there was a court ordered bugging, which will now come to light. And I think the last option is far and away the most likely. And the fucking idiot opened that Panora’s box. All his sins and indiscretions will now come pouring out because of his big, fucking stupid mouth.

    • Trump began tweeting his crazy-ass shit at the crack of dawn, which is when he reads his daily dose of wingnut news. There was a story on Breitbart alleging Obama had ordered the entire Trump Tower to be wiretapped (ludicrous on both counts — the Prez cannot order that to be done and no way would a court permit an entire building to be surveilled in that way).

      There were other tweets on unrelated topics before and after that, again suggesting Donald was reacting in real-time to shit he was reading before most of his staff was even awake yet.

      The one time when Cheeto Hitler is most likely to be in possession of his phone and out of reach of any moderating influences is on the weekends, when he’s taking yet another Florida vaycay.

    The far right is the most vociferous about big government coming to take away their freedoms. Yet they seem to be very ill informed about the checks and balances and protections of those freedoms that are built into the system. They also seem to be remarkably docile when government actually DOES attack their freedom, and knuckle under like dogs to curfews, searches of private property without warrant, people being asked to produce their papers, etc.

If you subscribe to the theory that the tweeting is strategic, creating distractions for the media to focus on, etc., then maybe the answer is that Bannon or someone at Breitbart is in charge of writing them and sending them out at strategic times.

    Next point: assuming that the Trump administration engages in strategic tweeting, it would seem logical that Trump is again creating a distraction so that this is what you’ll remember from the weekend, not the proposed budget cuts to EPA, NOAA, the IRS, etc. which are intended not to save money (since the Pentagon budget is to be increased) but to undermine EPA’s rulemaking to protect the environment, NOAA’s research on climate change, IRS’s ability to collect taxes, especially from the wealthy individuals and corporations that owe the most money. In other words Trump is not crazy, he’s just completely amoral, tells lies, etc., uses social media to create fear and loathing among the populace.

          Let me spin a theory here, keeping in mind it’s just a theory. It comes in a few parts.
          – Okay, we know Donald is a bigot, xenophobe, etc. So he’s comfortable with the idea of his Muslim ban, but honestly doesn’t care about the details at all.
          – Bannon though, he’s an out and out fascist nationalist. He may well be the one writing up the orders to ICE and CPB telling them to be as vicious, cruel, and brutal as possible. He gets Donald to sign off on it by assuring him it’s necessary. “Only bad hombres,” right? (Basically, if Bannon remains the power-behind-the-throne, it means we would probably see concentration camps and secret mass executions eventually.)
          – Bannon and others have been controlling what Donald hears and sees. Not entirely — after all, CNN seems to be on all the WH TVs now — but certainly the major stuff. So maybe Donald doesn’t actually see what’s being done in his name, not all of it.
          – As Donald becomes more and more hated, paradoxically he becomes even easier to control because all it takes is a few positive stories and it’s enough to feed his starving narcissistic ego. “Here you go, Mr. President. Breitbart still loves you. Here’s some article clippings for you to read.”

          In essence, we see Donald’s reactions through the prism of what Bannon, Miller, and the other evil bastards have let him see.

          Your mentioning of how narcissistic and insecure he is would also explain why he’d see anything negative from Obama as a huge and intolerable betrayal. Because Obama had been police and nice towards him during the transition. So criticism now or any hint that Obama worked behind the scenes to ensure the Trump/Russia intelligence was preserved…well, again, betrayal. And his ego can’t handle that.

          Anyway, you’ve given me a lot to think about.

        I see your point, but in DTs case I would argue that one needs to use the anti-bully method. The only way to stop a bully is to hurt it. Either through shame (assuming the bully has any sense of honor at all) or in the case of the bully who pushes, hit back even harder. If the bully attacks with mendacity and viciousness, one responds with some response which will really shut him up. Silence won’t do it with a person of DT’s ilk.
