ARKANSAS: State Supreme Court Strikes Down LGBT Rights Law Opposed By Famous Christian Child Molester

The local LGBT ordinance battled by former Family Research Council leader and incestuous child molester Josh Duggar has been struck down. Arkansas Online reports:

The Arkansas Supreme Court on Thursday struck down a city’s ordinance banning discrimination based on a person’s sexual orientation or gender identity, but it stopped short of saying whether a state law aimed at prohibiting such local LGBT protections is constitutional.

The justices reversed a judge’s decision that Fayetteville’s anti-discrimination ordinance didn’t violate a state law prohibiting cities from enacting protections not covered by state law. Fayetteville, a liberal enclave in northwestern Arkansas, is one of several cities that approved local protections for lesbian, gay, bisexual and transgender people in response to the 2015 law.

Arkansas’ civil rights law doesn’t cover sexual orientation or gender identity. In the unanimous ruling, justices rejected the argument that Fayetteville and other cities that have enacted such ordinances have made that the protections are covered elsewhere in state law.

      For the average person in the south, so-called “justice”is pretty much a matter of “heads, … the bigots win, … and tails … you the victim lose”.

      Of course human rights should never be decided by votes, but now with Trump having all the levers of power, it IS votes, (even though the GOP vastly lost the popular vote in the vastly rigged and gerrymandered system) .. it is GOP votes of manipulated courts and legislatures , votes that are taking the rights of minorities away while Fear and Loathing stalk the land, a land that was until the last three months so optimistic and hopeful.

      We can only weep for what was and could have been, and perhaps now will never be.

      I think you misunderstand. No city in AR can pass an anti-discrimination law now.

      Unless they appeal to the federal courts, which is not a good idea right now, at least not without national coordination. This is Romer v. Evans II but they’ve gotten a lot smarter now.

  • this is the one problem with local protections in states that are not supportive, the local law goes farther then the state law and then gets rolled back. Just an example of how there needs to be protections at the state level.

    I do have a handful of relatives born in Arkansas (who now live in California) who earnestly hope to see executions of gays and Muslims. And yes, they are Republican Trump-supporters who claim to be born-again Christians with a god to back them up.

    My father and my brother are among them and have boasted that they would pull the trigger themselves. They do not live in the hills somewhere; they live only 40 minutes from the heart of Los Angeles.

    Most of my relatives aren’t that extreme. They’re “nicer” Republican Christians; their just pressing for discrimination laws to be overturned and for penalties for gaybashing to be lifted. They believe that public shaming and beatings without accountability will restore morality for their “Christian nation” by denying non-heterosexuals any services, including medical services. They have been convinced by their leaders that they can force all non-heterosexuals into extinction.

    You are all correct, that fear of America’s version of “The Final Solution” is not a far-fetched notion. Not at all.

    I live a short distance from Fayetteville, AR and try very hard not to do business with Christers, hard to accomplish in the south. Yesterday I decided it was time to have the septic tank pumped, so I went on-line and found a local place that gave no indication of any problem on their web page. The guy showed up this morning and of course was a hunk with a very lickable face. When I paid him, he hands me a receipt with one of those jeebus fish on the bottom of it. I decided not to demand my shit be returned, but I did think about it. Hunk or not, I will not be calling them in the future.

    I wish we had a nationwide registry to consult before choosing stores or services. I do not enjoy supporting the enemy, and any business promoting their religion on their advertising or receipts is the enemy.

      Though honestly, I didn’t do the hiring anyway, but the last septic tank cleaners I had dealings with had a Jesus fish or two there, and were actually perfectly nice. *Crazy,* but not in a scary or threatening or even proselytizing way.

      I usually avoid doing business when I see those fish or Bible quotes or a bunch of crosses somewhere, (Especially in the automotive business, the amount of Christianist display is usually inversely proportional to their honesty and competence, actually: not only is there the usual expectation of that meaning I can’t expect to be treated well, that’s a sure sign someone’s trying to ‘borrow’ some credibility/morality/authority over others of their flock.     Mr Duggar, along with most of those who share his beliefs, mistake those who settled along the Atlantic shores (in the main, religious fanatics whom their own countrymen in Europe couldn’t stomach) with the men and women of the enlightenment who forged the country known as the United States of America. These patriotic people who met in Philadelphia in 1787 envisioned a democracy wherein religion and religious ideology had no place at the table of governance. Along with a system of checks upon the overreach of its differing branches, one being a court system empowered to nullify actions found to be in conflict with our Constitution.

    Mr Duggar and his ilk, are among the most unpatriotic americans we have ever produced. They seek to rewrite not only our history, but our Constitution to suit their dogmatic agenda.

    So again, fuck you very much Mr Duggar.

    It really burns me that my state (Tennessee) along with Arkansas and North Carolina are the only three states with a law prohibiting cities and counties from passing ERO’s. North Carolina got backlash, but Tennessee has skated by with hardly a peep. Nashville in particular should be boycotted big-time until Tennessee gets rid of their vile law. There’s not much leverage with Arkansas unfortunately.
