BREAKING: Trump Rescinds Transgender Student Rights

The New York Times reports:

President Trump rescinded protections for transgender students that had allowed them to use bathrooms of their gender identity, overruling his own education secretary and placing his administration firmly in the middle of the culture wars that many Republicans have tried to leave behind. In a joint letter, the top civil rights officials from the Justice Department and the Department of Education rejected the Obama administration’s position that nondiscrimination laws require schools to allow transgender students to use the bathrooms of their choice.

That directive, they said, was improperly and arbitrarily devised, “without due regard for the primary role of the states and local school districts in establishing educational policy.” Ms. DeVos’s unease with the situation was evident in the strongly worded statement she released Wednesday night that said she considered it a “moral obligation” for every school in America to protect all students from discrimination, bullying and harassment.

She said she had directed the Education Department’s Office for Civil Rights to investigate all such claims “against those who are most vulnerable in our schools” but also insisted that bathroom access was not a federal matter. “This is an issue best solved at the state and local level,” Ms. DeVos said. “Schools, communities, and families can find – and in many cases have found – solutions that protect all students.”

Lambda Legal reacts:

The U.S. Department of Education today rescinded the Obama administration’s 2016 Title IX guidance clarifying the rights of transgender students. Rachel B. Tiven, CEO of Lambda Legal, the nation’s oldest and largest LGBT legal organization, released the following statement:

“We all know that Donald Trump is a bully, but his attack on transgender children today is a new low. The U.S. Department of Education’s decision to withdraw guidance clarifying the rights of transgender students endangers the well-being and safety of children across the country.

“Trump’s actions do not change the law itself—transgender students remain protected by Title IX of the Education Amendments of 1972—but abandoning the guidance intentionally creates confusion about what federal law requires. The law bars discrimination – the new administration invites it.

“Betsy DeVos became Education Secretary just one week ago. At her brief confirmation hearing she publicly committed to protecting LGBT students – this harms them.

“Over the past week Donald Trump has attacked perhaps the two most vulnerable groups of children in America: transgender children and refugee children. While his Education Secretary was busy withdrawing protective guidance for trans kids, his Homeland Security Secretary signed memos that strip legal protections from children who arrive alone at our borders, seeking refuge.

“Now Attorney General Jeff Sessions and Secretary DeVos give us sickening echoes of the racially segregated schools era by claiming that enforcement of this federal civil rights law is a ‘states’ rights issue.’ This is not just a bizarre misunderstanding. We recognize that language.  This is a cynical rejection of the federal government’s responsibility to enforce federal law protections for vulnerable students.

“While the Trump/Pence administration wages its War on Children, Lambda Legal will redouble our efforts to protect transgender and other vulnerable kids. At Lambda Legal, we are already in court fighting for transgender students, and we are prepared to sue any school district that discriminates in the wake of the Trump administration’s actions today.”

PFLAG reacts:

“PFLAG hearts everywhere are with the worried parents who will be kept awake tonight, and the kids who will be scared to go to school in the morning.  Tomorrow we will fight even harder for the protections that Title IX still affords all transgender youth across the country.”

GLSEN reacts:

“Supports for transgender students in K-12 schools change and save lives, and hurt no one. President Trump’s reversal of federal guidance affirming Title IX protections in schools undermines the settled expectations and protections afforded by federal law, hurts transgender students and impedes the progress we have made creating safer and more inclusive learning environments for all.

“While the Trump administration may abandon transgender students, GLSEN won’t. And neither will the thousands of teachers, administrators and parents around the country who work with GLSEN and our local Chapters to ensure that transgender students everywhere have the opportunity to simply be themselves and live better lives. Schools, leaders and teachers must do the right thing and give all students the chance in life they deserve.

“Research has consistently shown that transgender students are more likely to face severe violence and discrimination at school than their peers, and at greatly increased risk of suicide and self-harm as a result. GLSEN’s National School Climate Survey has shown that 76 percent of transgender students felt unsafe at school simply because of their gender. We also know that transgender students who are allowed simply to be themselves at school are as healthy and happy and successful as their peers. Rescinding guidance designed to help schools help them makes zero sense.

“The administration’s actions today do not and cannot change the well-established legal foundations upon which the federal Title IX guidance is based. Many federal courts have already determined that Title IX’s prohibition on sex discrimination and the Constitution’s guarantee of equal protection extend to transgender individuals. Fairly applied, the law remains on our side.”

The SPLC reacts:

“The Trump administration today showed a few more of its true colors, and they are decidedly not the colors of the rainbow. By rescinding federal guidance from the Departments of Justice and Education that helped to ensure equal educational opportunities for transgender students, the administration has contributed to the baseless hysteria and panic that puts so many vulnerable transgender youth at risk.

“But we don’t need Jeff Sessions or Betsy DeVos to tell us whether these young people deserve protection. We know that they deserve protection, as well as equality and respect, and we know that Title IX and the U.S. Constitution demand it. We will continue to fight for transgender students in classrooms and school board meetings and courtrooms throughout the country, and we will prevail.”

They are about making sure transgender people cannot be further than roughly a mile and a half from a safe bathroom – which, should these laws be enacted, translates to a mile and a half from their own homes, which removes them from public life.

        Have you seen DeVoss’s plans for our student’s education? Or the bill that was submitted? Essentially her job will consist of nothing but a once a year signing the form for each state granting them the funds determined by congress for education. However, to get that funding states must agree to use it to provide vouchers for parents to use toward their child attending public, private or religious schools.

      Here, the Administration of course was going to rescind these rights — their base all but demanded it. So there was never a question of “debate” or “due consideration.” And with Bannon and Miller in charge, you knew how this was going to come out.

      So they made up this story about DeVos being “uncomfortable” and implying (but not stating) that she fought this action. It makes her look good to all those people who were protesting her. Maybe she isn’t the wicked witch after all! Maybe she really does have the interests of students at heart!

      It makes Sessions look good, because his base is the anti-gay crowd. So he stands tall and tough against those evil transgendered students who all sexually assault everyone when ever they go to pee. More power to him!

      It makes Trump look good — like he reasonably listened to both sides and the, like a decisive leader he really is — come down on the side of state’s rights! And power to the people! See, this is how a real leader leads! And he’s just the best leader ever!

      Always be suspicious of stories that make everyone look good to the people they need to look good to. And this one doesn’t even pass the smell test.

Now we watch as the Trump Administration deliberately endangers the life of LGBTQ youth.

    As a gay, Jewish American, I am far more fearful of my government than I am of Muslims Americans.

        My ex was a transman who began transitioning in high school, and since no policy existed and it was just plain too simple to let him go to the boy’s room, he had to use the faculty bathroom. That may sound like an okay solution, but it was on another floor and across the building from where most of his classes were, and some of the hormones made him have to go more often. Plus, anything that makes you at all “other” in high school can feel like a BIG deal. We don’t need anything, however small, to push any LGBT kids over the edge to do something that they can’t take back.

      The detained thug and the bum-rushing bum were arrested. The off-duty cop was not. Both Anaheim PD and LAPD are investigating. The cop will probably get off with no arrest or disciplinary action. Why? Because he did the right thing.

    Remember that recent article about how gay marriage becoming legalized decreased the suicide rate among gay youth?

    Welp, this is going to crank up the trans suicide rate among teens and that was already appallingly high (like 50% high). And it’s going to normalize a type of admin lead harassment of trans kids and a direct signal to the bullies.

    I work as a teacher. I have 8 trans kids at my school. It’s already hard enough to try and protect them all. This is going to make that task even harder.

        That’ll be about the rate of suicide attempts, loud or not, reported later by those who *didn’t* get treatment or support in school, ie, almost all till fairly recently. Trans kids who get treatment and support have just about a baseline suicide rate, even considering there’s still extra stress.

    Michael Moore lists 10 things to do ranging from calling Congress daily to something that REALLY caught my eye:

    “I realize most of you can’t do this ― but there is one office every one of us can and SHOULD run for next year: PRECINCT DELEGATE.Every precinct, every neighborhood can elect x-number of Dems to the county Democratic Convention. It’s on the ballot and it’s usually blank -no one runs for it. So the precinct delegates end up being appointed by the party hacks. And that’s who ends up eventually at the national convention to pick the next presidential candidate. So this is an important position to run for. The time commitment is just 3 hours a year! You attend the county convention ― that’s it. Call your city or county clerk and find out how to get on the ballot. If you’ll do it, I’ll do it. It’s the first step to making sure we put a candidate on the ballot who can win.”

    I know a lot of people here who are pissed at the general state of the Dems. I think it’s the right position for someone who doesn’t have a lot of time, doesn’t have a lot of money yet wants a hand in the direction of the party.

      • it’s not hard. but you do feel compelled to go to some meetings and do other stuff, so i wouldn’t say 3hrs a year is really a good description.

          Hi. Yeah, I figure it’d be more than 3 hours a year. But fortunately, being retired, I’ve got spare time. And since the county is just this 12 mile long, 4 mile wide island, it should be easy to get to the county convention, and if it involves some district work, I’ve recently enrolled in this district’s local dem party. It’s ’bout time I got something compelling in my life. Things get ‘routiney’ ya’ know?

          • i’ve done time with the partee in three four states. it annoyed me, mostly. i won’t bore you with all the reasons why. but Moore is not wrong; it would only take a handful of “us” to take over the party. i guess now would be a good time.

            you have to forgive me, for being burned out on it and not joining you right now. bring your piss and vinegar, you’re going to need them.

    The scary thing about Trump , which we knew before he was elected , is that he has no conscience or empathy , he’s guided by his will and it can change any time he believes it benefits him to do so . He will never be sane or stable , which leaves us responsible to hold him responsible for his actions
