Senate Approves GOP Bill Legalizing Gun Ownership By Severely Mentally Ill, White House Says Trump Will Sign

The Associated Press reports:

Congress on Wednesday sent President Donald Trump legislation blocking an Obama-era rule designed to keep guns out of the hands of certain mentally disabled people. On a vote of 57-43, the Senate backed the resolution, just one of several early steps by the Republican-led Congress to undo regulations implemented by former President Barack Obama. The House had passed the measure earlier this year. The White House has signaled Trump will sign the legislation.

The Obama rule would have prevented an estimated 75,000 people with mental disorders from being able to purchase a firearm. It was crafted as part of Obama’s efforts to strengthen the federal background check system in the wake of the 2012 massacre of 20 young students and six staff at Sandy Hook Elementary School in Newtown, Connecticut.

Adam Lanza, a 20-year-old man with a variety of impairments, including Asperger’s syndrome and obsessive-compulsive disorder, shot and killed his mother at their home, then went to school where he killed the students, adults and himself. He used his mother’s guns in the attack.

The Senate version of the bill was spearheaded by Chuck Grassley.

      “The House voted 235-180 to roll back a rule that required the Social Security Administration to report people who receive disability benefits and have a mental health condition to the FBI’s background check system. The database is used to determine eligibility for buying a firearm.

      Critics said the rule stripped Second Amendment rights from people who are not dangerously mentally ill, such as those who have eating disorders or mental disorders that prevent them from managing their own finances.”

      Social Security disability benefits pay crap and many people on disability live in not-so-good neighborhoods and may need a gun for protection.

      Statistic show that people with mental illness are more likely to be the victim of a violent crime than to commit one. This Obama-era rule was discriminatory and perpetuated the stereotype that people with mental illness are inherently dangerous.

      The vast majority of gun violence in this country is committed by persons with no mental illness. In my city, the vast majority of homicides are committed by Black men with guns. Should all Black men in my city be barred from owning guns? Of course not. But that’s the logic that Obama’s rule relied upon and I’m glad it got voted down.

        that prevent them from managing their own finances. This would only limit gun sales to people who do not have access to their own SSI direct deposit bank accounts.

        BTW, what city do you live in? Because, if it’s not Detroit, it’s highly unlikely that the vast majority of homicides are committed by black men with guns. The majority of homicides in all US regions is between people who know each other (often claiming to love each other), so, unless the vast majority of your city is Black . . .

            Which, in 2016, according the the Baltimore Sun had 318 killings (not separating murders from man-slaughter from accidents). The police provided uniform crime reports for only 137 murders last year. One of the major reasons for that discrepancy is that most (like 75%) of the killings in Baltimore last year have no publicly known suspect, let alone convict.

            With 63% of Baltimore being black, and most murders being committed by men (and with guns), it might be a safe assumption that 63% of the murders in Baltimore are conducted by black men with guns, the actual data from last year (based on solved cases) is only about 10%, because the vast majority, is simply unknown.

And how many of them are presumed to be dead because of the violence inherent in the drug trade? And who runs the drug trade in Baltimore?

      Not re tipping, and with respect, if the Obama Administration had completed the process and issued the regulations earlier, the period for Congressional Review, under which the Congress and President Trump can now block the regulations, would have expired before the Inauguration.

      Unfortunately, as we all know, the Republicans are now in charge of our country. At least a significant proportion of newly empowered Second Amendment activists live in red states and Congressional districts.

      This law they’re using to overturn Obama’s EO’s, BTW, also blocks all other EO’s, in perpetuity, on the subject– only way to change it after this will be by legislation.

    There should have been research done. For example: Bring a set of junior kindergarten kids before the Republicans. If necessary explain the word “insane” or simply sad “mad people.” Have Paul Ryan act like a mad man (not hard to do) with a gun in his hand. Tell the kids, this is a mad man with a gun. Ask the kids should this mad man have a gun? Have the camera focus on the kids’ disbelieving faces and words of “No way!” Then focus on the rest of the mad Republicans. Get feed back from parents whose kids are having nightmares and won’t get out of bed! This is insanity. They should take these Republicans into an insane asylum – give guns to the inmates – and shut the doors!

            Our Tortie girl cat, Rapunzel, loves me and will tolerate exactly one of the three boy cats (Duncan, in the foreground in the above pic). Indeed, I often catch them pressed up against each other, but she doesn’t like it when I see them together.

            It’s kind of impossible, though, not to love Duncan. Even the most rabid of cat-haters ends up liking him. He sort of oozes his way next to you ever so slowly that you don’t even realize that he’s there until it’s too late, at which point, he will unleash an utterly devastating, heart-melting series of deep, sultry rumble-purrs in your ear while head-butting you.

            I don’t doubt for a second that your grrlkitty let that dog know who’s boss :-), and that she would probably do a better job protecting the household than your doggie!

        Considering these are people without access to their own SSI direct deposit bank accounts, someone should also track whoever DOES have access to those funds, but then, the GOP has disallowed this to be tracked as a public health issue.

        BTW, the Review Act doesn’t allow the Dems to add an amendment to re-write regulation. These anti-EO bills simply strip out the new regulation (and prohibit an EO on it, EVER again).

      There are homeless mentally ill people who keep knives and guns in order to protect themselves from street thugs. What often happens, though, is that someone complains to the cops there is a crazy person waving a knife or gun around in public, and when the cops confront them, they generally shoot and kill the armed mentally ill persons.

    Our 90 yo uncle wanted us to bring his gun to the hospital so he could kill himself. We refused. The rest of the family including his kids are all gun toting republicans and paid it no mind. 3 weeks later he was doing very well, and at a party he blew his brains out right in front of everyone. I was sitting right next to him and the bullet missed be by about a foot. His wife and kids had just given him his guns back. It was a horrible experience and 4 years later still can’t look at a hand gun without having flashbacks. This bill is a huge mistake!

I gotta admit, though, listening to some of her purely insane blabber was always a source of wonderment, awe and entertainment. When she dropped out of high school her sophomore year, she severely crippled her and her future children and grandchild’s lives. But she is a warrior for the Lord, and a mighty fine evangelical republican.

      Poor thing. I went to the grocery store and had to decide on which items I could and could not afford. I limped around on a damaged knee that I have to live with because I don’t have any health insurance. After I got done shopping, I loaded up my 17 year old truck and drove home to my 65 year old house in the burbs. I had to get back in time to give my 82 year old mother her lunch. She’s been housebound for over a year now. We can’t afford to put her anywhere or have someone come in to help. She secretly cancelled her BCBS behind my back because she felt she couldn’t afford it. She has to rely on Medicaid in the state of Alabama if she has a problem. So fuck Melania Trump.

        The organization is being rather good at supporting and fighting for the Bears Ears National Monument, keeping ATV fanatics off of wilderness trails and away from historic indian ruins. A lot of the same prairie fairies I’ve known for years show up to the meetings. But what has been very helpful is having a professional political organizer come in and train us on how to be effective dealing with politicians.

            I don’t remember an octavio. But he sound’s like my kind of bleeding heart. A friend from Salt Lake turned me on to JMG about a month or so. He used to show up constantly in these comment sections posting as “Ewetaw.” But he hasn’t appeared in several weeks since he took off to try living in Mexico. Old cars is probably the biggest thing I have in common with most of my Friends. “Ewetaw” is a member of the same car club as me. He’s not a close friend, primarily because he’s wrapped up in his Mormon heritage. That stuff gets old, fast. But he’s a pleasant enough guy.

            Regarding immigration strikes today, some restaurants in Moab, which is in Grand County just north of where I live, have put out notices to their employees regarding churches family members can find sanctuary. A few restaurants have closed for the day. But it’s not tourist season, so Moab is sort of dead right now. We met with our council here in San Juan County, letting them know we supported providing sanctuary for Dreamers and others threatened by prosecution. There are more Native American in San Juan County than there are white people. In the last few years they’ve started listening to us. It wasn’t always that way. Volunteers from the Navajo Nation have started an underground railway to help immigrants find sanctuary on their reservation. That is one of the things that may blow up blow up with the Feds down here. It’s a constant struggle with the BIA to respect the equality of all people in this part of the world.

            Other than that, life is pretty damn good. A bunch of us old gay guard have retired to here and try to keep things lively. We’ve infiltrated the Realty market and have our claws in many small businesses that support the tax base. It’s the old Mormon families that are the biggest problem for everyone. If Mormons can’t build a McDonalds under Delicate Arch in Arches National Park they scream that their ancestral rights are being denied. They totally disregard that the Goshute, Paiute, Navajo and other Native Americans that have deeper roots and a greater connection to the land. Just another example of white Jesus trumping everything else.

            Funny, when ‘Dreamers’ are mentioned, I often think, well, aren’t we all? Husband and I are both first generation dreamers. On our fathers’ side. He’s the son of Joe, over from Ireland, on the lam. Became a NYC fireman. Like father like son. A hero. My dad, Jesus, from Sonora, Mexico, his family got out of the way of the revolution in 1911 into Phelps Dodge copper mine, Bisbee, Az. Met my mom, moved to the east bay area to work the shipyards, later he was a gardener. So today we’ve taken to heart. One high end bakery is closed. We’ll now support it, even if it is a bit dear. Spend it while we have it. The people working the farmers’ market, all immigrants, farm workers with the farmers that come down from upstate twice a week, all had “REFUGEES WELCOME HERE” buttons on. A lot of them from Nepal, Tibet, Northern India and Burma. Sweet people.

            My only claim to a vintage vehicle was a ’95 VW combi. During a six year gig in Mérida, Yuc. 2006 = 2012, it was my get about car. Damn fun and in primo condition. I was often asked to sell it. Now, most of everything is within walking distance, if not, NYC/MTA can make the day or ruin it, depending on what’s happening to the system. I never, ever, said “THANKS OBAMA” in sarcasm. I always said: “THANKS MTA!”

            Good ‘chatting’ with you and glad you’re with us. IF you know of anyone needing refuge passing thru NY/NJ/CT area, give me a comment. We’re of like minds and have two studio apartments, side by side, top floor, five floor walk up. Nobody comes up here unless invited. Can help a pair if in need.

            Thank you for your background info. I’m an old bleeding heart from way back. I was born in Los Angeles to two of the whitest people in the known universe. Both parents worked in air craft assembly plants in Long Beach during the war. I loved growing up in Long Beach, until I didn’t.

            I was a VISTA volunteer in 1965-1967 – your typical long-haired hippie conscientious objector doing “alternative service” instead of dying in Vietnam. My type was so hated that they did everything to make my life unbearable. I was assigned as the secretarial support to the head of the Bureau of Indian Affairs office in Blanding, Utah. They considered such an assignment to be the worst possible punishment for not volunteering to kill Vietnamese. My old boss, a retired Army officer, was incredibly sexist and cruel, doing anything he could do or say to try and break me. That’s when I became ashamed of being white, working with so many Native Americans who were more ignored than Republicans try to ignore Democrats.

            Thank for the kind words. The thing about being treated like shit during my VISTA years is everyone thought that sending me out to the middle no where in the Four Corners area would be a totally miserable experience. But as is typical with stupid angry people, my banishment to Blanding in the mid60s was like being condemned to live and work in Paradise. Southern Utah/Colorado is truly remarkable. The instant I was able to move back here in 2000 I did it in a heart beat. And San Juan County is not nearly as trendy as surrounding counties, so finding a chunk of farm property with an old pioneer home on it wasn’t too difficult. My ex finds this place too isolated. Even friends who live in Moab insist I’m too isolated from the rest of the world. But that doesn’t seem to stop them from showing up at odd hours and days of the week.

            Lately, I’ve been spending too much time surfing blogs and political sites like JMG. I really can’t afford the time, because to keep this place tidy and livable takes all the energy I can muster. Just having a coop full of laying hens is a ton of work. Amusingly, I’ve become a tourist destination for many of my friends. There’s plenty of room for two or three week stays. And the quality of life is so pleasant that it seems there’s always someone willing to stay for a short period in exchange for helping with chores. In the next ten years I will need to find a sturdy young man, maybe a fabulous gay potter with hair down his back, to live in and ensure I don’t break a hip. Georgia O’Keefe, whom I met in the early 1970s and forced to be my good friend, was always an inspiration to me. She had it figured out. Maybe I’ll have it figured out, too.

            Keep on doing what makes you happy. And don’t let the bastards get you down. There will always be bastards. Just learn to manage and herd them. That’s winning. 🙂

            AmTrak lumbers through on tracks about 40 miles north of Moab. What used to be the last passenger rail service in the USA that was not AmTrak was operated by the Rio Grand RR, ferrying people back and forth between Denver, Steamboat Springs, through the famous Rocky Mountain route to Grand Junction, Colorado, then across the Utah state line through the Book Cliffs to Price, Provo, ending in SLC. AmTrak bought that route in the early 1980s and, of course, ruined it. I live another 60+ miles south of Moab. I rarely drive to Moab. Instead, there is a scenic back route to Grand Junction on the east side of the La Sals of only 110 miles that is my usual escape to buy supplies and getting stuff done.The Rio Grand offered a bus service from a stop at the I-70 Junction to Moab, but I doubt AmTrak continues the tradition. If you’re going cross-country via the southern Colorado route to see the Rockies you’ll end up going from Grand Junction up to SlC and then Ogden where AmTrak changes motor equipment. Then the route continues across the Great Salt Lake (a rather interesting part of the ride) on to Oakland via northern Nevada. I’m curious about the crossing of the Great Salt Lake. It’s now run by AmTrak, which doesn’t care if you get to see the over water route or not. For expediency, they probably cross in the middle of the night when you can’t see anything.

            As for O’Keefe, she was a brilliant and caring human being. My long-time companion (long since dead companion) worked for the firm that represented O’Keefe, so that’s how I came to know her. She was fine up until the last two years of her life. Everyone thought she was a cranky bitch, a reputation she liked to cultivate, just so everyone would leave her alone. Juan Hamilton, her husband, is still a good friend. He took care of Georgia like no one else could. During the last three years of her life they had to move into Santa Fe where he could hire long-term nursing care. She had lost her sight many years before, but had a number of young assistants who helped her create other art besides paintings.

            For the last two years I have a younger “friend” who lives with me most of the time. He’s a nice enough guy and a good roll in the hay. We’re both a little hesitant to make a commitment. Which is fine with me. I’m just thinking ahead. My health is perfect. I look like I’m in my late 40s early 50s, but one long bout of influenza could change that rather quickly. Last year, two very good L.A. friends came to stay in my little guest cabin for a couple of weeks. One of them passed in his sleep without any warning. We still have no idea what caused his death. He just died. It happens. But it really shook me into getting all my my paperwork in order.

            I’m always whining that what I really need, what we both need, is a hunklicious alpha male gay Navajo to move in to keep us on our toes and who we can worship. Sadly, even though I know quite a few gay Native Americans, none of them fill my particular fetish for a rugged taciturn male. Maybe someday.. 😀

    I have such a storied history with Zuni Cafe in SF. Met a date there once. It didn’t go well. A former bosses brother worked there, sending us dishes from the kitchen. One of which was lambs tongue. The upsetting part was when the dish arrived what was on the plate looked like a cross section of a tongue. I took a pass…..yeah I have 2 other stories but I’ll save those.

    But, this is cool. Even if it exalts exploited labor, but then where do you eat in SF-Oak or anywhere where that isn’t the case.

      All of the issues she claims to care about are history due to SCOTUS and the lower courts.
      If Trump and Republicans get their act together, not only will Trump get to appoint a far right hack to SCOTUS but 114 other seats as well.
      And those judges will be more then happy to strike down any progressive victory we get while upholding bigoted conservative ones such as voter id laws, anti-LGBT laws etc.
      And Sarandon played her part by undermining Hillary and the Democrats every chance she got, to the point many folks no doubt stayed home.

    A few years ago when buying a shotgun I mentioned to the sales clerk that I needed a gun for protection from a crazy neighbor that had threatened me. She said she wished I hadn’t said that because state law prevents her from selling me a gun if there is any mention of it being used against someone. I said you’ve got to be kidding, to which she said no, I can’t sell you a gun today, but I am going to lunch in about 20 minutes and my replacement should be her soon. Wink, wink.

    There is not a single fundamental right enumerated in the Constitution that isn’t subject to some constraints in specific situations – including the freedom of the press, of free speech, of assembly, and of religion.

    While driving is not an enumerated civil right, we make commonsense requirements that people demonstrate that they can safely operate a vehicle before they are allowed to operate one.

    I’ve never seen any reason why someone shouldn’t similarly be required to demonstrate that they have the ability to safely operate a firearm before they’re allowed to own – or especially, to carry – one. And doing so wouldn’t materially affect someone’s right to own a gun. People who can’t use one safely are certainly not exercising any right that the Constitution intended to guarantee.

    And that’s without even addressing the pretty damn clear Constitutional provision that the whole point of the right to own a gun is so someone can participate in a well-organized militia. People with severe mental illnesses certainly aren’t a part of that idea. Or at least, one hopes.
