TENNESSEE: GOP Rep Intros Bill To Classify Children Born From Artificial Insemination As “Illegitimate”

Nashville’s NBC affiliate reports:

A proposed bill in the Tennessee General Assembly seeks to classify children born through artificial insemination as illegitimate children. Representative Terry Lynn Weaver (R-Lancaster) proposed HB 1406, which is intended to repeal the current statute regarding children born through artificial insemination.

TCA 68-3-306 provides for the child to be considered the legitimate child of a husband and wife if the child is born through artificial insemination and with the consent of the husband. “A child born to a married woman as a result of artificial insemination, with consent of the married woman’s husband, is deemed to be the legitimate child of the husband and wife.” (TCA 68-3-306)

However, the bill proposed by Weaver, with the Senate equivalent (SB 1153) proposed by Senator Joey Hensley (R-Hohenwald), would repeal that statute and label the child as illegitimate despite the couple being married and both consenting.

        My brother was whining a few years ago about how they needed to bring the shame of bastardy back. Supposedly it’s to stop people from having sex before marriage. I pointed out that 1) if that was the goal it never worked and 2) that it’s never the parents that suffer from the stigma, just the children and it’s not their fault for how they were brought into the world.

        But I thought the “stigma” was the woman having sex outside of marriage (or before marriage)? So this would be a child, wanted by both husband and wife, born, as a result of artificial insemination, by the wife while married to the husband (& I assume the wife is artificially inseminated with donor sperm. There are cases where a wife is artificially inseminated with her husband’s sperm, if he has a fertility issue, sometime the artificially insemination can provide a greater chance of pregnancy. If THOSE babies were classified as “illegitimate”, that would really be ridiculous) ? So how is the child “illegitimate”? And for what purpose would they be classified as such?

        No child is “illegitimate”. I can understand listing a biological father somewhere in the paperwork, for future possible medical questions, but this whole illegitimate versus legitimate thing does not belong on legal documents!

    On the up side, legitimacy or illegitimacy simply has no social meaning these days. On the down side, that could have legal meaning in terms of the father’s…er, I mean Male Caregiver’s…rights to the child in the event of death or divorce of/from the mother. But I guess the orphanage workhouse can always use another kid.

    Given that reproductive issues happen at every social level and in every political and religious path, this might not be the best thing to be running after. It’s going to impact people who actually vote for you, who are not going to be pleased that little Johnny or little Suzie is now a bastard.

        The difficulty with it being Kansas is that the law as drafted will have all sorts of unexpected side effects.

      Not really, no. Back in the Olden Days*, birth certificates would be stamped with “Bastard” in some states when the father was unknown or not the woman’s husband.

      The child still had the same legal rights as anybody else, but more subtle discrimination would obviously apply.

      When I was pregnant in 1980, I was told the word ‘bastard’ would be put on the birth certificate. It upset me because it might affect my child’s future. I went to the library and did some research but came up dry. My Great Grandma is the one to put it all in perspective. She asked me how often I used my certificate for things and I could only think of a very few times. Then she asked what was the information they were looking for. Mostly to make sure I was a US citizen. Then why was I worried about one small word that means squat? She also reminded me that my Mom’s father, her son, was also born a bastard and it was back when class was a bigger problem. It never got in the way of him serving in the Army, going on to college, hold several degrees or having a family of his own. It was not on my child’s certificate but I didn’t care thanks to Grandma Gum.
      This woman is just trying to open the door to stopping LGBT people from using AI at the expense of straight couples and single women. She doesn’t really care about the kids who probably will not suffer except in their own hearts when they read it. What a bitch.

    Hmm, I note her website has http://www.weaverhouse40.com/Response_to_intent_of_HB1406.pdf which means that the proposed bill is not intended to affect at least opposite sex married couples (and possibly not two women who are married).

    There is more going on here. It seems that people have argued two ways on the bill that this bill proposes for repeal. One that “husband” must be interpreted strictly and a couple where both spouses are female cannot use the law to have a child by AI and both being assumed to be parents without going through a legal adoption. The other that ‘husband’ should be interpreted to mean mother’s spouse. Repealing may mean going back to the standard common law interpretation that a child’s mother (in this case the woman who gave birth not a genetic or adoptive mother) spouse is presumed to also be a parent unless disavowed (and proven).

        Maybe, but the issue is now that SSM is legally required, there is a legal argument that that same right has to extend to same-sex couples. By forcing all married couples to engage in a second parent adoption, the state could forbid all same-sex couples from joint adoptions and argue they aren’t denying lgbt people any of the rights associated with marriage.

Her parents or siblings would have a claim to custody and could cut the husband out of the child’s life. Additionally, it makes dealing with medical records, schools, travel and taxes infinitely more difficult because the second parent and the child are not legally related.

      There’s also a long standing legal principle that any child born to a married woman during her marriage is de facto the legitimate offspring of the husband. I don’t know how this has interacted with the removal of legal significance from birth legitimacy.

    The Virgin Mary, Mother of Jesus Christ Himself, was CALLED BY GOD to conceive via a nontraditional method, according to this politician’s own Holy Book. Neither did Mary receive the seed from her betrothed, Joseph. And since Mary wasn’t married to Joseph at the time of Jesus’ conception, this bill would label JESUS CHRIST HIMSELF, Ms. Weaver’s professed Lord and Savior, an illegitimate child, for legal purposes. The irony and hypocrisy and prejudice and arrogance and ignorance of politicians like the one that sponsored this bill is positively galactic.
