BREAKING: Leaked Draft Executive Order Reveals “Sweeping Plan” To Legalize Anti-LGBT Discrimination

The Nation reports:

A leaked copy of a draft executive order titled “Establishing a Government-Wide Initiative to Respect Religious Freedom,” obtained by The Investigative Fund and The Nation, reveals sweeping plans by the Trump administration to legalize discrimination.

The four-page draft order, a copy of which is currently circulating among federal staff and advocacy organizations, construes religious organizations so broadly that it covers “any organization, including closely held for-profit corporations,” and protects “religious freedom” in every walk of life: “when providing social services, education, or healthcare; earning a living, seeking a job, or employing others; receiving government grants or contracts; or otherwise participating in the marketplace, the public square, or interfacing with Federal, State or local governments.”

The draft order seeks to create wholesale exemptions for people and organizations who claim religious or moral objections to same-sex marriage, premarital sex, abortion, and trans identity, and it seeks to curtail women’s access to contraception and abortion through the Affordable Care Act.

Language in the draft document specifically protects the tax-exempt status of any organization that “believes, speaks, or acts (or declines to act) in accordance with the belief that marriage is or should be recognized as the union of one man and one woman, sexual relations are properly reserved for such a marriage, male and female and their equivalents refer to an individual’s immutable biological sex as objectively determined by anatomy, physiology, or genetics at or before birth, and that human life begins at conception and merits protection at all stages of life.”

The breadth of the draft order, which legal experts described as “sweeping” and “staggering,” may exceed the authority of the executive branch if enacted. It also, by extending some of its protections to one particular set of religious beliefs, would risk violating the Establishment Clause of the First Amendment to the Constitution.

“This executive order would appear to require agencies to provide extensive exemptions from a staggering number of federal laws—without regard to whether such laws substantially burden religious exercise,” said Marty Lederman, a professor at Georgetown University Law Center and an expert on church-state separation and religious freedom.

White House officials told ABC News that the draft appears to be among the hundreds of executive orders that are circulating –- drafted by either the Trump transition team, the White House policy team or even by outside groups –- and that not all reflect administration thinking or likely policy. One official did not say who drafted this potential order, but did not dispute its authenticity. “We do not have plans to sign anything at this time but will let you know when we have any updates,” said Sarah Huckabee Sanders, a White House spokesperson.

Several outside conservative groups that have been pushing for similar actions have been pressing for something to be released surrounding Thursday’s National Prayer Breakfast in Washington. Tony Perkins, the president of the Family Research Council, told CNBC on Tuesday that he believed that “religious liberty” would be addressed in an executive action by Trump, despite the president’s statement earlier that day. “I think this is going to be addressed,” Perkins said. Perkins did not respond to requests for comment on Wednesday.

            Twice Hilary began her campaigns offering little more than a slightly kinder and gentler version of the status quo and twice modified her stance to embrace policies of her opponents, when people made it clear they didn’t like her corporate friendly policies.

            Four times people voted not just at the ballot (Primaries and Presidential), but with their hearts and wallets, for the guy who promised something for them The People, and not for “The Nation” or “The Economy”.

            And every time they’ve had that promise snatched away.

            One of Hillary’s many problems was the sense of entitlement she and her most vocal supporters brought to both election campaigns. And this time that was compounded by it being abundantly clear that the party had actively tipped the balance in her favour in the primaries.

            A lot of people stayed home simply because they all fondly believed that Trump didn’t stand a chance, so why effing bother.

            Unfortunately enough others, were pissed off enough at the promise of another four-eight years of death by a thousand cuts to piss in everybody’s wheaties and vote in a highly informal referendum to finish breaking what’s been broken since Reagan.

            Trump did not win this election. Hilary and the Democratic Party lost it, because she and they both made is abundantly clear by their actions that they had zero intention of doing anything which might stifle the flow of the corporate dollars which had become their bread and butter.

Until the court loses Kennedy nothing much has changed with the new justice. Hell, a replacement Scalia is just a replacement.

            The answer is, it depends. Registration for the draft is not being required to report for boot camp. When it comes time to conscript able-bodied people to serve in the military, then it is time to evaluate claims of conscientious objection.     I think it’s time to begin listing somewhere, ALL businesses, etc., that discriminate against the LGBTQ community – whether mom & pop or major corporations. I want to know what specific churches (not denominations) hate us so that I can avoid contact with their members and so I can let those members know why. The same for the patrons of the businesses. That way we can be sure to avoid, as far as is practical, spending any money with them and we can spread the word that they are bigots. I have basically decided, painfully so, that I will not travel to any red state. I have friends and family in those states but I refuse, as much as is practical, to spend any of my money supporting those people, businesses, economies. I know. It’s a broad brush I’m painting with and it’s like peeing in the ocean hoping to significantly raise the water level, but it makes me feel good to take that stand. I think every effort, however seemingly small, is significant in the end. IMHO the time has come to stop being ‘understanding’ and to adopt the Larry Kramer mantra, “Act up! Fight Back!” and do it with a vengeance!

      Federal law supersedes State law when it says it does. That’s why Alabama couldn’t keep its marriage ban for same sex couples. Federal law can set a floor – like for environmental regs or a ceiling. Other subject matters – like patent law – are said to have ‘field preclusion’ and States must not legislate the topic at all.

      Historically, civil rights fall into the ‘federal floor’ category. This EO seems to do the obverse and set a federal cap on civil rights.

      I’ll also say that it’s massively illegal in it’s current form. total bullshit. I’d even laugh it off but we’ve already seen the ‘muslim ban’ get enforced contrary to court order and in the face of Senators threatening to bring in federal marshals.     Well Woman exams appear to be something that a religious entity can object to. Women can get a free breast cancer and cervical cancer screen, but everything else can be jettisoned. Some of the folks here with lady parts may not be terribly fond of pelvic exams, stirrups, the dreaded two -fingered-poke, or an ice-cold speculum, but soon, you need not worry about them any longer. HPV screening is likewise out. Domestic violence screening is in, but only for women of “child bearing age” (apparently women aren’t assaulted prior to puberty or after menopause).

      I watched a video of when that mobil light lit aflame… It appeared that it was smoking for several minutes prior to the flames, with the smoke growing in intensity leading up to the flames appearing. From the angle of the video I watched, it was framed straight on in under fifteen feet away, It appeared that not only was there a pile of fuel to keep the generator running the lights spilled under it, that it self combusts from an electrical short or or damaged something contacting spilt oil/fuel inside and on parts. There was obvious drainage of liquid just as the flames appeared on the flow of dribbling fuel and then lighting the puddle, which fueled the entire combustion… “As you can see, they’ve set that light stand, that generator on fire,” the on scene reporter says into the LIVE SHOT!

        The struggles for civil rights and Indian independence, against apartheid and the Vietnam war – it’s hard to think of a nonviolent movement that has succeeded without causing its opponents a certain amount of trouble, discomfort and inconvenience.

        And economic boycotts – another sort of trouble and inconvenience – have proved remarkably successful in persuading companies to cease supporting repressive governments. Of course, nonviolence has often been met with violence, but one can only hope that our hearts have not so hardened that we, as a nation, would not be troubled and shamed by the spectacle of peaceful people being arrested and bloodied, as they were in Selma and Birmingham.

        So what can we do to protest our current government’s callousness about our environment and our health, its rampant greed, its disrespect for life, liberty and the pursuit of happiness?

        I believe that what we need is a nonviolent national general strike of the kind that has been more common in Europe than here. Let’s designate a day on which no one (that is, anyone who can do so without being fired) goes to work, a day when no one shops or spends money, a day on which we truly make our economic and political power felt, a day when we make it clear: how many of us there are, how strong and committed we are, how much we can accomplish.

        Meanwhile, I’m deleting my Uber account and adding Lyft (which donated generously to the ACLU) in its stead. Leaving Uber is not uncomplicated, and it’s taken me the better part of a day to persuade them to let me go. But in the process, the site asks subscribers why they are leaving, and it’s a pleasure – a small pleasure, but a pleasure nonetheless – to let them know.

        I do think, though, that we need to establish a legally recognized church/religion which incorporates LGBT concepts in its doctrine and as part of its tenets. The legal recognition would be key in strengthening the demand for respecting that religion. After all, you CAN discriminate based on sexual orientation, but NOT on religion… so why not create a religion in which sexual orientation is a key facet?

    Straight people better read this and pay major attention, too. This won’t just affect the LGBT community; the language there affects straight women (in multiple ways) and could even lead to straight men being fired if their boss decides its “immoral” that they ever have sex with a woman who they haven’t married. It opens the door for any boss who simply claims they’re religious to police everyone’s bedroom.

    There is a disconnect between Trump and the evangelicals that Trump has indulged to date. After all, the Republican Party platform which Trump gave Tony Perkins of the Family Research Council carte blanche to draft and pledged not to rewrite was a horribly anti-gay document. And my former Governor here in Indiana Mike Pence is a ridiculously anti gay zealot. But that does not mean that these drafts circulating thru Washington reflect an eventual order’s language. Trump likes to be taken at his word, and he says he will not roll back protections on gays. But he absolutely knows the motivations of Mike Pence in protecting religious freedom. And he willingly allowed Tony Perkins to draft the platform. So my prediction is that we will get a sweeping religious freedom executive order that tries to avoid direct confrontation with the supporters of gay equality. Many, many people are seeing these drafts. They have obvious constitutional problems. This is not a party platform where anything goes. This will trigger almost immediate litigation, no matter what the language. These issues are being taken up by State legislatures across the country and are being litigated with varying results. A sweeping executive order will just hasten Federal review. Let us hope it is narrowly drafted. Because the Supreme Court is about to get a new conservative member.
