BREAKING: Federal Judge Issues National Emergency Stay On Trump’s Executive Order Banning Muslims UPDATE: Stay Only Affects Current Detainees

According to multiple reports on Twitter, US District Judge Ann Donnelly just issued a national stay on Trump’s executive order banning Muslims from seven nations from entering the United States. Story developing…

UPDATE: The Verge reports.

The federal court for the Eastern District of New York issued an emergency stay halting President Donald Trump’s executive order banning entry to the US from seven majority-Muslim countries tonight, following widespread protests at airports around the country.

The court ruled on a habeas corpus petition filed by the ACLU on behalf of Hameed Khalid Darweesh and Sameer Abdulkhaleq Alshawi, who were denied entry to the US upon landing at JFK airport in New York City and detained indefinitely by Customs and Border Patrol.

Darweesh spent a decade working for the United States military in Iraq as an interpreter and engineer and had been granted an entry visa after background checks; Alshawi had been granted a visa in order to join his wife and son who are already permanent residents of the US after their similar service with the US military.

            Instead Democrats and Republicans spent their time demonizing one another while ignoring the real issues with predictable results – close to 50% of the eligible electorate just ignored them, refusing to vote or engaging in protest votes and many of those same people went on to build unions and mass movements for change.

            Those mass movements are the only vehicles for real change and their growth and militancy will gut the Trumpites, just as they gutted the Clintonites and any replacements the twin parties of the rich vomit up to replace them.

          There has been no ruling for this sweeping of an executive order, and the decision you refer to had comments about there were limits on executive. As with almost every decision vwith the Roberts court, they narrow the ruling. The exception is the second on citizens united, the anti voting rights act, both upsetting plus 120 and plus 50 years of settled law. Roberts is fine with sweeping decisions when it is the right wing agenda.

The attorneys will make that call but if it were me, I’d tell them to stay put. Also, the JCS would not necessarily carry out an order an order from a deranged Trump administration to nuke North Korea, for example, if they did not feel it was in the national interest. If this sounds like a potential coup, it is– and we should be happy about it. But the Joint Chiefs or at least the head of the JCS HAS to be involved — the Defense Secretary (taking orders from the President or National Security Advisor) has to have some way of ordering the military into position. You need a command structure in place.

    One disqualifier may be the Establishment clause. The Guardian:

One section of the order allows the government to make exceptions to its own refugee injunction “when the person is a religious minority in his country or nationality facing religious persecution”. What used to qualify for refugee status was each individual’s dire humanitarian need to escape deadly oppression of any sort. Now, it’s being non-Muslim among the Muslims.

      I’ve read that rail freight volume is a leading economic indicator. It is down 10% over the past two years as of October. Most of the decline, one article reads, is due to things like the energy sector (coal, petrol) changing due to plant changes and OPEC. However, a more troubling sign is a decrease in intermodal (shipping container) traffic.

      If you drive around, notice the number of idle rail cars parked. Where I live, they’re using the old GM plants rail lines and redundant tracks for storage. It is quite noticeable.

      First, had the order actually included any countries whose citizens have acted as terrorists in the past, I might agree with what I believe is the underlying sentiment – to protect the USA. (The part where I would in any case disagree is in implementation; there are better ways to do this.) As it is, it seems like grandstanding. In reality, Trump ought to have suspended travel by every nationality, just to be safe.

      Second, while the US has an unchallenged right to ban whomever it chooses from travelling to its shores, the concept of green card holders already in the US being OK, while green card holders travelling to the US not being OK appears a little strange from a practical standpoint. The next logical step is to pass a law to revoke green cards for citizens of these countries, which I assume is coming, but I would have expected this to be put in motion at the same time.

      Third, part of the point of courts in a democracy is to challenge the executive and legislative branches, an idea that germinated in the 1620s (so it’s hardly new). Your concept of democracy seems more akin to majoritarianism, where a vote of 50%+1 allows the majority the unfettered right to do as it pleases. Sort of like in countries like Russia or Turkey.

        I’m not sure. I’m not a legal expert (or even try to play one on Disqus) 🙂 But, to me, a nationwide stay by a Federal judge is a nationwide stay. I don’t think folks can just decide on their own to ignore it.

        Of course, I also read that the White House issued a statement saying the executive order is still in full effect. But, when has this white house ever made statements based on reality or truth?

          I’m ok with having voted for him, still. I’m amused by the fact that the person who told me to vote for Justin was Steven Harper. (he did, in 2013. I had advised him that if he wanted to win re-election he’d need to decriminalize pot. He told me they’d virtually done that, I was mean and didn’t correct him.)

      The Supreme Court stood up for the Cherokees when Jackson ordered them forcibly removed from their homes to a reservation. Jackson refused to obey the Court. I don’t know what smart-assed comment he made when he VIOLATED the Constitution by disobeying the Court’s ruling in their favour.

      I think the story–their forced march to the reservation, the confiscation of almost all their goods by white people–is called the Trail of Tears.

      I don’t know if Trump admires the racist bastard.

      Look down-thread a ways for posts confirming that some border agents have refused–or were refusing–to obey the stays, probably because Trump ordered them not to.
