TEXAS: Proposed GOP Bill Makes Abortion A Felony

The Texas Observer reports:

A Republican lawmaker filed the “Abolition of Abortion in Texas Act” Wednesday, which would ban and criminalize abortions in Texas at any stage and direct state officials to ignore federal law established by Roe v. Wade.

House Bill 948, authored by state Representative Tony Tinderholt, R-Arlington [PHOTO], is the newest and most straightforward attempt by Texas Republicans to force the U.S. Supreme Court to revisit the landmark 1973 decision that established the right to terminate a pregnancy under the 14th Amendment.

Previously, as with HB 2, GOP lawmakers have hidden behind the thin veil of “women’s health” when making laws that limit access to abortion in the state. But the new proposal is clear in its motive and comes after the Republican Party of Texas declared “abolishing abortion by enacting legislation to stop the murder of unborn children” as a priority for the legislative session.

The proposal would remove the exception for abortion in the state’s penal code for criminal homicide, meaning women and abortion providers could face felony charges for the procedure. The bill makes no exception for rape or fetal abnormalities.

Back in 2015 the five-times-married Tenderholt filed a federal complaint against a local judge who had performed a same-sex marriage. He filed the complaint against the wrong judge.

I also had “complications” during my first pregnancy so I can’t have another safe pregnancy. Can’t. I’m lucky in that I can afford an IUD and have a terrific GYNO. But if the IUD fails and I accidentally get pregnant, I would have to abort. Just exactly who are these laws trying to protect? My living child? Me? My husband?

        No, these laws are to protect white male privilege. They use religion as the wrapping paper, but they exist to keep women second class.

    Of course. This makes perfect sense. In addition, William Pryor of the 11th U.S. Circuit Court of Appeals, recently met with Trump for consideration as a Supreme Court nominee. Pryor is more than just anti gay. He firmly believes that homosexuality should be made a criminal offense, period. Not just gay sex but being gay. Every flavor of gay. Every color.     Question, if god forbid Roe v Wade is overturned, could the legal case be made that forcing a woman to carry a baby to term (especially if died in utero or representing serious or fatal risk to the mother) is torture?

      Probably not, because the foundational principle of Roe is that obtaining medical care is a woman’s right, and up to her to select (abortion was merely the procedure requested by Roe in the case); repealing Roe enables fathers, husbands, brothers and eldest sons everywhere to overrule their daughters’/wives’/sisters’/mothers’ healthcare decisions, right up to end of life care and emergency lifesaving. THAT was what the Schaivo case was about.

      If making abortion was the goal, they’d go after Griswold, which is the decision that made abortion legal. You will notice they’re not doing that.

    The problem with this tactic, besides the obvious, is that there is no new evidence to provide the courts let alone SCOTUS on Roe v Wade. Without new evidence against abortion there is no court case to bring before them. They can’t just create a law and then take it through the courts crying the same evidence as in Roe v Wade. They need new compelling evidence that shows Roe v Wade was a bad decision. Sorry guys, Roe v Wade is settled law no matter how much you flop on the floor throwing a two year olds tantrum.

Afterall, the Texas legislature knows full well what the current federal law is and what this Texas law would illegally try to do!
