McCrory To Withdraw Statewide Recount Demand If Durham County Recount Produces No Change In Result

The Raleigh News & Observer reports:

Gov. Pat McCrory is ready to withdraw his request for a statewide recount if a new hand count of Durham County votes produces the same results as Election Day, his campaign announced Saturday evening.

The governor is asking the N.C. State Board of Elections to hold an expedited hearing on an appeal of the Durham County election board’s denial of a request for a recount there. The state board on Saturday called for a Sunday afternoon meeting by phone to discuss this matter and a federal lawsuit challenging same-day registration ballots.

β€œIf a Durham recount provides the same results as earlier posted, the McCrory Committee will be prepared to withdraw its statewide recount request in the Governors race,” the campaign’s news release says.

McCrory has been trailing Attorney General Roy Cooper by about 7,700 votes as counties around the state finalize their counts with provisional and absentee ballots. McCrory, in order to meet a deadline last week, gave notice that he would request a statewide recount. He is permitted to demand a recount as long as the margin between he and Cooper remains less than 10,000 votes.

Durham has been at the center of allegations of voter improprieties, mostly promulgated by Republican officials and the McCrory campaign, in complaints filed in about half of the counties. The first county election boards to review those complaints, however, have not found significant abuses. In addition to the computer glitches, the eligibility of a number of votes has also been contested, such as accusing voters of being felons, voting in two states or that ballots were cast be dead people.

            CA just legalized it. One of the initiatives provisions was if someone had been arrested and charged with possession, small amt of course, they could go to court to have their record cleared. One of the best provisions I think I’ve ever read.

      I was once walking down Market Street in San Francisco and came upon some people registering voters. “Are you registered to vote,” I was asked. “Yes,” I replied. Then I was handed a number of political flyers from San Francisco candidates. I said, “No, thanks. I’m registered in Oakland.”

      Immediately, the man lowered his voice to a whisper and asked, “Well, do you want to vote in San Francisco?”

      In any City Hall it’s probably a short walk from the office of the Department of Health to that of the Board of Elections. It can’t be difficult to identify the recently dead registered voters who have not yet been purged from the rolls.

      And then, of course, there is Chicago.

        And I have a little problem with that little story of yours. BTW in California the voter rolls are cross checked with the records of deaths. I had a relative who used to do that work in SF City & County.

        As for your Chicago comment that little exercise in urban legend has been debunked numerous times. But I do recall when a certain federal prosecutor who happened to be a Republican once announced he wanted to do an investigation into voting irregularities in Chicago not long before old man Daley died. Daley announced he welcomed the investigation and demanded it be expanded to include the counties surrounding Cook County.Cook County [Chicago] was reliably Democratic while the surrounding counties were just as reliably Republican. Needless to say the idea died a quick death.

    “Accepting the Elections results” does not mean that a Presidential Candidate doesn’t have a LEGAL RIGHT to challenge the results!… and, based on the number of computer scientists (and the wack of lawyers!) that met with Hillary Clinton’s Campaign Team members on Thursday, November 17, there’s a clear cause for concern! And as for the suggestion offered up by sundry that Hillary Clinton supporters have been “harassing the Electors”!… well… and again!… there’s a LEGAL RIGHT to convince Electors in a given state to concede to a National Popular Vote!

    Indeed!… the electorate have as much of a Right to claim Ballot Results Irregularity– at least!– as any Candidate has! In fact, as Candidates– in a “democracy”!– exist to represent the “will” of the people, it’s my view, that the Right of the people to “Elections transparency”, “trumps” that OF ANY CANDIDATE! And so… regardless of any set timetable for Candidates to invoke some action on suspected problems with Elections transparency (and re this present Election process, by this past Friday, November 25, 2016!), both Constitutional and Tort legal actions are within the Rights of the average American voter to pursue! And!… I should point out, action, on a NUMBER of valid legal grounds!… e.g., the Right to a Paper Ballot (regardless of the state in which one has voted!), and the Right to a “None of the Above Ballot option”!

    To close… what appears to be happening in N.C., is a TORTIOUS breach of the DUE PROCESS CLAUSE under the FIFTH AMENDMENT of the EQUAL PROTECTION AND BENEFIT CLAUSE of the FOURTEENTH AMENDMENT, re the Right of every American citizen to invoke, and to have upheld, THEIR RESPECTIVE, AND COLLECTIVE RIGHT to seek Ballot Transparency, and Elections Transparency, generally! And!… based upon CONFIRMABLE EVIDENCE brought to the attention of the “servants of/ to our Elections Process” by ANY CITIZEN… OR GROUP OF CITIZENS!… that any aspect of the U.S. Elections System is amiss!… such an individual, or group, should have Equal Protection and Benefit to effect (through the Due Process Clause!… and through the “servants of/ to our Elections Process!) A REVIEW of ANY AND ALL EVIDENTIARY CLAIMS OF ANY AND ALL SAID BREACHES OF ANY AND ALL ASPECTS OF ANY GIVEN ELECTIONS PROCESS!
