Mike Pence Affirms That Trump Would Roll Back Obama’s Guidelines On Transgender Student Rights

Mike Pence has indicated a Donald Trump administration would roll back guidance issued by the Obama administration that prohibits schools from discriminating against transgender students and assuring them access to the restroom consistent with their gender identity.

Pence made the remarks on the day after the vice presidential debate on the “Family Talk Broadcast” hosted by Focus on the Family founder James Dobson. The Christian Post, a conservative media outlet, reported on the interview after obtaining an audio file in advance.

Dobson’s question was not just about the guidance, but a rule from the Department of Health & Human Services mandating non-discrimination for transgender people in health care, including transition-related care and gender reassignment surgery, but Pence’s response was focused on the transgender student guidance.

Accusing the administration of overreach, Pence said the trans initiatives demonstrate “there’s no area of our lives too small for them to want to regulate, no aspect of our Constitution too large for them to be willing to ignore.”

“These questions that come up, Donald Trump and I both believe not only can be resolved with common sense at the local level, but they are every single day, working with parents and administrators and teachers,” Pence said.

Trump has also repeatedly vowed to sign the so-called First Amendment Defense Act, which would legalize business discrimination against same-sex couples. Last week Trump sent a letter to Catholic Vote, home of former NOM communications director Thomas Peters, in which he promised to protect Catholics against evil homosexuals.

  • What does “mandating non-discriminating” regarding health care ( particularly transitioning)?

    While transgender identity is real, not everyone who claims to be transgender in early adulthood (or younger) retains this identity. Some have sexual identity issues they haven’t sorted out.

    I’m just wary of this insistence that questioning a transgender identity necessarily amounts to hatred and bigotry. It does not. Psychiatrists and counselors need to be able to work with their patients in a way that doesn’t put them at risk for a lawsuit simply because they’re seeking what is best for that particular patient.

    I’ve just read way too many comments here that seem to imply that parents should rush their children off for sex-reassignment surgery as soon as their kid expresses gender identity issues, regardless of their age.

      Well, the Ayatollah was personally moved by an actual transwoman’s story when visiting like Spain or something: the only problem with Iran’s recognition of *trans* people is that they still threaten gay people with death sentences, so too many cases are gay people having the surgery to try and avoid their own deaths and those of their partners, …not being actually trans, though, this basically doesn’t work out at all for either partner.

      The odd case of Iran actually kind of proves it’s BS to claim that anyone does this whimsically or that trans people are actually ‘just about being gay.’ When literally all but forced to do this, gay people are generally miserable. (And trans people are still largely shunned and oppressed by the rest of the population anyway, once on their own: (Cause if they’re ‘just gay people avoiding actual execution,’ their gay partners are *gay* and tend to lose interest.) I think Iran just has better social services regarding homelessness etc in general, ironically, than we do in some regards.

      The solution there is of course to stop persecuting *gay* people and let the trans people get their treatment as needed, too. Here in the US having massive freakouts about calling them ‘predators’ with parts they don’t want, but which you want to stop them getting *rid of* …is insane and backwards in its own way, obviously.
