Roy Moore Appeals Being Shitcanned

Via press release from the Liberty Counsel:

Alabama Supreme Court Chief Justice Roy Moore has filed an appeal of the decision issued by the Court of the Judiciary (COJ) on September 30 to suspend him for the remainder of his term, which runs through January 2019. A new panel of judges will need to convene to hear the case and all the sitting justices should be recused.

The Judicial Inquiry Commission (JIC) previously requested that the Chief Justice be removed from the bench. Under the COJ rules, removal requires a unanimous 9-0 vote by the members of the COJ, which is made up of judges, a lawyer and laypeople. Absent a 9-0 unanimous vote, the COJ cannot remove a judge from the bench. But in an unbelievable violation of the law, the COJ suspended him without pay for the remainder of his term. When his term expires, he will be ineligible to run again for election as judge due to his age. So the suspension until the end of his term is a de facto removal from the bench.

โ€œLiberty Counsel and the Chief Justice have appealed this case to the Alabama Supreme Court. These baseless charges should be dismissed and the Chief Justice should be reinstated,โ€ said Mat Staver, Founder and Chairman of Liberty Counsel. โ€œTo suspend Chief Justice Moore for the duration of his term is a miscarriage of justice and the same as removal. The COJ lacked the unanimous votes to remove the Chief, so the majority instead chose to ignore the law and the rules. We will continue the fight for justice to prevail in this case.โ€

  • bkmn

Hey Roy – if you want to win a case you should sue your lawyer. Mat Staver bragging to his sheeple about what you did was what sealed your fate.

    • bambinoitaliano

Shhhhhhhhh why are you giving billable lawyer advise to that asshole?

  • I wrote about this earlier. The appeal requires a cash appeal bond to offset court costs. No mention of that from Mr. Staver. These could be the two dumbest lawyers in America

    • LackofFaithify

Moore has his own, cough, non-profit, cough that is now run by his wife. I am sure they will help out this random person in need.

  • lukefromcanada

I am sorry but is Liberty Counsel a one man operation? The only name that ever seems to pop up is Mat (minus one t, and a hell lot more in his head) Staver

    • No but he is responsible for most of the communiques

    • bkmn

His wife Anita is a lawyer with LC also but she stands behind her man and collects her checks.

      • Steverino

Except for when she says: “get thee behind me, Satan.”

        • BearEyes

          push, push, in the tush.
Oops – had a satanic moment there ๐Ÿ˜‰

    • Traxley Launderette

They put out a desparate help wanted ad a while back. I think that the highway crews who scoop up roadkill got more serious responses than Staver did.

    • bambinoitaliano

He has to bank in the billing hours for the year end bonus.

    • McSwagg

I bet they have a whole slew of volunteer (non-paid, of course) “Prayer Warriors.”

  • S1AMER

Roy Moore is one of those people who make me wish there really was a god, and he’d die, and She would tell him exactly why he’s going to spend eternity where he belongs!

    • bkmn

      Right next to Antonin.

      • ByronK

        And Phyllis.

        • pj

          she is prone to spinning

          • bambinoitaliano

Just to pump up the hell fire for the roasting.

          • pj

that old chicken had little to roast.

  • Has Staver ever won a case? Seriously.

    • Traxley Launderette

      Nope.

    • LackofFaithify

You would think quantum probability would have given him one win by now. lol

      • Silver Badger

There has to be people on the scale who always win and those who never win. Fortunately, Mat Staver has found his spot.

        • c

True enough … a perpetual loser … who is laughing all the way to the bank.

      • McSwagg

Mat doesn’t believe in Quantum Theory. It directly contradicts “Creation Theory” and “Creation Theory” clearly states that the validity of any “theory” is established by belief alone. “Creation Theory” requires cause and effect for anything that happens. We know the effect. I’ll leave the determination of the cause as an individual exercise.

Also, the Heisenberg Karma Principle states that one cannot be a complete asshole and also win at the same time. The two are mutually exclusive.

    • PLAINTOM

Depends on your definition of win, no state bar has taken away his license yet.

      • Joseph Miceli

OT, but … how does work? If you pass the bar in New York and then move to Florida, do you have to pass the bar there? How about Louisiana? I know our legal system descends from French Common law and it is very different.

        • Jerrelt

Many states allow reciprocity, meaning if another state recognizes their bar members, they will recognize that states bar members. Florida however, does not grant reciprocity to any state, so no state grants reciprocity to Florida.

          • Joseph Miceli

Thanks! So If you move to Florida, you have to take the bar all over again? Wow, that sucks!

        • Danieruw

My mother got her law degree and passed the bar in Indiana. When we moved to Louisiana a few years later, she had to study all over again. I remember coming home from school countless times and finding her surrounded by thick books all about Louisiana law. She HATED it but passed on the first try. She had to do it all again when we moved to Wisconsin ten years later.

    • bambinoitaliano

He won as much as Trump successes in his businesses without declaring bankruptcy.

    • Todd20036

      Winning is for chumps.

As long a he gets his fee, or gets donations by pleading martyrdom, that’s all the “win” he needs.

      • Piercedchrlz

They can just set up a GoGriftEm account to pay for it.

        • Nic Peterson

          GoFundie!

    • NancyP

I don’t think that people actually expect him to win. It generates publicity.

      • Herald

it generate publicity and donations which is what really matters to Staver.

        • The_Wretched

He’s a millionaire on this grift.

          • Curieux Bleu

A mere million is not all that much these days for an impoverished “PRO BONO” disciple of Christ’s Wrath against the same sex.

His super luxurious Estate Mansion in Lake Mary, FLA was valued at 3 million (and that was before prices improved down there.)

And the ungodly realty taxes they have to pay!!! … just getting by is a monthly struggle, I tells ya! The Wolf is always banging on their door.

This saintly man and his gun toting bible sanctioned wifey can’t even afford a christian divorce if they were to need one — the irony of it all.

    • Henri205

He has the best people, they’re tremendous, the very best, they’re so smart, they know everything, I only hire the best.

  • TheManicMechanic

So the Blathery Counsel takes on yet another sure-to-lose case. That’s a w00t.

    • BearEyes

fund-raising against those godless heathens who attacked this “man” doing the work of god
      /s

    • bambinoitaliano

Just a quota the firm has to meet for tax deduction.

  • ByronK

I do take great comfort in Mr. Staver’s track record of success. Miscarriage of justice? You, sir, are a walking legal abortion.

  • Kelly Lape

I think Judge Moore should pray on it. His faith in the 10 Commandments and old testament are all he needs. Or has his faith drained from him in the face of man?

  • Sam_Handwich

from everything i’ve read, a suspension is perfectly within the JIC’s powers.

it’ll be interesting to see what the ASC says

    • BuckyB12

And didn’t I read that the vote to suspend WAS unanimous? So whomever didn’t vote to remove him agreed to the suspension.

      • yes, the vote to suspend was unanimous–Staver is trying to argue that since Moore will never be able to serve again because of age, they really voted to remove.

        • ChrisMorley

But sadly there is no legal time limit to the period of suspension that can be imposed. Staver has taken on another utterly hopeless appeal.

  • Traxley Launderette

Good luck, asshole, finding a judge who won’t justifiably laugh at your pathetic and well-deserved situation, and who’ll toss your jeebus-loving ass into the Gulf of Mexico.

    And I hope it’s a lesbian.

    • Silver Badger

This is the Alabama Supreme Court. All good buddies. This may have to go to the Supremes after the election.

      • BobSF_94117

        1) I don’t think his fellow jurists like him much.

        2) The SCOTUS doesn’t have jurisdiction over AL state laws. He would have to appeal based on Due Process or Free Speech or something to approach the Supreme Court. (I don’t doubt Staver would dream up some appeal, but I can’t imagine SCOTUS taking the case.)

  • Bryan

I really wanna see Roy Moore star in Defending Your Life. The appeals would be brilliant.

    • Deanobear

Just bought it off iTunes about an hour ago ๐Ÿ˜œ (the original I mean)

  • Sam_Handwich

The Alabama Court of the Judiciary is a constitutionally mandated court component of the state judicial disciplinary agency in Alabama. The court convenes to hear complaints filed by the Alabama Judicial Inquiry Commission, and has the authority to sanction, censure, suspend, remove or retire judges who have committed misconduct or are incapacitated

Oh Sam, you and your facts!! Remember, it’s Staver.

      • abel

Yeah, Staver only recognizes the Babble.

One problem is even if this asshole gets the boot, his fellow theocrat Tom Parker will still be on the bench.
And if you want to know what Tom Parker’s claim to fame in Alabama is, it’s co-founding the Alabama Family Alliance AKA Alabama Policy Institute, which is linked to Focus On The Family.
Like Moore, he has also suggested Alabama shouldn’t listen to SCOTUS on this issue, which is why there is a complaint filed against him as well.
Yes, we can celebrate when this fool loses his appeal but we’ll really be able to celebrate when Parker is given the heave ho as well.

That rationale is only good for and used when the results are in the righteous one’s favor and detrimental to the opposition. Other than that, it is apparently not permitted to acknowledge that your loss just might be God’s will. After all, God’s will is always in agreement with the self-righteous petitioners. In this case, God just wants him to fight on and fight harder so that his martyrdom will be an example to others of weak faith.

Majorly O/T but I figure someone here would know. I want to shampoo my carpet. Any tips? How long should I go without walking on it? How best to dry it?

    • Ben in Oakland

Rent a quality shampooer and ask them. Not the kind you get occasionally at supermarkets.

    • Martin

Rent a machine at a home-center big-box store. They work well. Everything is included, including instructions. They suck most all of the detergent mixture back out of the carpet, don’t think you really have to wait to walk on it.

    • pay for a pro. if you animals, then i really mean that. i agree with Ben in O. the chain store rented ones are a headache and a ripoff and don’t work. but someone who works, and will clean an entire floor, in an hour for 75-200$ is totally worth it. i had a home where a sad, sick, smelly dog lived before i had the carpets cleaned. it was disgusting, but the cleaner made them shiny and new.

    • kareemachan

      1. Use a commercial machine (rented) and take it back if it isn’t working correctly (personal experience).
      2. Clean the carpet on the warmest day possible to help with drying (this may not help you right now).
      3. Use fans to blow air through your house/apartment.
      4. Don’t put furniture back on it til dry (they’ll cause rust spots or discoloration).
      5. If you rent a good machine, it doesn’t take long to be dry to the touch, although it won’t be perfectly dry.
      6. FOLLOW INSTRUCTIONS.

Thus sayeth someone who shampooed their carpeting this summer. And OMG, the dirt the shampoo machine got out….

    • another_steve

Do you own a carpet that shows dirt? Faux pas, that.

Carpeting is out these days (everyone wants wooden — or faux-wooden — floors these days), but if you’re putting down new carpet, buy only shades that don’t show dirt.

(The man and I bought a house with carpeting that shows neither dirt nor cat vomit stains. With age comes wisdom.)

      • safari

I *hate* carpet. But I’m in an apartment. (An edit because I despise it: I get it. People wanted full-floor rugs. That was a dumb idea.)

        • McSwagg

I don’t know what state you’re in or what laws govern rentals, but it may be possible to have the landlord cover the cost (or some of it) as ‘maintenance’ if you’ve lived there for a few years. I know that in some states it’s the responsibility of the tenant to clean the carpets when they move out. In other states, carpet cleaning is considered part of acceptable ‘wear and tear’ that is the responsibility of the landlord.

    • I’m in the “pay for a pro” column. If you can’t afford that, rent one of those steamer machines — they actually work better than straight-up shampooers.

If I remember correctly, she’s still voting for him. Btw, her outfit is “Nancy Reagan only 50 years younger and at a gala on the beach.” I’m not sure how I feel about it, but it’s different than the usual red dress / pearls. Maybe replace the giant beads with shells…?

      • another_steve

Look, hon… no gay man would have outfitted her like that. Please. We all know that.

One of the reasons the Republican Party is sinking and doomed to going extinct is that not enough gay men are employed by that party.

        • safari

It’s just hard that it’s informal from the shoulders down with a giant faux-pearl party bead necklace around the neck and librarian for the head.

          • another_steve

Please. You don’t need to explain it to men with the gay gene reading here.

            It’s obvious.

…but I’m terrible at fashion. So I feel a need to get feedback ๐Ÿ™‚

          • EweTaw

Those are Betty Rubble beads. Not pearl party beads.

          • safari

Traditionally, no. I seem to remember a photo of a guy wearing beads of such size only in a slight green… being quite sexual. It’s where my mind went.

          • Adam King

            Remember pop-it beads?

          • safari

No. I had to look them up.

Yeah, but the dumb ass says she’s still voting for him. WTF is wrong with these people?

      • TrollopeReader

        a lot.

  • Lazycrockett

well looks like nobody watched the VP debates last night. Ratings were on par with the Cheney/Leiberman debate and the Gore/Kemp debate. Yeah they don’t ring a bell either.

    • Sam_Handwich

well it’s 2016, analysis and replays have been all over the internets today. my impression is that it’s mostly cases of Pence being ridiculed (from both sides, for obviously opposite reasons ) for failing to defend Trump. so he’s basically being called a coward or an opportunist. whereas Kaine may have ‘interrupted too much’, but his image remains unchanged

      • joe ho

Chris Matthews was drooling over Pence’s disciplined performance and said it marked a turning point in the campaign. But like David Brooks, Tweety tends to mistake his random thoughts for deep insights.

        • Spending 90 minutes telling bald-faced lies ought never be considered a winning debate performance.

Ohmigod,,, you remember Joey Stefano. Love to you, Henry.

Half the kids on this fuckin’ blog weren’t born yet when Joey was showing his butt, but we remember.

Nature destroyed its butt mold after creating Joey Stefano, evolutionary perfection having been attained.

  • O/T It is entirely possible that one of the many reasons Trump hates and loathes Clinton so much — besides the fact she’s a “broad” — is because of this:

At a rally Tuesday in Arizona, Donald Trump sought to blame Hillary Clinton for his own low tax bills. He asked:

“After years of failure, she complains about how I’ve used tax laws of this country to my benefit. Then I ask a simple question: Why didn’t she ever try to change those laws so I couldn’t use them?”

Well, maybe Clinton didn’t just try to change laws Trump used, but actually got them changed, when she was in the Senate in 2002.

    http://www.businessinsider.com/why-did-trump-pay-so-little-tax-2016-10

    As Digby remarked earliter today:

If this speculation is true, Clinton did help pass a law designed to stop greedheads like Trump, who may have taken the largest (Net Operating Loss writeoff) in the country in 1995, from cheating the taxpayers by taking advantage of an accidental loophole to save his dying company from extinction. It figures that would be how he did it.

    • A tangent: I’ve been noticing ads on buses and at bus stops for the Chicago Marathon, showing the runners crossing the Michigan Avenue Bridge in front of the horrible Trump Tower. “TRUMP”, which is two stories high and about six stories up — can’t miss it from the bridge — has been photoshopped out of the image.

Perhaps, but I’m not quite so sure. Even those who basically agree with him sold him out, so I suspect they were thinking, “But NOO, you had to keep being a drama queen, didn’t you?”
